Based on the provisions of Clause 1, Article 50 of the 2015 Law on Military Service, it is stipulated as follows:
Regimes and policies for non-commissioned officers, enlisted soldiers on active duty, discharged, and their relatives
1. For non-commissioned officers and enlisted soldiers during their active service:
a) Promptly provided with adequate and quality food, supplies, military gear, medicines for disease prevention and treatment; ensured accommodation, monthly allowances, essential goods, and cultural and spiritual needs suitable for the nature of the army’s duties; ensured policies during holidays and Tet; provided healthcare when injured, sick, or involved in accidents, as prescribed by law;
b) From the thirteenth month onwards, entitled to leave policies; sudden leave cases are regulated by the Minister of National Defense;
c) From the twenty-fifth month onwards, entitled to an additional 250% of their current monthly military rank allowance;
d) Counted as members of their families when their families are allocated or adjusted residential or housing construction land, and agricultural land;
dd) Counted the time of active service into their working time;
e) Entitled to postal service preferences;
g) Commended for achievements in combat, work, or training as prescribed by law;
h) If injured or sick while on duty, entitled to preferential policies as prescribed by law;
i) Guaranteed social insurance benefits and health insurance as prescribed by the Law on Social Insurance and the Law on Health Insurance;
k) Temporarily deferred and exempt from interest on loans from the Social Policy Bank if they were members of poor households or students before enlistment, per the law;
l) Given priority in military recruitment.
Thus, based on the above provisions, citizens serving in military service from the 13th month onwards are entitled to leave policies. Sudden leave cases are regulated by the Minister of National Defense.

Additionally, according to the provisions of Article 6 of the 2015 Law on Military Service:
Obligation to Serve on Active Duty
1. Male citizens of military service age are obliged to serve on active duty in the People's Army.
2. Female citizens of military service age during peacetime, if voluntarily and if the army needs, are allowed to serve on active duty.
Thus, based on the above provisions, male citizens must serve military service within the legal age range. In other words, it is a mandatory duty for male citizens.
For female citizens, the 2015 Law on Military Service extends the regulation, allowing female citizens within the legal age range to volunteer for military service if the army needs. This regulation does not mandate female citizens of military service age to enlist. Female citizens during peacetime enlist voluntarily and are accepted by the state.
- The current age for conscription is stipulated in Clause 1, Article 4 of Circular 148/2018/TT-BQP, as follows:
+ Citizens from 18 years old to the end of 25 years old.
+ Male citizens trained at college, university levels who have postponed enlistment once for a training course at a level are conscripted until the end of 27 years old.
Who is exempted from military service in Vietnam?
Based on the provisions of Clause 1, Article 41 of the 2015 Law on Military Service supplemented by Point c, Clause 1, Article 49 of the 2019 Militia and Self-Defense Law, the following cases are exempted from conscription:
- Insufficient health for active service as concluded by the Health Examination Council;
- The only laborer directly supporting dependents who are unable to work or are under working age; families suffering severe harm in terms of people and assets due to accidents, natural disasters, dangerous diseases as confirmed by the communal People's Committee;
- One child of a war invalid, a person contaminated with Agent Orange with a working capacity reduction from 61% to 80%;
- Having a sibling currently serving as a non-commissioned officer or enlisted soldier; a non-commissioned officer, soldier performing duty in the People's Public Security;
- People in the resettlement area for 3 years since relocation to especially difficult communes under the state socio-economic development projects as decided by the provincial-level People's Committee or higher;
- Officials and public employees, youths mobilized to work in areas with particularly difficult socio-economic conditions as per the law;
- Studying at general educational institutions; undergoing regular higher education at higher education institutions, undergoing regular college education at vocational education institutions during the time of a training course;
- Permanent militia members.
Citizens in the above cases are exempted from conscription in 2024.
Additionally, as per the provisions of Clause 2, Article 41 of the 2015 Law on Military Service, the following cases are exempted from conscription in 2024:
- Children of martyrs, children of Grade 1 war invalids;
- One brother or sister of a martyr;
- One child of a Grade 2 war invalid; one child of a person with a working capacity reduction of 81% or higher; one child of a person contaminated with Agent Orange with a working capacity reduction of 81% or higher;
- People engaged in cryptographic work who are not military personnel or People's Public Security officers;
- Officials and public employees, youths mobilized to work in areas with particularly difficult socio-economic conditions as per the law for 24 months or more.
Additionally, citizens eligible for temporary exemption from conscription, if no longer subject to the reasons for the temporary exemption, may be conscripted.
Citizens eligible for temporary exemption or exemption from conscription, if volunteering, are considered for selection and conscription.
