How is the Purchase Price of Automobiles in People's Armed Forces Units Regulated? In What Cases Can Automobiles in People's Armed Forces Units Be Liquidated?
What types of specialized automobiles are included in the units of the people's armed forces?
Pursuant to Clause 1, Article 5 Decree 85/2018/ND-CP, the regulations are as follows:
Standards and norms for the use of specialized automobiles
1. General specialized automobiles include: Specialized automobiles in the medical field; automobiles with special structures (money transport vehicles, laboratory-equipped vehicles, crane trucks,...); automobiles with specialized equipment or marked with signs or identifiable features (vehicles with satellite transmitters and receivers, mobile broadcasting vehicles,...); trucks; pickup trucks; automobiles with more than 16 seats as stipulated by the Government of Vietnam in the standards and norms for the use of automobiles.
2. Specific specialized automobiles are those equipped with specialized devices or special structure according to professional requirements for national defense and security.
3. The Minister of National Defense and the Minister of Public Security are responsible for:
a) Issuing standards and norms for the use of general specialized automobiles as prescribed in Clause 1 of this Article for units of the people's armed forces under their management after reaching a consensus opinion from the Ministry of Finance regarding the types and quantities of vehicles;
b) Issuing the list, subjects of use, and quantity of specific specialized automobiles for each unit under their management as prescribed in Clause 2 of this Article.
Therefore, according to the above regulations, the general specialized automobiles in the units of the people's armed forces include the following types:
- Specialized automobiles in the medical field.- Automobiles with special structures (money transport vehicles, laboratory-equipped vehicles, crane trucks,...).- Automobiles equipped with specialized devices or marked with signs or identifiable features (vehicles with satellite transmitters and receivers, mobile broadcasting vehicles,...).- Trucks.- Pickup trucks.- Automobiles with more than 16 seats as stipulated by the Government of Vietnam in the standards and norms for the use of automobiles.
The purchase price of automobiles in the units of the people's armed forces is regulated as follows. How are automobiles in the units of the people's armed forces liquidated?
How is the purchase price of automobiles in the units of the people's armed forces regulated?
The purchase price of automobiles in the units of the people's armed forces is prescribed in Article 7 Decree 85/2018/ND-CP as follows:
(1) Automobile purchase price:
- The purchase price of official automobiles is regulated in Clauses 1, 2, and 3 of Article 3 Decree 85/2018/ND-CP:+ The standards and norms for the use of automobiles by leadership officials in the People's Army and People's Public Security, who are members of the Politburo, Secretary of the Central Executive Committee of the Communist Party, members of the Central Executive Committee of the Communist Party, Ministers, Deputy Ministers, General Directors, and equivalent positions, are implemented according to the decree of the Government of Vietnam on the standards and norms for the use of automobiles.+ The standards and norms for the use of automobiles according to military rank are as follows:++ Officers with the highest rank of General are entitled to regularly use one automobile during their service. Depending on the actual situation at the time of equipping the automobile, the Prime Minister of Vietnam decides the type and purchase price of the vehicle based on the proposal of the Minister of National Defense and the Minister of Public Security;++ Officers with the highest rank of Senior Lieutenant General, Naval Admiral are entitled to regularly use one automobile during their service with a maximum purchase price of 1,100 million VND/vehicle;++ Officers with the highest rank of Lieutenant General, Vice Admiral are entitled to regularly use one automobile during their service with a maximum purchase price of 920 million VND/vehicle;++ Officers with the rank of Major General, Rear Admiral are entitled to use an automobile for commuting from residence to workplace and business trips with a maximum purchase price of 820 million VND/vehicle.+ The standards and norms for the use of official automobiles in state-owned enterprises under the Ministry of National Defense and the Ministry of Public Security are implemented according to the decree of the Government of Vietnam on the standards and norms for the use of automobiles.
- The purchase price for general service automobiles as stipulated in Article 4, Clause 1, Article 6 Decree 85/2018/ND-CP is a maximum of 720 million VND/vehicle;- The purchase price of specialized automobiles is determined by the Minister of National Defense and the Minister of Public Security in accordance with the mission requirements, the state budget capabilities, and ensure cost-saving and efficiency.
(2) The purchase price of automobiles for official positions and general service vehicles in agencies and units that regularly operate in mountainous, remote, and extremely difficult socio-economic areas as defined by the Government of Vietnam, the Prime Minister of Vietnam, should not exceed:
1.5 times the price specified at points a and b, Clause 1, Article 7 Decree 85/2018/ND-CP when purchasing 4-wheel drive vehicles. If necessary, for vehicles with 12 to 16 seats, the maximum purchase price is 1,100 million VND/vehicle.
(3) The purchase price of automobiles stipulated in Clauses 1 and 2, Article 7 Decree 85/2018/ND-CP is the price that includes taxes payable as prescribed by law; does not include registration fees, vehicle license fee, insurance fees, inspection fees, road maintenance fees related to vehicle use.
In cases where automobiles are exempt from taxes, the full amount of the exempted tax must be calculated to determine the standards and norms. The price of automobiles to determine standards and norms in the case of transferring used automobiles is implemented according to the decree of the Government of Vietnam on the standards and norms for the use of automobiles.
(4) Adjusting the purchase price of automobiles in the units of the people's armed forces is done according to the decree of the Government of Vietnam on the standards and norms for the use of automobiles.
Under what conditions are automobiles in the units of the people's armed forces liquidated?
Pursuant to Article 8 Decree 85/2018/ND-CP, the regulations on this content are as follows:
Replacement of automobiles in the units of the people's armed forces
1. Automobiles equipped for leadership officials in the People's Army and People's Public Security, who are members of the Politburo, Secretary of the Central Executive Committee of the Communist Party, and the positions stipulated at point a, Clause 2, Article 3 of this Decree, are replaced as required by the work or when meeting one of the conditions stipulated in Clause 2 of this Article. The handling of old automobiles after replacement is carried out according to the Law on Management and Use of Public Assets and Decree No. 151/2017/ND-CP dated December 26, 2017, of the Government of Vietnam detailing some articles of the Law on Management and Use of Public Assets (hereinafter referred to as Decree No. 151/2017/ND-CP).
2. Official automobiles not stipulated in Clause 1 of this Article, general service automobiles, and general specialized automobiles are liquidated when meeting one of the following conditions:
a) The usage period has expired according to the law on asset management, depreciation, and fixed asset depreciation;
b) Used for over 200,000 km for mountainous, island areas, and areas with especially difficult socio-economic conditions as defined by the Government of Vietnam, the Prime Minister of Vietnam; used for over 250,000 km for other areas;
c) Automobiles are damaged and cannot be repaired, or the repair is not effective (repair cost estimate is more than 30% of the original price).
3. Specific specialized automobiles are replaced as required by the task performance for national defense and security activities, ensuring cost-saving and efficiency.
Official automobiles not stipulated in Clause 1, Article 8 Decree 85/2018/ND-CP, general service automobiles, and general specialized automobiles are liquidated when meeting one of the following conditions:
- The usage period has expired according to the law on asset management, depreciation, and fixed asset depreciation;- Used for over 200,000 km for mountainous, island areas, and areas with especially difficult socio-economic conditions as defined by the Government of Vietnam, the Prime Minister of Vietnam; used for over 250,000 km for other areas;- Automobiles are damaged and cannot be repaired, or the repair is not effective (repair cost estimate is more than 30% of the original price).
