How does the Vietnam General Confederation of Labor answer questions about financial support to unionists and employees affected by Covid-19?

I have a question as follows: I am working at the Binh Thuan province Labor Confederation, now I would like to ask about financial support to unionists and employees affected by Covid-19. For cases of unionists, employees who are positive for Sars-CoV-2 before December 15, 2021, will they be supported? Thank you!

What were the previous regulations on offering financial support to unionists and employees impacted by Covid-19?

Pursuant to Article 1 of Decision 3749/QD-TLD of Vietnam dated December 15, 2021 on offering financial support to unionists and employees impacted by Covid-19 follows:

- Unionists and employees who are F0 patients and do not commit any violations against anti-Covid-19 regulations may receive:

+ Up to VND 3,000,000 per person if they have severe symptoms that require at least 21 days of treatment at designated hospitals or health facilities according to written certification by the competent health authorities.

+ Up to VND 1,500,000 per person if they have to be outpatients for at least 21 days or inpatients for less than 21 days at designated hospitals or health facilities according to written certification by the competent health authorities.

- If a unionist or employee who has paid the trade union fee to his company or agency dies from Covid-19, his/her relative may receive a financial support of VND 5,000,000.

- Regarding other cases impacted by Covid-19 that also need financial support, Standing board of Federations of provinces and cities, trade unions of ministries and central branches and equivalence, trade unions of general corporations affiliated to the General Confederation; superior trade unions of grassroots trade unions may, on their own initiative, make decisions on financial support in consideration of regulations on for financial delegation of the General Federation depending upon the Covid-19 circumstances and the sources of trade union finance that have been approved in the year.

Pursuant to Clause 4 Article 5 of Decision 3749/QD-TLD of Vietnam dated December 15, 2021 on the case in which a unionist or employee has tested positive for Sars-CoV-2 before December 15, 2021 as follows:

“Article 5. Implementation
If a unionist or employee has tested positive for Sars-CoV-2 before the effective date of this Decision but his/her treatment duration goes beyond the mentioned effective date, and besides he/she has not received the support while meeting the support eligibility requirements as prescribed in clause 1 Article 1 of this Decision, then proceed the support process for him/her.”

How does the Vietnam General Confederation of Labor answer questions about financial support to unionists and employees affected by Covid-19?

The Vietnam General Confederation of Labor has just issued a Official Letter responding to comments on offering financial support to unionists and employees affected by Covid-19?

Regulations on stopping the actual payment of support for unionists and employees affected by COVID-19 epidemic from March 1, 2022?

Pursuant to Decision 4292/QD-TLD of Vietnam dated March 1, 2022 stipulating the suspension of the implementation of Decision No. 3749/QD-TLD dated December 15, 2021 as follows:

- Stop implementing Decision No. 3749/QD-TLD dated December 15, 2021 of the Vietnam General Confederation of Labor on support for unionists and employees affected by COVID-19 from March 1, 2022.

- From March 1, 2022, the payment of support for unionists and employees affected by COVID-19 (including F0 deaths) is implemented according to regulations on financial support, visitation, subsidies in Decision No. 4290/QD-TLD dated March 1, 2022 of the Vietnam General Confederation of Labor on the promulgation of regulations on revenue, expenditure, financial management and assets of grassroots trade unions, Decision No. Decision No. 4291/QD-TLD dated March 1, 2022 of the Vietnam General Confederation of Labor on promulgating regulations on standards and norms of spending regimes in trade union agencies.

- This Decision takes effect from the date of signing. The receipt of dossiers for settlement of support payments for subjects infected with COVID-19 before March 1, 2022 according to Decision No. 3749/QD-TLD dated December 15, 2021 of the Vietnam General Confederation of Labor is done no later than March 31, 2022.

Vietnam General Confederation of Labor responded to comments on offering financial support to unionists and employees affected by Covid - 19?

Pursuant to Official Dispatch 3992/TLD-QHLD of Vietnam dated April 21, 2022, after receiving Official Dispatch No. 1413/LDLD dated March 18, 2022 of the Ben Tre Provincial Confederation of Labor on asking for opinions to support unionists, For employees affected by the Covid-19 epidemic, the Vietnam General Confederation of Labor has the following comments:

- According to the provisions of Clause 4 Article 5 of Decision 3749/QD-TLD dated December 15, 2021 of the Presidium of the Vietnam General Confederation of Labor on spending support for affected unionists and employees. Due to the Covid-19 epidemic: Union members and employees were positive for Sars-CoV-2 before December 15, 2021 but the continuous treatment period lasted until after December 15, 2021, did not receive support. Support under Decision 2606/QD-TLD and Decision 3022/QD-TLD shall be considered for support according to the provisions of Clause 1, Article 1, Decision No. 3749/QD-TLD. In these cases, expenditures are not made according to Decision 2606/QD-TLD and Decision 3022/QD-TLD of the General Confederation.

- According to the provisions of Clause 1, Article 3 of Decision 4292/QD-TLD dated March 1, 2022 of the Presidium of the Vietnam General Confederation of Labor on stopping the implementation of Decision 3749/QD-TLD dated December 15, 2020. 2021 on spending support for unionists and employees affected by the Covid-19 epidemic: Cases of Covid-19 infection before March 1, 2022 but continuous treatment lasts until after March 1, 2022, the dossiers are received by trade unions at all levels by March 31, 2022, and are eligible for support under the provisions of Decision 3749/QD-TLD of the General Confederation.

Thus, the Vietnam General Confederation of Labor has responded to the Ben Tre Provincial Labor Federation's support for unionists and employees affected by Covid - 19. Accordingly, the Confederation of Labor of Ben Tre province and other provinces need to carefully study the regulations of the General Confederation, make timely and proper expenditures to support unionists and employees.
