Pursuant to Clause 7, Article 59 of Decree 115/2020/ND-CP regarding the regulations related to retirement decisions:

7. Regulations related to retirement decisions:
a) At least 03 months prior to the retirement date as stipulated in Clauses 1, 2, 3, and 4 of this Article, the agency or unit managing the public employee must issue the retirement decision;
b) Based on the retirement decision stipulated in point a of this clause, the agency or unit managing the public employee must cooperate with the social insurance organization to carry out the procedures as per the regulations for the public employee to enjoy social insurance benefits upon retirement;
c) The public employee set to retire has the responsibility to hand over documents, materials, and ongoing work to the designated person at least 03 working days prior to the retirement date;
d) From the retirement date indicated in the retirement decision, the public employee retires and enjoys social insurance benefits as per the regulations.
At least 03 months prior to the retirement date as stipulated in Clauses 1, 2, 3, and 4 of Article 59 of Decree 115/2020/ND-CP, the agency or unit managing the public employee must issue the retirement decision.

Which subjects are prioritized in public employee recruitment?
Based on Article 6 of Decree 115/2020/ND-CP regulating the priority subjects in public employee recruitment as follows:
- Heroes of the Armed Forces, Labor Heroes, war invalids, persons entitled to the policies as war invalids, type B war invalids: 7.5 points will be added to the results of round 2;
- Ethnic minorities, military officers, police officers, professional military personnel upon discharge, persons working in cryptographic organizations transferring to another field, graduates of reserve officer training, graduates of district-level military command training departments granted reserve officer ranks registered in the reserve officer rank, children of martyrs, children of war invalids, children of sick soldiers, children of persons entitled to the policies as war invalids, children of type B war invalids, biological children of individuals who participated in the resistance and were affected by chemical toxins, children of Heroes of the Armed Forces, children of Labor Heroes: 5 points will be added to the results of round 2;
- Persons who have completed military service, police service, youth volunteer team members: 2.5 points will be added to the results of round 2.
Note: in cases where an individual applying for public employee recruitment belongs to multiple priority categories, they will only receive the highest priority point added to the results of round 2.
How many members are in the public employee recruitment council?
Based on Article 8 of Decree 115/2020/ND-CP stipulating as follows:
Public Employee Recruitment Council
1. In cases where a public service provider is delegated recruitment authority, the Recruitment Council consists of 05 or 07 members, including:
a) The Chairman of the Council is the head or deputy head of the public service provider;
b) The Vice Chairman of the Council is the person in charge of personnel organization at the public service provider;
c) The Council Member cum Secretary is a public employee assisting with personnel organization of the public service provider;
d) Other council members are individuals with expertise and professional skills related to the recruitment organization as decided by the head of the public service provider.
In the event that the Chairman of the Recruitment Council cannot be arranged according to the provisions at point a of this clause, the competent authority managing the public service provider shall consider and decide.
2. In cases where the competent authority managing the public service provider carries out recruitment, the Recruitment Council consists of 05 or 07 members, including:
a) The Chairman of the Council is the head or deputy head of the authority with recruitment authority;
b) The Vice Chairman of the Council is the leader of the personnel advisory department of the authority with recruitment authority;
c) The Council Member cum Secretary is a representative of the personnel advisory department of the authority with recruitment authority;
d) Other council members are individuals with expertise and professional skills related to the recruitment organization as decided by the head of the authority with recruitment authority.

Hence, the Public Employee Recruitment Council consists of either 5 or 7 members, including:
- The Chairman of the Council who is the head or deputy head of the public service provider;
- The Vice Chairman of the Council who is in charge of personnel organization work at the public service provider;
- The Council Member cum Secretary who is a public employee assisting with personnel organization at the public service provider;
- Other council members who are individuals with expertise and professional skills related to the recruitment organization as decided by the head of the public service provider.
In the event that the Chairman of the Recruitment Council cannot be arranged as stipulated at point a of this clause, the competent authority managing the public service provider shall consider and decide.
