On March 28, 2022, the Ministry of Labor, War Invalids and Social Affairs of Vietnam issued Decision 257/QD-LDTBXH on the announcement of newly promulgated administrative procedures within the scope of functions of State management of the Ministry of Labor, War Invalids and Social Affairs on the implementation of the policy of rent assistance for employees. In which, if employees working in enterprises hope to receive a rent assistance of VND 500,000/month, they shall perform the following procedures:
What are the requirements and conditions for an employee to receive a rental subsidy of VND 500,000/month?
The employee is entitled to rent assistance when meeting the following requirements and conditions:
(1) Working in an enterprise in an industrial park, export processing zone or key economic area, specifically as follows:
- Industrial parks and export processing zones are established under the conditions, order and procedures specified in Decree 82/2018/ND-CP of Vietnam dated May 22, 2018 of the Government on management of industrial parks and economic sector.
- Key economic areas include:
+ Economic zones are established under the conditions, order and procedures specified in Decree 82/2018/ND-CP of Vietnam dated May 22, 2018 of the Government on management of industrial parks and economic zones.
+ 24 provinces and centrally-run cities in 04 key economic regions are planned and established under the Prime Minister's Decision (including provinces and cities: Hanoi, Hai Phong, Quang Ninh, Hai Duong). , Hung Yen, Vinh Phuc, Bac Ninh, Thua Thien Hue, Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Ho Chi Minh City, Binh Phuoc, Tay Ninh, Binh Duong, Dong Nai, Ba Ria - Vung Tau, Long An, Tien Giang, Can Tho, Ca Mau, An Giang and Kien Giang).
(2) Having an employment relationship, currently living in a rental or boarding house, specifically as follows:
- Renting, lodging in the period from February 1, 2022 to June 30, 2022.
- Having an indefinite-term labor contract or a definite-term labor contract of 01 month or more signed and commenced before April 1, 2022.
- Being participating in compulsory social insurance (named on the list of participating in compulsory social insurance of the social insurance agency) in the month preceding the time the enterprise prepares the list of employees requesting rent assistance.
In case employees are not subject to compulsory social insurance as prescribed in Clause 4 Article 2 of Decree 115/2015/ND-CP of Vietnam dated November 11, 2015 of the Government detailing a number of articles of the Law on Social Insurance on compulsory social insurance, they must be included in the salary list of the enterprise in the month immediately preceding the time the enterprise makes a list of employees requesting rent assistance.

An application form made according to Form No. 01 in the Appendix issued with Decision 08/2022/QD-TTg of Vietnam.
- For enterprises:
+ List of employees requesting rent assistance certified by the social insurance agency according to Form No. 02 in the Appendix enclosed with Decision 08/2022/QD-TTg of Vietnam.
+ In case there are employees not participating in the compulsory social insurance in the list, the application file needs to have a copy of the salary list of the month preceding the time the enterprise makes the list of employees requesting rent assistance.

07 simple steps for employees to receive rent assistance of VND 500,000/month
Step 1. The employee requests for rent assistance using Form No. 01 in the Appendix enclosed with the Prime Minister's Decision 08/2022/QD-TTg dated March 28, 2022 stipulating the implementation of the policy on rent assistance for employees (Decision 08/2022/QD-TTg for short) to send to the enterprise to summarize (employees are responsible for the accuracy of information as prescribed in Clause 1 Article 4 of Decision No. 08/2022/QD-TTg of Vietnam).
Step 2. Enterprises compile a list of employees requesting rent assistance according to Form No. 02 in the Appendix enclosed with Decision 08/2022/QD-TTg of Vietnam and publicly post it at the workplace at least 03 working days. In case there are comments about the objects and conditions of support, the enterprise will verify the correct objects and support conditions as prescribed within 02 working days.
Enterprises shall send a list of employees requesting housing rental support according to Form No. 02 in the Appendix enclosed with Decision 08/2022/QD-TTg to the social insurance agency to confirm that the employees are participating in compulsory social insurance. Enterprises make a list of employees who request monthly rent assistance and may request the social insurance agency to confirm the lump sum for 2 or 3 months.
Step 3. Within 02 working days from the date of receiving the request, the social insurance agency shall certify the employee's participation in compulsory social insurance.
Step 4. Enterprises send dossiers according to regulations to the district-level People's Committees where their head offices or branches, representative offices, production and business locations are located. Enterprises can send a dossier to request for support for 2 or 3 months.
The deadline for receiving applications is until the end of August 15, 2022.
Step 5. Within 02 working days from the day on which the complete application is received, the People's Committee of the district shall appraise it and submit it to the People's Committee of the province.
Step 6. Within 02 working days from the day on which the complete application is received, the People's Committee of the province shall issue a decision approving the list and funding for support; at the same time directing the implementation of support payments.
In case of disapproval, the People's Committee of the province shall notify in writing and clearly state the reason.
Step 7. Within 02 working days from the date of receipt of the support funds from the provincial People's Committee, the enterprise shall pay the employees.

- Submit online.
What is the time limit for employees to receive rent assistance of VND 500,000/month?
- 09 working days from the date of receiving the application and dossier as prescribed.
- 11 working days from the date of receipt of the application and dossier as prescribed in case the enterprise must conduct verification.

Implementing agency: District People's Committee, Provincial People's Committee, social insurance agency.
