How are Support Policies for Non-public Preschool and Primary School Teachers Facing Difficulties Due to COVID-19 Regulated?
Recently, the Government of Vietnam issued Decision 24/2022/QD-TTg on implementing support policies for management staff, teachers, and employees in private preschools and primary schools facing difficulties due to the COVID-19 pandemic.
Which specific groups are entitled to support policies after the COVID-19 pandemic?
In accordance with Article 1 of Decision 24/2022/QD-TTg, the subjects regulated to receive support policies after the COVID-19 pandemic include:
Scope of regulation
This Decision stipulates the implementation of support policies for management staff, teachers, and employees working at private, non-public preschool education institutions (including independent childcare groups, independent kindergarten classes, independent preschool classes, childcare centers, kindergartens, and preschools of private, non-public types); SOS kindergartens, preschools; private primary schools, multi-level private primary schools including primary levels, Hermann Gmeiner primary schools within the SOS Children's Villages Vietnam system that are authorized to establish and operate under the regulations, and had to temporarily suspend activities according to the requirement of competent state agencies for COVID-19 prevention and control (hereinafter referred to as non-public educational institutions).
To be specific, Article 3 of Decision 24/2022/QD-TTg stipulates that the following individuals are entitled to the support policies after the COVID-19 pandemic, including:
- Management staff, teachers, and employees working at non-public educational institutions, including:
+ Principals, vice principals, teachers, employees, team leaders, deputy team leaders, and specialized managers;
+ Institution owners, group class owners, childcare group owners meeting the standards prescribed by the Education Law, Regulations on Preschools, Regulations on the organization and operation of independent childcare groups, independent kindergarten classes, independent preschool classes of private and non-public types participating in professional management or performing tasks as teachers, employees (hereinafter referred to as management staff, teachers, employees).
Support Policy for Teachers at Non-Public Preschools and Primary Schools Facing Difficulties Due to COVID-19
What are the conditions for management staff, teachers, and employees to be eligible for support?
According to Article 3 of Decision 24/2022/QD-TTg, management staff, teachers, and employees are eligible for support when meeting the following conditions:
- Currently working at non-public educational institutions before they had to temporarily suspend activities upon the requirement of competent state agencies for COVID-19 prevention and control from May 1, 2021, to the end of December 31, 2021.
- Took unpaid leave for at least 1 month from May 1, 2021, to the end of December 31, 2021.
- Have not received support policies for employees who temporarily suspended labor contracts or took unpaid leave as prescribed in Clauses 4, 5, 6, Section II of Resolution No. 68/NQ-CP dated July 1, 2021, of the Government of Vietnam on several support policies for employees and employers facing difficulties due to the COVID-19 pandemic, Resolution No. 126/NQ-CP dated October 8, 2021, of the Government of Vietnam amending and supplementing Resolution No. 68/NQ-CP dated July 1, 2021, of the Government of Vietnam on several support policies for employees and employers facing difficulties due to the COVID-19 pandemic (hereinafter referred to as Resolution No. 68/NQ-CP) due to not participating in compulsory social insurance.
- Have verification of working at non-public educational institutions at least until the end of the 2021-2022 school year according to the local academic year plan, including previously employed non-public educational institutions or other non-public educational institutions in case the previously employed non-public educational institution did not resume operations.
What is the amount of support for management staff, teachers, and employees under these policies?
According to Article 4 of Decision 24/2022/QD-TTg, the amount of support for management staff, teachers, and employees under these policies is as follows:
Support level
1. A one-time support amount of 3,700,000 VND/person applies to management staff, teachers, and employees who have not received local support policies for the group of workers without labor contracts and some other specific subjects as prescribed in Clause 12, Section II of Resolution No. 68/NQ-CP.
2. A one-time support amount of 2,200,000 VND/person applies to management staff, teachers, and employees who have received local support policies as prescribed in Clause 12, Section II of Resolution No. 68/NQ-CP.
Thus, the specific support levels for private preschool teachers facing difficulties due to COVID-19 are as follows:
- A one-time support amount of 3,700,000 VND/person applies to:
Management staff, teachers, and employees who have not received local support policies for the group of workers without labor contracts and some other specific subjects as prescribed in Clause 12, Section II of Resolution 68/NQ-CP of 2021.
- A one-time support amount of 2,200,000 VND/person applies to:
Management staff, teachers, and employees who have received local support policies as prescribed in Clause 12, Section II of Resolution 68/NQ-CP of 2021.
In which, Clause 12, Section II of Resolution 68/NQ-CP of 2021 stipulates support for workers without labor contracts (freelance workers) and some other specific subjects as follows:
Based on specific conditions and the local budget capacity, provinces and cities set criteria, determine subjects, and support amounts, but the support amount must not be less than 1,500,000 VND/person/one-time or 50,000 VND/person/day based on the actual number of days of temporarily suspended activities as required by local authorities.
