How is the doping control procedure in sports activities from July 9, 2024, implemented according to the latest Circular?

On May 17, 2024, the Minister of the Ministry of Culture, Sports, and Tourism issued Circular 01/2024/TT-BVHTTDL regulating the doping prevention and control in sports activities.

In Circular 01/2024/TT-BVHTTDL, the procedure for doping control in sports activities is regulated as follows:

Authority for Doping Control:

Based on Article 8 of Circular 01/2024/TT-BVHTTDL, the authority for doping control in sports activities includes:

- The Anti-doping Organization in Vietnam has the authority to conduct doping tests on all athletes according to the World Anti-Doping Code.

- Athlete management agencies and the organizers of sports competitions may request the Anti-doping Organization in Vietnam to conduct doping tests on athletes when necessary, according to the World Anti-Doping Code.

- In cases where international sports federations authorize or request doping tests, the Anti-doping Organization in Vietnam will cooperate with the relevant sports federations to conduct doping tests according to the regulations of the World Anti-Doping Code, and the International Standards for Testing and Investigations of the World Anti-Doping Agency.

Sample Collection for Doping Control:

Based on Article 9 of Circular 01/2024/TT-BVHTTDL, the regulations on sample collection for doping control in sports activities are as follows:

- The Anti-doping Organization in Vietnam is responsible for:

+ Planning and organizing the implementation of sample collection for doping tests.

+ Ensuring the sample collection, storage, and transportation process adheres to the World Anti-Doping Code and related international standards.

- The sample collector must be trained and certified according to the World Anti-Doping Code and related international standards.

Notification of Doping Test Results:

Based on Article 10 of Circular 01/2024/TT-BVHTTDL, the regulations on the notification of doping test results in sports activities are as follows:

- Within 5 working days from the date of receiving the doping test results, the Anti-doping Organization in Vietnam must notify in writing the test results to:

+ The Department of Sports and Physical Training;

+ The agency or organization requesting the doping test, the athlete, and the athlete's management unit.

- For athletes with suspected doping violation results, the notification is carried out according to the World Anti-Doping Code and related international standards.

Therapeutic Use Exemption:

Based on Article 11 of Circular 01/2024/TT-BVHTTDL on Therapeutic Use Exemption (TUE) in sports activities as follows:

- Athletes with medical records that necessitate the use of prohibited substances or methods for treatment must apply for a TUE in accordance with the World Anti-Doping Agency's regulations and International Standard for TUE.

- Athletes do not violate the World Anti-Doping Code if the prohibited substances or methods are detected in their samples or possession provided they have a valid TUE permitting the use of such substances or methods as required.

Therapeutic Use Exemption Committee:

Based on Article 12 of Circular 01/2024/TT-BVHTTDL, the regulations on the Therapeutic Use Exemption Committee (TUEC) for the treatment of athletes are as follows:

- The Director of the Anti-doping Organization in Vietnam establishes the TUEC in accordance with the International Standard for TUE to review the reasonableness of treatment in TUE applications of athletes.

- The TUEC comprises 3 to 9 members, with an odd number of members. Members include medical experts and qualified individuals as prescribed by the World Anti-Doping Code and the International Standard for TUE.

- The TUEC operates democratically, voting by majority, and in accordance with the World Anti-Doping Code and the International Standard for TUE.

- The TUEC is responsible for following the World Anti-Doping Code and the International Standard for TUE to review, evaluate, and approve TUE applications for athletes.

- The operation period of the TUEC is as specified in the Decision establishing the Committee.
