How many members are there in the Recruitment Council for public employees in a public service provider in Vietnam?
Based on Clause 1, Clause 2, Article 8 of Decree 115/2020/ND-CP, this content is regulated as follows:
Public Employee Recruitment Council
1. In the case where the public service provider is authorized to recruit, the Recruitment Council has 05 or 07 members, including:
a) The Chairman of the Council is the head or deputy head of the public service provider;
b) The Vice-Chairman of the Council is the person in charge of personnel organization of the public service provider;
c) The Commissioner cum Secretary of the Council is a public employee assisting in personnel organization of the public service provider;
d) Other members are individuals with relevant expertise and professional duties appointed by the head of the public service provider.
If it is not possible to assign the Chairman of the Recruitment Council as stipulated in point a of this clause, the agency authorized to manage the public service provider will review and decide.
2. In the case where the agency authorized to manage the public service provider conducts the recruitment, the Recruitment Council has 05 or 07 members, including:
a) The Chairman of the Council is the head or deputy head of the recruiting authority;
b) The Vice-Chairman of the Council is the leader of the advisory unit for personnel organization of the recruiting authority;
c) The Commissioner cum Secretary of the Council is the representative of the advisory unit for personnel organization of the recruiting authority;
d) Other members are individuals with relevant expertise and professional duties appointed by the head of the recruiting authority.
The Recruitment Council typically has 05 or 07 members.

a) Establish supporting units: Application Verification Committee, Examination Committee, Proctoring Committee, Exam Coding Committee, Grading Committee, Re-Grading Committee (if any); Examination Committee for interviews or practical tests in the second round;
If necessary, the Chairman of the Recruitment Council may establish a Secretariat Team for assistance;
b) Organize the collection of recruitment fees and use these fees according to regulations;
c) Verify the application forms, organize the exams, grade the exams, and conduct re-grading according to the regulations;
d) Report to the head of the authority or unit authorized to recruit to approve the recruitment results;
dd) Resolve complaints and denunciations during the recruitment process;
e) The Recruitment Council dissolves itself after completing its duties.

How is the authority to recruit public employees in a public service provider regulated?
Based on Article 7 of Decree 115/2020/ND-CP, it is regulated as follows:
Public employee recruitment authority
1. For public service providers guaranteeing regular expenditures and investment expenditures, and public service providers guaranteeing regular expenditures, the head of the public service provider carries out the recruitment of public employees.
2. For public service providers partially covering their own recurrent expenditures and public service providers with regular expenditures guaranteed by the state, the authority authorized to manage the public service provider carries out the recruitment of public employees or delegates this task to the head of the public service provider.
Thus, for public service providers guaranteeing regular and investment expenditures, and public service providers guaranteeing regular expenditures, the head of the public service provider carries out the recruitment of public employees.
For public service providers partially covering their own recurrent expenditures and public service providers with regular expenditures guaranteed by the state, the authority authorized to manage the public service provider performs the recruitment of public employees or delegates this task to the head of the public service provider.
