Are businesses required to pay the 13th-month salary to workers during the 2024 Tet Holiday in Vietnam?

Article 90 of the Labor Law 2019 stipulates:

Salary

1. Salary is the amount that the employer pays to the employee under the agreement to perform the job, including the wage level according to the job or title, wage allowances, and other additional amounts.

Article 104 of the Labor Law 2019 stipulates:

Bonus

1. Bonus is an amount or property or other forms that the employer rewards the employee based on production and business results and the level of job performance of the employee.

2. The bonus regulation is decided by the employer and publicly announced at the workplace after consulting the representative organization of the employees at the grassroots level where such an organization exists.

Thus, according to the above regulations, the 13th-month salary is a term coined by businesses and is not a wage regulated by labor law. Furthermore, the 13th-month salary is typically given as a bonus to workers.

Therefore, in principle, businesses are not obligated to pay the 13th-month salary to workers. It depends on the bonus regulation decided and publicly announced by the employer, under which the workers may receive the 13th-month salary during the Tet Holiday if they meet the conditions.
