What are the conditions for issuing a tour guide card in Vietnam?

Based on the provisions of Article 59 of the Tourism Law 2017 regarding the conditions for issuing a tour guide card as follows:

- Conditions for issuing a domestic tour guide card include:

+ Being a Vietnamese citizen, permanently residing in Vietnam;

+ Having full civil act capacity;

+ Not having infectious diseases, not using narcotics;

+ Graduating from intermediate level or higher in the field of tour guiding; in case of graduating from intermediate level or higher in another field, a certificate of domestic tour guiding must be obtained.

- Conditions for issuing an international tour guide card include:

+ Conditions specified at points a, b, and c of clause 1, Article 59 of the Tourism Law 2017;

+ Graduating from college or higher in the field of tour guiding; in case of graduating from college or higher in another field, a certificate of international tour guiding must be obtained;

+ Proficiently using the registered foreign language for professional practice.

- Conditions for issuing a site-specific tour guide card include:

+ Conditions specified at points a, b, and c of clause 1, Article 59 of the Tourism Law 2017;

+ Meeting the requirements for tour guiding proficiency at the site organized by the provincial tourism authority.

Vietnam: What do applications for issuance of international and domestic tour guide cards include in Vietnam?

Based on Article 60 of the Tourism Law 2017 stipulated as follows:

Applications, procedure, authorization for issuing an international tour guide card, a domestic tour guide card

1. The application for applying for an international tour guide card, a domestic tour guide card includes:

a) An application form for issuing a tour guide card as prescribed by the Minister of Culture, Sports and Tourism;

b) A curriculum vitae confirmed by the People's Committee of the commune where the applicant resides;

c) A certified copy of the relevant diplomas and certificates corresponding to the conditions specified at point d of clause 1 or points b and c of clause 2 of Article 59 of this Law;

d) A health certificate issued by a competent medical institution within a period not exceeding 06 months up to the time of application submission;

dd) 02 color portrait photos size 3cm x 4cm.

2. The procedure and authorization for issuing an international tour guide card, a domestic tour guide card are specified as follows:

a) The applicant for a tour guide card submits 01 set of applications to the provincial tourism authority;

b) Within 15 days from the date of receipt of a valid application, the provincial tourism authority shall issue a tour guide card to the applicant; in case of refusal, must provide a written response stating the reasons.

The applicant needs to prepare the application as mentioned above and submit it to the competent state authority. Within 15 days from the receipt of a valid application, the state authority will issue the tour guide card as requested by the applicant.

What are the regulations for practicing as a tour guide in Vietnam?

According to Section 1 of Official Dispatch 120/TCDL-LH of 2018, the conditions for practicing as a tour guide are as follows:

- Having a tour guide card;

- Having a labor contract with a travel service business or a tour guide service provider.

In case there is no contract with a travel business or a tour guide service provider, the tour guide must be a member of a socio-professional organization for tour guiding; as stipulated at point a of clause 1, Article 65 of the Tourism Law 2017.

Participation in a socio-professional organization is the right of the tour guide, who can choose to be a member of a business or a socio-professional organization; a tour guide who is an employee of a travel service business also has the right to join a socio-professional organization for tour guiding.

- Having a guiding contract with a travel service business or a guiding assignment document according to the tour itinerary. Specifically:

+ For tour guides who are contract employees of a travel service business - meeting the requirements at point b of clause 3, Article 58 of the Tourism Law 2017, when performing guiding duties for the business's tour group, the guide must have a guiding assignment document according to the tour itinerary of that travel service business - meeting point c of clause 3, Article 58 of the Tourism Law 2017.

+ For tour guides who are members of a socio-professional organization or contract employees of a travel service business or a guiding service provider (as evidenced by confirmation documents from the socio-professional organization:

+ A fixed-term labor contract, a periodic contract, or a seasonal labor contract or a specific job contract of less than 12 months with a travel service business or a guiding service provider) - meeting the requirements at point b of clause 3, Article 58 of the [Tourism Law 2017](https://lawnet.vn/vb/Luat-du-lich-2017-4ED78.html#dieu_58), when performing guiding duties for another travel service business's tour group, must have a guiding contract with that business.+ The guiding contract is a type of contract but differs from the labor contract stipulated at point b of clause 3, Article 58 of the [Tourism Law 2017](https://lawnet.vn/vb/Luat-du-lich-2017-4ED78.html#dieu_58) in terms of the nature of work, time of performance, and the obligations and responsibilities of the contracting business.

Responsibilities related to labor contracts, such as contributions to social insurance, unemployment insurance, and healthcare insurance, are implemented in accordance with the Labor Code, Health Insurance Law, and Employment Law.
