According to Subsection 6, Section 1, Annex 2, issued together with Decision 1085/QD-BTNMT in 2023, the documents required for splitting a parcel from a certificate issued for multiple parcels to issue a separate certificate include:

- A land and attached asset change registration application.

In the case where the parcel is split from a certificate issued for multiple parcels to issue a separate certificate, there is no need to declare or verify information in item 5 of section I, sections II and IV of the land and attached asset change registration application according to Form No. 09/DK issued together with Decision 1085/QD-BTNMT in 2023.

- The original certificate issued.

For cases where land and attached asset change registration procedures are carried out and there is a change in information regarding legal entities, ID card numbers, citizen identification card numbers, personal identification numbers, or addresses on the issued certificate, the land user must submit additional documents as follows:

+ A copy of the new ID card or new military ID card or new citizen identification card or personal identification number or other documents proving the change in personal information of the person named on the certificate;

In cases where the national population database is shared and connected with data from various sectors (including land), the receiving agency will use data from the national population database without requiring the applicant to submit copies of the new ID card, new military ID card, new citizen identification card, personal identification number, or other documents to prove personal information.

+ A document from a competent authority permitting or recognizing the change in legal entity information for cases where the legal entity information of the organization recorded on the certificate has changed.

How to Register Online for Splitting a Parcel from a Certificate Issued for Multiple Parcels to Issue a Separate Certificate

Based on Subsection 6, Section 1, Annex 2, issued together with Decision 1085/QD-BTNMT in 2023, the process for online registration to split a parcel from a certificate issued for multiple parcels to issue a separate certificate is as follows:

- The receiving and processing agency is responsible for carrying out administrative procedures regarding land in accordance with land law regulations. If it is necessary to check, verify, or clarify or due to other reasons that the result of the application processing is not returned within the time specified for land administrative procedures, the receiving and processing agency will notify the applicant in writing or via the Public Service Portal or by SMS, stating the reason.

- Land users, and owners of assets attached to land, are responsible for fulfilling financial obligations as stipulated by law directly or online through the payment function of the Public Service Portal.

- The receiving or processing agency will notify the applicant to submit the original certificate and required documents after the land user has fulfilled financial obligations.

- The administrative procedure results will be returned at the receiving agency, through public postal services, or at the requested location for cases where land registration application reception and result return procedures are handled.

Processing Time for Issuing a Certificate for Splitting a Parcel from a Certificate Issued for Multiple Parcels to Issue a Separate Certificate

According to Subsection 6, Section 1, Annex 2, issued together with Decision 1085/QD-BTNMT in 2023, the processing time for issuing a certificate for splitting a parcel from a certificate issued for multiple parcels to issue a separate certificate is determined by the Provincial People's Committee but should not exceed 15 days from the date of receiving a complete application.

This period does not include weekends, public holidays as prescribed by law; the time of receiving the application at the commune level; the time taken for financial obligations by the land user; the time needed to consider handling for cases involving land law violations, and the expert examination time.

For mountainous communes, island communes, remote areas, areas with difficult socioeconomic conditions, and areas with extremely difficult socioeconomic conditions, the processing time will be extended by 10 more days.

- The result of the administrative procedure must be returned to the land user, or owner of assets attached to the land within a maximum of 3 working days from the date of completion of the processing.

- For localities where the Provincial People's Committees have issued regulations on receiving, transferring, processing, and returning procedure results on a need basis for specific timing, the processing time will follow the agreement between the applicant and the Land Registration Office, Branch of the Land Registration Office, but not exceeding the time prescribed by the Provincial People's Committee.
