- Declaration by the individual or guardian (according to Form 07 issued with Decree 20/2021/ND-CP);

- A copy of the birth certificate for children; in the case of abandoned children, procedures for birth registration must be completed in accordance with the law on civil status registration;

- A copy of the Disability Certificate in the case of a disabled person;

- Certification from a competent medical authority in the case of HIV infection;

- Other relevant documents (if any).

What is the procedure for admitting socially protected individuals with particularly difficult circumstances into provincial or district-level social assistance facilities?

Based on the provisions of Section 1 of the Administrative Procedures issued with Decision 635/QD-LDTBXH in 2021, the procedure for admitting socially protected individuals with particularly difficult circumstances into provincial or district-level social assistance facilities is as follows:

- Step 1: The individual or guardian prepares the dossier as prescribed and submits it to the Chairman of the People's Committee at the commune level.

- Step 2: Within 10 working days from the date of receipt of the dossier, the Chairman of the commune-level People's Committee is responsible for reviewing and publicly posting the review results at the head office of the commune-level People's Committee for 07 working days, except for information regarding the individual's HIV status.

- Step 3: Within 07 working days from the date of receipt of the dossier and the recommendation letter from the Chairman of the commune-level People's Committee, the Department of Labor, War Invalids, and Social Affairs shall appraise and submit the dossier to the Chairman of the district-level People's Committee.

- Step 4: Within 03 working days from the date of receipt of the submission from the Department of Labor, War Invalids, and Social Affairs, the Chairman of the district-level People's Committee shall decide to admit the individual into the social assistance facility under its management or issue a written request for the Department of Labor, War Invalids, and Social Affairs to consider transferring the dossier to the head of the social assistance facility for admission.

- Step 5: Within 07 working days from the date of receipt of the dossier and the recommendation letter from the Chairman of the district-level People's Committee, the Department of Labor, War Invalids, and Social Affairs shall appraise and transfer the individual's dossier to the social assistance facility under its management. Upon receipt of the complete dossier, the head of the social assistance facility shall decide on the admission of the individual into the facility.

In cases where the individual is not admitted to the social assistance facility, a written explanation must be provided stating the reason.

Processing time: 34 working days for admission into provincial-level facilities; 27 working days for admission into district-level facilities.

The socially protected individual with particularly difficult circumstances is defined as per Article 24 of Decree 20/2021/ND-CP.

To be specific:

- Individuals specified in Clauses 1 and 3 of Article 5 of Decree 20/2021/ND-CP who are in difficult circumstances, unable to lead an independent life and have no one to care for and nurture them in the community;

- Elderly people eligible for care and nurture in social assistance facilities as per the law on elderly people;

- Disabled children, disabled individuals eligible for care and nurture in social assistance facilities as per the law on disabled individuals.
