1. The approval dossier for establishing maritime signaling includes:
a) An application form by the organization or individual as per Form 15 stipulated in the appendix issued with this Decree;
b) A copy attached with the original for comparison or an electronic copy or an electronic copy from the original record or a certified electronic copy from the original technical design of the maritime signaling;
c) A copy attached with the original for comparison or an electronic copy or an electronic copy from the original record or a certified electronic copy from the original plan, coordinates of the position where the maritime signaling is established.

How is the approval procedure for establishing maritime signaling from November 27, 2023, carried out?
According to Clause 2, Article 40 of Decree 58/2017/ND-CP, amended by Clause 2, Article 1 of Decree 74/2023/ND-CP, the approval procedure for establishing maritime signaling from November 27, 2023, is carried out as follows:
Case 1: For maritime signaling with installation location within the port waters.
Step 1: The organization or individual sends 01 set of the dossier to the Maritime Administration.
Methods of submission: directly or via postal system or online public service system.
Step 2: Receipt of the dossier
If the dossier is not valid, within 02 working days from the receipt date, the Maritime Administration will guide the completion of the dossier.
If the dossier is valid, within 05 working days from the receipt date, the Maritime Administration will issue a written approval for establishing maritime signaling. In case of disapproval, a written explanation stating the reason must be provided.
Case 2: For maritime signaling with an installation location outside the port waters or a maritime signaling system with installation locations both within and outside the port waters or across multiple port waters managed by various Maritime Administrations.
Step 1: The organization or individual sends 01 set of the dossier directly or via postal system or online public service system to the Vietnam Maritime Administration.
Step 2: Receipt of the dossier
If the dossier is not valid, within 02 working days from the receipt date, the Vietnam Maritime Administration will guide the completion of the dossier.
If the dossier is valid, within 05 working days from the receipt date, the Vietnam Maritime Administration will issue a written approval for establishing maritime signaling. In case of disapproval, a written explanation stating the reason must be provided.
What general regulations must maritime signaling comply with?
According to Article 38 of Decree 58/2017/ND-CP, maritime signaling must comply with the following general regulations:
- Investment in constructing maritime signaling must be conducted according to this Decree and the laws on investment and construction. Maritime signaling must be positioned at necessary locations to ensure maritime safety.
- The Ministry of Transport organizes the implementation of state management of maritime signaling.
- The Maritime Administration is responsible for inspecting the operation of the maritime signaling system within the port waters and managed areas.
- Maritime safety assurance enterprises assigned to manage and operate the system are responsible for the operational safety of the maritime signaling system.
- Organizations and individuals managing and exploiting public maritime routes, specialized maritime routes, waters in front of port quays, or conducting surveys, construction, or exploitation of works in port waters and the sea of Vietnam are obligated to establish, manage, and operate, ensuring the operational safety of maritime signaling on these routes and waters according to the published standards and technical regulations.
- The Minister of Transport stipulates detailed regulations for managing the operation of the maritime signaling system and issues national technical regulations on maritime signaling.
Decree 74/2023/ND-CP takes effect from November 27, 2023.
