What preferential policies can the relatives of people with meritorious service receive from the State?

Based on Article 5 of the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution 2020, the preferential policies for the relatives of people with meritorious services to the revolution are stipulated as follows:

Depending on each subject, the relatives of people with meritorious services to the revolution can receive the following main preferential policies:

- Monthly allowances, monthly subsidies, and one-time allowances;

- Other preferential policies include:

+ Health insurance;+ Health rehabilitation and nursing care;+ Provision of assistive devices, orthopedic tools, necessary rehabilitation means and equipment as prescribed by the orthopedic, rehabilitation facility under the labor - war invalids and social affairs sector or provincial hospital and above;+ Priority in admission and job creation;+ Support for studying up to university level at educational institutions in the national education system;+ Housing improvement support based on the merits, circumstances of each person or when facing housing difficulties;+ Exemption or reduction of land levy when the State allocates homestead land, changes the land use purpose to homestead land, recognizes the right to use homestead land, or when purchasing houses owned by the State;+ Priority in land, water surface, and sea surface allocation or leasing; priority in forest protection and development contracting;+ Preferential loan for production and business;+ Exemption or reduction of taxes as prescribed by law.

According to Clause 4, Article 13 of Decree 104/2022/ND-CP, the removal of phrases related to household registration books is stipulated as follows:

4. Removal of the phrase "or the household registration book issued before July 1, 2021" at Point b, Clause 1, Article 116, and the phrase "or the household registration book issued before July 1, 2021" at Clause 3, Article 130 of Decree No. 131/2021/ND-CP dated December 30, 2021, guiding the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution.

Simultaneously, based on the provisions at Article 116 of Decree 131/2021/ND-CP, the procedures for issuing confirmation certificates for relatives of meritorious persons from January 1, 2023 (after the removal of the household registration book) are as follows:

- The person with meritorious service or their relative submits an application for the issuance of a confirmation certificate for relatives of meritorious persons to the People's Committee at the commune level where they reside, along with certified copies of one of the following documents:

+ Certificate of meritorious service or commemorative medal for revolutionary, resistance, national defense, and international duty activities who were imprisoned by the enemy;+ Medals, Resistance Medals; Victory Medals; commemorative medals "The Fatherland remembers you"; certificates "Meritorious service to the nation".+ Documents issued by competent authorities confirming the relationship with the person with meritorious service: Citizen identification card.

- The People's Committee at the commune level where they reside: Within 5 working days from the date of receiving all required documents, it is responsible for issuing the confirmation certificate for relatives of meritorious persons.

Thus, the procedures for issuing confirmation certificates for relatives of meritorious persons from January 1, 2023, after the removal of the household registration book, are implemented as stated above.

What are the principles for implementing policies, preferential policies for relatives of people with meritorious services to the revolution?

Based on Article 6 of the Ordinance on Preferential Treatment for People with Meritorious Services to the Revolution 2020, the principles for implementing policies and preferential policies for relatives of people with meritorious services to the revolution are as follows:

- Taking care of the health, material, and spiritual life of the relatives of people with meritorious services to the revolution is the responsibility of the State and society. The State encourages organizations and individuals to care for, assist, and implement preferential policies for people with meritorious services to the revolution.

- The preferential policies for relatives of people with meritorious services to the revolution must be determined and adjusted to suit the socio-economic conditions of the country in each period; ensuring the living standard of meritorious persons is equal to or higher than the average living standard of the residential community where they reside.

- When the relatives of people with meritorious services to the revolution pass away, the person or organization performing the burial is entitled to funeral allowances as stipulated by social insurance laws; in cases belonging to multiple subjects, only one funeral allowance is received.

In cases where the above subjects concurrently belong to the beneficiaries of funeral allowances under social insurance laws, they are entitled to funeral allowances under social insurance laws; in cases where they concurrently belong to beneficiaries of funeral allowances guaranteed by the state budget according to other legal documents, they are entitled to the highest funeral allowance.

- When a person with meritorious services to the revolution passes away and their relatives are entitled to monthly survivor benefits as stipulated by this Ordinance, the relatives of the person with meritorious services to the revolution are entitled to monthly survivor benefits as follows:

+ Relatives of two or more people with meritorious services to the revolution are entitled to a maximum of two monthly survivor benefits;+ Relatives of one martyr who are also relatives of two or more people with meritorious services to the revolution are entitled to the monthly survivor benefit of one martyr and the monthly survivor benefit of one person with meritorious services to the revolution;+ Relatives of two or more martyrs who are also relatives of people with meritorious services to the revolution are entitled to monthly survivor benefits for relatives of martyrs;+ Relatives of people with meritorious services to the revolution who belong to two or more meritorious service groups are entitled to the monthly survivor benefit of one group;+ Children of people with meritorious services to the revolution aged 18 or above who are receiving or have received monthly survivor benefits during their studies at vocational education institutions or universities but have stopped or have been expelled will not be entitled to monthly survivor benefits.

- Relatives of people with meritorious services to the revolution who are entitled to additional monthly nursing survivor benefits will receive one monthly nursing survivor benefit.
