What are the procedures for resolving a one-time allowance policy when people with meritorious service die while in military service?

The procedures for resolving a one-time allowance policy when people with meritorious service die while in military service are specified in Subsection 16, Section I of the administrative procedures promulgated with Decision 4576/QD-BQP in 2022 as follows:

- Step 1: The agency or unit directly managing the regiment level and equivalent, within 5 days from the date of death of the person with meritorious service, shall provide a document along with a copy of the death certificate, proposing to the direct superior according to the hierarchy (division level and equivalent within 3 days), sent to the political office of the unit where the records of the person with meritorious service are managed.

- Step 2: The political office of the unit where the records of the person with meritorious service are managed, within 4 days from the date of receiving all prescribed documents, shall check and compare the records and provide a document along with the records to report to the Military Region Command (for subjects under military region management); for other subjects, report according to the hierarchy, sent to the Policy Department.

- Step 3: The commander or political commissioner of the military region, the Director of the Policy Department, within 5 days from the date of receiving all prescribed documents, shall issue a decision to terminate the preferential policy for the person with meritorious service and issue a one-time allowance decision according to Form No. 74, Appendix I of Decree 131/2021/ND-CP; transfer the records along with the decision to the proposing agency/unit for execution.

- Step 4: The political office of the unit, within 3 days from the date of receiving the decision to terminate the preferential policy and the one-time allowance, shall implement the policy; transfer the records of the person with meritorious service to the Department of Labor - Invalids and Social Affairs where the family of the person with meritorious service resides to carry out the procedures for receiving monthly death benefits, nursing benefits (if any).
