To change their name, foreign adoption organizations in Vietnam must submit one dossier to the competent authority for resolution. The dossier includes:

- Application for amendment of the operation license of the foreign adoption organization in Vietnam.

- The original operation license of the foreign adoption organization in Vietnam.

The dossier must be translated into Vietnamese; the translation must be duly authenticated in accordance with Vietnamese law.

Procedure for Changing the Name of Foreign Adoption Organizations in Vietnam

Based on Subsection 3, Section A, Part II of the Administrative Procedures issued with Decision 169/QD-BTP of 2021, the following is stipulated:

Procedure for Amending the Operation License of Foreign Adoption Organizations in Vietnam

Implementation sequence:

- The foreign adoption organization submits a dossier to request the amendment to the Adoption Department under the Ministry of Justice.

- The Adoption Department appraises the dossier:

* For cases where the foreign adoption organization changes its name, the location of its main office in the founding country, or the location of its office in Vietnam:

+ The Adoption Department reports to the Minister of Justice on recording the changes in the License;

+ The Adoption Department notifies the Ministry of Public Security and the competent tax authority for coordinated management.

* For cases where the foreign adoption organization changes the head of its office in Vietnam:

+ The Adoption Department reports to the Minister to request opinions from the Ministry of Public Security on this change;

+ The Ministry of Public Security provides a written opinion;

+ The Minister of Justice decides on the change and notifies the Ministry of Public Security and the competent tax authority for coordinated management. In case of disapproval of the proposed head, the Adoption Department will notify the foreign adoption organization in writing stating the reasons.

According to the above regulation, the foreign adoption organization submits the dossier requesting the name change to the Adoption Department. The Adoption Department reports to the Minister of Justice on recording the changes in the License.

Then, the Adoption Department notifies the Ministry of Public Security and the competent tax authority for coordinated management.

- For cases where the organization changes its name, the location of its main office in the founding country, or the location of its office in Vietnam: Within 5 working days from the date of receiving the application for recording changes, the Adoption Department reports to the Minister of Justice on recording the changes in the License.

- For cases where the organization changes the head of its office in Vietnam:

+ The Adoption Department appraises the dossier and reports to the Minister of Justice: 5 working days from the date of receiving a complete dossier;

+ The Ministry of Public Security provides a written opinion to the Ministry of Justice: 15 days from the date of receiving the request from the Ministry of Justice;

+ The Minister of Justice decides on amending the License: 5 working days from the date of receiving the written opinion from the Ministry of Public Security.

Competent authority for decision: Ministry of Justice.

Direct implementing agency: Adoption Department, Ministry of Justice.

Coordinating agency: Ministry of Public Security.

Subjects of the administrative procedure: Foreign adoption organizations.

Name of forms: Application for issuance, extension, amendment of the operation license of foreign adoption organizations in Vietnam.

Fee: None.

Result of the administrative procedure: The operation license of the foreign adoption organization in Vietnam is amended.

Within 5 working days from the date of receiving the application for changing the name of the foreign adoption organization in Vietnam, the Adoption Department reports to the Minister of Justice on recording the changes in the License.
