What are the conditions for conducting telemedicine services?
Based on the provisions of Clause 1, Article 87 of Decree 96/2023/ND-CP, the conditions for conducting telemedicine services are clearly stated as follows:
- Conducted by practitioners of medical facilities in one of the following organizational forms:
(1) Hospitals, including the following forms:
- General hospital;- Traditional medicine hospital;- Odonto-stomatology hospital;- Specialized hospital.
(2) Clinics, including the following forms:
- General clinic;- Specialized clinic;- Multi-specialty clinic;- Medical doctor's clinic;- Traditional medicine clinic;- Odonto-stomatology clinic;- Nutrition clinic;- General medical practitioner's clinic.
(3) Medical stations.
(4) Maternity homes.
(5) Traditional medicine diagnostic facilities.
(6) Paraclinical service facilities, including the following forms:
- Testing facility;- Diagnostic imaging facility;- Testing and diagnostic imaging facility.
(7) Family medicine medical facilities.
(8) Dental restoration technical facilities.
(9) Rehabilitation technical facilities.
(10) Clinical psychology facilities.
(11) Nursing service facilities.
(12) Maternity service facilities.
(13) Palliative care facilities.
(14) Pre-hospital emergency care facilities.
(15) Optical facilities conducting refractive error measurement and inspection.
(16) Dialysis facilities.
- The facility must have the appropriate professional scope of activities in alignment with the telemedicine services offered;
- The facility must have a sufficient number of practitioners according to the telemedicine service scope;
- The facility must have appropriate technical infrastructure, information technology equipment, specialized devices, and software technology suitable for the type of services provided. This ensures the safe, secure transmission, display, processing, and storage of data, meeting legal data storage and backup regulations.

What documents are required to declare the eligibility for providing telemedicine services?
Based on the provisions of Clause 2, Article 87 of Decree 96/2023/ND-CP, the documents required for declaring the eligibility for providing telemedicine services include:
(1) A request letter for conducting telemedicine services specifying the start date of service;
(2) A valid copy of the medical practice license of the facility (not applicable if the license has been connected and shared on the Information System for Medical Practice Management or the National Database on Healthcare);
(3) A list of registered practitioners along with their practice license numbers, provided the license has been connected and shared on the Information System. If not, valid copies of individual practice licenses for each participating practitioner must be submitted;
(4) A list of telemedicine services to be provided;
(5) Supporting documents proving compliance with condition (4) above.
What is the latest procedure for declaring the eligibility for providing telemedicine services in 2024?
Based on the provisions of Clause 3, Article 87 of Decree 96/2023/ND-CP, the latest procedure for declaring the eligibility for providing telemedicine services in 2024 is as follows:
Step 1: The medical facility submits one set of documents declaring eligibility for providing telemedicine services to:
- The Ministry of Health for facilities under its jurisdiction;
- Specialized health agencies under the provincial People's Committee for facilities within the locality (including private medical facilities), except for those under the jurisdiction of the Ministry of Health, Ministry of National Defense, or Ministry of Public Security.
Step 2: Upon receiving the declaration documents, the receiving agency will issue a receipt as per Form 02 Appendix I issued along with Decree 96/2023/ND-CP.
Step 3: Within 10 days from the date on the receipt, the receiving agency must post the information of the facility eligible for providing telemedicine services on its website or portal and the Information System for Medical Practice Management.
If the requirements are not met, the receiving agency must send a document to the submitting medical facility stating the reasons.
The posted information must include at least: the name and address of the telemedicine facility and the list of telemedicine services provided.
If, after 10 days from the date on the receipt, the receiving agency neither sends a compliance notification nor posts the information, the medical facility may start providing telemedicine services.
Note: During operations, if there are changes to the declared information specified in Clause 2, Article 87 of Decree 96/2023/ND-CP, the medical facility must repeat the declaration procedure.
