Pursuant to Clause 2, Article 19 of Decree 07/2016/ND-CP regulating the dossier for reissuing the Branch Establishment License of a foreign trader as follows:
Dossier for reissuing the Representative Office Establishment License, Branch Establishment License
1. In case of reissue as prescribed in Clause 1, Article 18 of this Decree, the dossier includes:
a) Application for reissuing the Representative Office Establishment License in the form issued by the Ministry of Industry and Trade, signed by the authorized representative of the foreign trader;
b) Notification of termination of operation of the Representative Office sent to the License-issuing agency at the location of departure as prescribed in Point a, Clause 1, Article 36 of this Decree;
c) A copy of the previously issued Representative Office Establishment License;
d) Documents regarding the expected location of the Representative Office at the place of arrival as prescribed in Point e, Clause 1, Article 10 of this Decree.
2. In case of reissue as prescribed in Clause 2, Article 18 of this Decree, the dossier includes: Application for reissuing the Representative Office Establishment License, Branch Establishment License in the form issued by the Ministry of Industry and Trade, signed by the authorized representative of the foreign trader.

Pursuant to the provisions of Article 18 of Decree 07/2016/ND-CP, the cases in which the Branch Establishment License of a foreign trader is reissued are regulated as follows:
Cases of reissuing the Representative Office Establishment License, Branch Establishment License
Foreign traders perform the procedures for reissuing the Representative Office Establishment License, Branch Establishment License in the following cases:
1. Relocation of the headquarters of the Representative Office from one province/city under central authority or geographical area under the management of one Management Board to another province/city under central authority or geographical area under the management of another Management Board.
2. The Representative Office Establishment License, Branch Establishment License is lost, destroyed, damaged, or eliminated in any form.
Thus, according to the above provisions, in cases where the Branch Establishment License is lost, destroyed, damaged, or eliminated in any form, the foreign trader is entitled to carry out the procedures for reissuing the Branch Establishment License.
What is the procedure for reissuing the Branch Establishment License of a foreign trader?
Pursuant to the provisions of Article 20 of Decree 07/2016/ND-CP, the procedures are stipulated as follows:
Procedures for reissuing the Representative Office Establishment License, Branch Establishment License
1. Foreign traders perform the procedures for reissuing the Representative Office Establishment License in cases specified in Clause 1, Article 18 of this Decree within 30 days from the date of notification of termination of the Representative Office at the place of departure. After this period, foreign traders must apply for the Representative Office Establishment License in accordance with Articles 10 and 11 of this Decree.
2. Foreign traders can submit the dossier directly or via postal service or online (if applicable) to the License-issuing agency.
3. Within 03 working days from the date of receipt of the dossier, the License-issuing agency shall check and request supplementation if the dossier is incomplete or invalid. The request for dossier supplementation is made only once during the dossier processing.
4. Within 05 working days from the date of receipt of a complete and valid dossier, the License-issuing agency shall reissue the Representative Office Establishment License, Branch Establishment License. If not issued, the agency must provide a written explanation.
The procedure for reissuing the Branch Establishment License of a foreign trader includes the following steps:
- Step 1: Foreign traders submit the dossier directly or via postal service or online (if applicable) to the License-issuing agency.
- Step 2: Within 03 working days from the date of receipt of the dossier, the License-issuing agency shall check and request supplementation if the dossier is incomplete or invalid. The request for dossier supplementation is made only once during the dossier processing.
- Step 3: Within 05 working days from the date of receipt of a complete and valid dossier, the License-issuing agency shall reissue the Branch Establishment License. If not issued, the agency must provide a written explanation.
