Ho Chi Minh City: the employer makes a list of the worker who applies for subsidized house rents as how?
Which agency/unit is responsible for making a list of workers that apply for subsidies on housing rents?
As regulated in the Official Dispatch No.2220/BHXH-QLT dated April 29, 2022 by the Social Security Office of Ho Chi Minh City, the social security office of Ho Chi Minh City shall be responsible for making a list of workers who apply for subsidies on housing rents in Ho Chi Minh City to their employers. Thus:
08/2022/QD-TTg shall be regulated as follows:
08/2022/QD-TTg) to the social insurance authority in charge of management of collection of social insurance contributions through electronic transactions or the public service portal of Vietnam Social Security, the national public service portal, or by post, and send the electronic data file or the salt file of the unit management. The employer shall take legal responsibility for accuracy and truthfulness of information provided by workers.
+ The time limit for submission: Monthly, integrated: 02 months or 03 months. Not later than August 15, 2022.

- In case the unit makes dossier for improper subjects as prescribed, delays the dossier that affect the interests of the employees, such unit shall take full responsibility.
Which agency shall certify the list of employees requesting for the housing rent support?
As regulated in the Official Dispatch No. 2220/BHXH-QLT dated April 29, 2022 by the Social Security Office of Ho Chi Minh City, the social security office of Ho Chi Minh City shall be responsible for confirming the list of workers who apply for subsidies on housing rents in Ho Chi Minh City. Thus:
- Within 02 working days after receiving the Form 02 and 03 of the units, the social insurance agency which is managing shall confirm the participation in compulsory social insurance of the employees and return it to the units in the form which has been submitted to the social insurance agency.
- In case the list of units is not consistent with the data of social insurance agency which is managing, the social insurance agency shall return the list and the guiding sheet to the unit for addition, completion and timely returning.
Which worker will receive assistance for house rent?
In accordance with Article 4 of Decision No.08/2022/QD-TTg dated March 28, 2022 stipulating support for house rents for employees who are working in enterprises as follows:
- Laborers working in enterprises in industrial zones, export processing zones or key economic zones shall be supported when they meet the following conditions:
+ Lodging during the period from February 01, 2022 to June 30, 2022.
+ The employer has an indefinite term employment contract or a definite term employment contract of at least 01 month which is concluded and starts to execute such contract before April 01, 2022.
+ He/she is participating in compulsory social insurance (who is on the list of participants in compulsory social insurance of the social insurance agency) in the month preceding the date on which the enterprise makes the list of workers who apply for subsidies on housing rents.
Where the employees are not subject to the compulsory social insurance in accordance with the provisions in Clause 4, Article 2 of Decree No. 115/2015/ND-CP dated 11/11/2015 of the Government detailing a number of articles of the Law on social insurance on compulsory social insurance, they must have their names in the list of salary payment of the enterprise preceding the time the enterprise makes the list of employees requesting the assistance of house rent.
Pursuant to Article 8 of the Decision No.
- Laborers who are working in enterprises, cooperatives, business households registered business in industrial zones, export processing zones or key economic zones will be supported when they have full the following conditions:
+ Leasing or staying from April 1, 2022 to June 30, 2022.
+ There is an indefinite term employment contract or a definite term employment contract of 01 month or more which is entered into and executed from April 1, 2022 to June 30, 2022, except that the next employment contract is executed.
+ Participating in compulsory social insurance (defined in the list of participants in compulsory social insurance of a social security agency) in the month preceding the date on which the employer prepares the list of workers who apply for subsidies on housing rents.
Where the employees are not subject to the compulsory social insurance in accordance with the provisions in Clause 4, Article 2 of Decree No. 115/2015/ND-CP dated 11/11/2015 of the Government detailing some articles of the Law on social insurance on compulsory social insurance, the employees are newly recruited and have signed the labor contract but not named in the list of employees who participate in the compulsory social insurance of the social insurance body, they must be named in the list of employees' salary payment of the month preceding the time the employers make a list of employees to request the assistance of house rent.
