Has the Vietnam Ministry of Public Security proposed to integrate health insurance cards and driving licenses into citizen identity cards?
Most recently, in Article 23 of the Draft Law on Citizen Identification (amended), the Ministry of Public Security has proposed to integrate information into citizen identity cards:
Integrate information into citizen identification cards
1. Information integrated into citizen identity cards is information of citizens stated in documents issued by competent Vietnamese agencies and verified through national databases and specialized databases for integration into citizen identity cards at the request of citizens or state management agencies.
2. The use of information integrated into citizen identity cards shall be carried out by the following methods:
a/ Use specialized equipment to exploit the place of storage of citizen identity cards;
b) Use information on citizen identity cards to exploit integrated information through specialized equipment connected to the national database on population and electronic identification and authentication systems.
3. Information integrated into citizen identity cards includes: Health insurance cards, social insurance books, driving licenses, birth certificates, marriage certificates or other documents as prescribed by the Government.
4. The use of integrated information from citizen identity cards is equivalent to the use of papers ỏ documents containing such information during the carrying out of administrative procedures, public administrative services, and other civil, economic, and commercial transactions.
5. Citizens shall carry out procedures for integrating information into citizen identity cards at citizen identification management agencies or through the issuance, renewal and reissuance of citizen identity cards.
6. The Government shall detail this Article.
Accordingly, the Ministry of Public Security has proposed to integrate information into citizen identity cards. The information integrated into the citizen identity card includes health insurance card, social insurance book, driving license, birth certificate, marriage certificate or other documents as prescribed by the Government.
Currently, there are too many different types of documents issued by competent agencies to citizens, causing certain difficulties for citizens in storing and using, especially in carrying out administrative procedures, using utilities and public services; these types of documents are not in line with the trend of digital transformation, application of information technology to state management activities and social activities that are increasingly developing in our country. Therefore, the Ministry of Public Security has proposed to integrate information into citizen identity cards
The integration into citizen identity cards is to reduce documents for citizens, facilitate citizens in conducting civil transactions, implement digital transformation, and reform administrative procedures.
What is an electronic citizen identity card in Vietnam?
According to the provisions of the Law on Citizen Identification 2014, the concept of an electronic citizen identity card has not been mentioned. This new institution has just been added in Chapter IV of the Draft Law on Citizen Identification (amended) (here)
Accordingly, an electronic citizen identity card is an electronic identification account, containing information printed on a citizen identity card, information integrated into a citizen identity card, and other information about citizens in the electronic identification and authentication system.
When entities use electronic identification accounts in e-transactions or activities, it is equivalent to presenting papers and documents to prove that the information has been integrated into the electronic identification account.
What is the use validity of citizen identity cards in Vietnam?
Pursuant to Article 20 of the Law on Citizen Identification 2014, the use validity of citizen identity cards is as follows:
- Citizen identity card is a personal paper of a Vietnamese citizen which proves the citizen identification of the cardholder for conducting transactions in the Vietnamese territory.
- Citizen identity cards shall be used instead of passports in case Vietnam and a foreign country have signed a treaty or international agreement permitting citizens of the signatories to use citizen identity cards instead of passports in each other’s territory
- Competent agencies, organizations and individuals may request a citizen to produce his/her citizen identity cards for checking identification and information specified in Article 18 of the Law on Citizen Identification 2014; use personal identification numbers in citizen identity cards for checking information about the cardholders in the national population database and specialized databases in accordance with law.
When a citizen produces his/her citizen identity card at the request of a competent agency, organization or individual, this agency, organization or individual may not request the citizen to produce another paper to prove the information specified in Clauses 1 and 3, Article 20 of the Law on Citizen Identification 2014.
- The State shall protect the legitimate rights and interests of holders of citizen identity cards in accordance with law.
