The National Assembly has just promulgated the Law amending and supplementing several articles of the People’s Public Security Law 2023 (Revised People’s Public Security Law 2023).

What are the new points of the Revised People’s Public Security Law 2023?

Based on the content of the Revised People’s Public Security Law 2023, below are some notable new points:

- Amend and supplement Clause 4 of Article 22 of the 2018 People’s Public Security Law:

Officers considered for promotion from Colonel to Major General must have at least 3 years of service remaining. In cases where they have less than 3 years of service remaining, the decision will be made by the President.

- Amend and supplement Clause 4 of Article 23 of the 2018 People’s Public Security Law:

Specify standards and criteria for early promotion to the rank of General.

The Minister of Public Security shall prescribe specific standards and criteria for early and accelerated promotion to ranks for People’s Public Security officers with particularly outstanding achievements in combat and work.

- Amend and supplement points b, d, e Clause 1, Clause 2, and Clause 4 of Article 25 of the 2018 People’s Public Security Law:

Add specific regulations for 6 positions with the highest rank of General in the People’s Public Security Force, including:

- 01 position with the highest rank of Senior Lieutenant General;- 5 positions with the highest rank of Major General.

Regulation on the highest rank of Colonel for Regiment Commanders in units under the Ministry, Ho Chi Minh City Public Security, and Hanoi Public Security, Chiefs of the Departments of Personnel Organization, Party Work and Political Work, Chiefs of the Public Security of Districts under the Hanoi Public Security, and Ho Chi Minh City Public Security.

- Amend and supplement Clause 2 of Article 29 of the 2018 People’s Public Security Law:

Seconded People’s Public Security officers shall enjoy the policies as those currently serving in the People’s Public Security Force.

The promotion, demotion, revocation of ranks for seconded officers shall be carried out as for those currently serving in the People’s Public Security Force, except for seconded officers specified at points b, c, and d of Clause 1, Clause 3 of Article 25 of the 2018 People’s Public Security Law and Clause 1 of Article 25 of the 2018 People’s Public Security Law.

Seconded People’s Public Security officers shall be considered and arranged in positions equivalent to the seconded position upon completion of the secondment mission; entitled to the benefits of the seconded position.

- Amend and supplement Clauses 1, 2, and 3 of Article 30 of the 2018 People’s Public Security Law:

Amendment to increase the age of officers and non-commissioned officers by 2 years. For female officers with the rank of Colonel, the age is increased by 5 years, and for female officers with the rank of Senior Lieutenant Colonel by 3 years; add regulations to extend the maximum service age for People’s Public Security officers in special cases.

The maximum service age for male officers with the highest rank of Colonel and General; for female officers with the highest rank of Senior Lieutenant Colonel and Colonel shall follow the retirement age roadmap for employees as specified by the Labor Code. The Government of Vietnam shall stipulate details of this clause.

- Amend and supplement Clause 2 of Article 42 of the 2018 People’s Public Security Law:

Increase the maximum service age of People’s Public Security workers (Men: 62, Women: 60) and implement according to the retirement age roadmap for employees as specified by the Labor Code. The Government of Vietnam shall stipulate details of this clause.

When does the Revised People’s Public Security Law 2023 take effect?

Based on the provisions of Article 2 of the Revised People’s Public Security Law 2023 on the effective date as follows:

Effective date

This Law shall take effect from August 15, 2023.
