On December 15, the Hanoi Labor Confederation issued Official Dispatch 121/LDLD dated 2023 capturing the situation of labor relations, salary payment and bonuses for employees during the New Year and Lunar New Year holidays in 2024.

How to calculate the 2024 Tet bonus for employees in Vietnam?
Article 104 of the Labor Code in 2019 stipulates bonuses for employees as follows:
Bonuses
1. A bonus means an amount of money, a piece of property or item that is provided by an employer for his/her employees on the basis of the business performance or the employees’ performance.
2. A bonus regulation shall be decided and publicly announced at the workplace by the employer after consultation with the representative organization of employees (if any).
Thus, according to the above regulations, the employer will base on the business performance or the employees’ performance to reward the employees.

The 2024 Tet bonus for employees is absolutely not mandatory but will be decided by the company based on its results, production and business situation and implemented according to the Bonus Regulations announced by the company.
How many days off will employees be entitled to during Tet holiday in Vietnam in 2024?
Clause 1, Article 112 of the Labor Code in 2019 stipulates as follows:
Public holidays
1. Employees shall be entitled to fully paid days off on the following public holidays:
a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);
b) Lunar New Year Holidays: 05 days;
c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);
d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);
dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);
e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

On November 3, 2023, the Government Office issued Official Dispatch 8662/VPCP-KGVX 2023 conveying the Prime Minister's opinion on the Lunar New Year and National Day holidays in 2024.
Accordingly, the Prime Minister agreed with the proposal of the Ministry of Labor - War Invalids and Social Affairs of Vietnam in the mentioned of Official Dispatch 4594/LDTBXH-ATLD in 2023 for the schedules for the Lunar New Year Holiday (from February 8, 2024 to February 14, 2024) and the National Day Holiday (from August 31, 2024 to September 3, 2024).
Employers shall, based on the actual condition and the holiday schedules for officials and public employees, arrange the schedules for the Lunar New Year Holiday and National Day Holiday for employees (it is encouraged for employers to apply the schedule for the Lunar New Year Holiday for officials and public employees) as follows:
- Lunar New Year Holiday 2024:
+ Select 1 day before Tet and 4 first days after Tet or 2 days before Tet and 3 first days after Tet or 3 days before Tet and 2 days after Tet.
+ Notify employees of the scheme for the Lunar New Year Holiday schedule before implementation at least 30 days in advance.
The weekly days off coincide with the days off for the Lunar New Year Holiday, so employers shall arrange compensatory days off for employees on the next working days as follow:
*In the case where employees have the weekly breaks on Saturday
- Employers may adopt 01 ending day of the year 2023 and 04 beginning days of the year 2024 of the lunar calendar:
Employees will start taking the 2024 Lunar New Year holiday from Friday, February 9, 2024 (December 30 of the lunar calendar) until Thursday, February 15, 2024 (the January 6 of the lunar calendar).
- Employers may adopt 02 ending day of the year 2023 and 03 beginning days of the year 2024 of the lunar calendar:
Employees will start taking the 2024 Lunar New Year holiday from Thursday, February 8, 2024 (December 28 of the lunar calendar) until Wednesday, February 14, 2024 (the January 5 of the lunar calendar).
- Employers may adopt 03 ending day of the year 2023 and 02 beginning days of the year 2024 of the lunar calendar:
Employees will start taking the 2024 Lunar New Year holiday from Wednesday, February 7, 2024 (December 27 of the lunar calendar) until Tuesday, February 13, 2024 (the January 4 of the lunar calendar).
Thus, employees will be entiled to 7 consecutive days off, including 5 days off for Lunar New Year according to State regulations and 2 days off (due to weekly days off).
*In the case where employees do not have the weekly breaks on Saturday
- Employers may adopt 01 ending day of the year 2023 and 04 beginning days of the year 2024 of the lunar calendar:
Employees will start taking the 2024 Lunar New Year holiday from Friday, February 9, 2024 (December 30 of the lunar calendar) until Wednesday, February 14, 2024 (the January 5 of the lunar calendar).
- Employers may adopt 02 ending day of the year 2023 and 03 beginning days of the year 2024 of the lunar calendar:
Employees will start taking the 2024 Lunar New Year holiday from Thursday, February 8, 2024 (December 28 of the lunar calendar) until Tuesday, February 13, 2024 (the January 4 of the lunar calendar).
- Employers may adopt 03 ending day of the year 2023 and 02 beginning days of the year 2024 of the lunar calendar:
Employees will start taking the 2024 Lunar New Year holiday from Wednesday, February 7, 2024 (December 27 of the lunar calendar) until Monday, February 12, 2024 (the January 3 of the lunar calendar).
Accordingly, employees will have 6 consecutive days off, including 5 days off for Lunar New Year according to State regulations and 1 day off (coinciding with the weekly days off).
Note: The above Tet holiday schedule is for reference only. Deciding on the 2024 Lunar New Year holiday period will depend on each business.
