Guidance on the Procedures for Re-issuance of the Certificate of Eligibility for Occupational Safety Technical Inspection Activities upon Addition or Amendment at the Central Level
Requirements and conditions for re-issuance of the Certificate of Eligibility for Technical Safety Inspection Activities in case of amendments or supplements
Based on the regulations stipulated in Section 3, Part I of the Appendix issued together with Decision 1549/QD-LDTBXH 2023, the requirements and conditions for the re-issuance of the Certificate of Eligibility for Technical Safety Inspection Activities in the case of amendments or supplements are clearly stated as follows:
Requirements and conditions for administrative procedures: Satisfying the conditions as prescribed in Clause 1, Article 1 of Decree 140/2018/ND-CP dated October 8, 2018, of the Government of Vietnam, specifically:
- The organization granted the Certificate of Eligibility for Technical Safety Inspection Activities must meet the following conditions:
+ Ensure equipment and tools serving the inspection for each subject under the inspection scope, as required by the inspection procedure, national technical regulations on safety and labor hygiene.
+ Have at least 02 inspectors working under a contract of 12 months or more within the organization to conduct inspections for each subject within the scope of the application for the Certificate of Eligibility for Technical Safety Inspection Activities.
+ The technical manager responsible for inspection activities of the organization must have a minimum of 02 years of experience as an inspector.
- The equipment and personnel mentioned in points a, b, and c, Clause 1 of this Article are only used as conditions for applying for the Certificate of Eligibility for Technical Safety Inspection Activities for only one organization.
The requirements and conditions for the re-issuance of the Certificate of Eligibility for Technical Safety Inspection Activities in case of amendments or supplements must comply with the above regulations.
Instructions for re-issuance of the Certificate of Eligibility for Technical Safety Inspection Activities in case of amendments or supplements to the Central level
What does the dossier for re-issuance of the Certificate of Eligibility for Technical Safety Inspection Activities in case of amendments or supplements to the Central level include?
Based on the regulations stipulated in Section 3, Part I of the Appendix issued together with Decision 1549/QD-LDTBXH 2023, the dossier includes:
3.3. Composition and quantity of the dossier:
- Application for amendment or supplementation of the Certificate (01 copy);
- The issued Certificate (01 copy);
- Documents proving the changes in conditions for issuing the Certificate (each type 1 copy).
3.4. Processing time: No more than 30 days (from the date of receipt of a complete and valid dossier).
3.5. Subjects implementing administrative procedures: Inspection organizations that need to amend or supplement the Certificate of Eligibility for Technical Safety Inspection Activities.
3.6. Administrative procedure-processing agency: Ministry of Labor - Invalids and Social Affairs.
3.7. Result of administrative procedures: Certificate of Eligibility for Technical Safety Inspection Activities or official dispatch notifying the reason for not re-issuing the Certificate (stating clearly the reason for refusal).
3.8. Fees and charges: As prescribed in Circular No. 245/2016/TT-BTC dated November 11, 2016, of the Ministry of Finance; Circular No. 110/2017/TT-BTC dated October 20, 2017, of the Minister of Finance amending and supplementing the Fee Rate Table for appraising business conditions in technical safety inspection activities; safety and labor hygiene training issued together with Circular No. 245/2016/TT-BTC dated November 11, 2016, of the Minister of Finance regulating fee collection rates, collection, submission, management, and use policies of appraisal fees in technical safety inspection activities; safety and labor hygiene training; Circular No. 44/2023/TT-BTC dated June 29, 2023, of the Ministry of Finance regulating some fee and charge rates to support people and businesses.
The dossier for re-issuance of the Certificate of Eligibility for Technical Safety Inspection Activities in case of amendments or supplements to the Central level includes:
- Application for amendment or supplementation of the Certificate (01 copy);
- The issued Certificate (01 copy);
- Documents proving the changes in conditions for issuing the Certificate (each type 1 copy).
Procedure for re-issuance of the Certificate of Eligibility for Technical Safety Inspection Activities in case of amendments or supplements to the Central level
Based on the regulations stipulated in Section 3, Part I of the Appendix issued together with Decision 1549/QD-LDTBXH 2023, the procedure is clearly stated as follows:
- Step 1: Receipt of the application for re-issuance of the Certificate of Eligibility for Technical Safety Inspection Activities
An organization in need of re-issuance of the Certificate submits 01 dossier to the Department of Labor Safety, Ministry of Labor - Invalids and Social Affairs.
- Step 2: Appraisal of conditions
The receiving authority appraises the conditions based on the dossier and directly at the requesting organization.
- Step 3: Re-issue the Certificate or refuse to re-issue
Within 30 days from the date of receipt of a complete and valid dossier, the Director of the Department of Labor Safety will sign under the authority of the Minister for Certificates of Eligibility for Technical Safety Inspection Activities. In case the Certificate is not issued, the Director of the Department of Labor Safety will sign under the authority of the Minister an official dispatch declining and stating the reasons for not re-issuing the Certificate to the requesting organization.
