What documents are required for application for a new Certificate of Eligibility for Security and Order at the provincial level?

Pursuant to Sub-item 1, Item C, Part II, Administrative Procedures issued together with Decision 3191/QD-BCA in 2022 that stipulates the components of the application for a new Certificate of Eligibility for Security and Order as follows:

- A written request for issuance of the Certificate of Eligibility for Security and Order from the business establishment.

- A valid copy of one of the following documents:

Business Registration Certificate; Enterprise Registration Certificate; Investment Registration Certificate; Registration Certificate for the operation of a branch or subsidiary; Cooperative or Union of Cooperatives Registration Certificate; Branch or Business Location Registration Certificate of a cooperative or union of cooperatives;

Or an operation license from a competent state management agency in Vietnam; Business Household Registration Certificate; document establishing or allowing operation accompanied by a document notifying the tax code for revenue-generating public service providers.

- A valid copy of documents proving compliance with fire prevention and fighting safety for business areas and storage facilities for raw materials and goods, including:

+ Fire prevention and fighting acceptance document for business establishments listed in Appendix IV issued together with Decree 136/2020/ND-CP.

+ Fire prevention and fighting inspection record from the Fire and Rescue Police for business establishments not specified in the above point but listed in Appendix I issued together with Decree 136/2020/ND-CP;

+ Business establishments that do not need to submit the documents specified in points a and b include: Seal production; production and trade of flags; sirens, priority vehicle signal lights; security services; betting services; devices causing interference, disrupting mobile communication signals; cosmetic surgery services; road traffic speed monitoring devices; alcohol concentration monitoring devices; GSM mobile phone monitoring devices and other mobile phone monitoring devices.

- A personal history declaration of the person responsible for security and order at the business establishment.

If the person responsible for security and order is a Vietnamese residing abroad with a foreign passport or a foreign national, in addition to the personal history declaration, a valid copy of the Passport, Permanent Residence Card, Temporary Residence Card, or Visa with a valid stay period in Vietnam must be submitted.

- In addition to the above-mentioned documents, the application for a new Certificate of Eligibility for Security and Order must also include additional documents applicable to certain business sectors as follows:

+ For security service businesses, a valid copy of the educational qualification certificate from college or higher of the person responsible for security and order is required.

- For business sectors and industries involving the use of industrial explosives; betting services, a document permitting operation from the specialized state management agency is required.

Which entities are required to apply for a new Certificate of Eligibility for Security and Order?

Pursuant to Sub-item 1, Item C, Part II, Administrative Procedures issued together with Decision 3191/QD-BCA in 2022 that stipulates the entities required to apply for a new Certificate of Eligibility for Security and Order include:

- Organizations and individuals investing in the following business sectors and industries:

+ Seal production; industries involving the use of industrial explosives; production, purchase, and sale of military uniforms, insignias, patches, ranks, number badges of the People’s Army and People’s Police.

+ Businesses involving machinery and equipment (including components, parts, and production equipment): Road traffic speed monitoring devices; GSM mobile phone monitoring devices and other mobile phone monitoring devices; alcohol concentration monitoring devices; betting services; printing service enterprises.

+ Devices causing interference, disrupting mobile communication signals; cosmetic surgery services; discotheques; lodging service enterprises; security services.

+ Business establishments under the Military and revenue-generating public service providers of central and provincial agencies and organizations within the managed area.

+ Other business establishments not specified in paragraph a, clause 1, and clause 3, Article 24, Decree No. 96/2016/ND-CP; business establishments authorized in writing by the Administrative Management Police Department on Social Order of the Ministry of Public Security.

What is the procedure for applying for a new Certificate of Eligibility for Security and Order at the provincial level?

Pursuant to Sub-item 1, Item C, Part II, Administrative Procedures issued together with Decision 3191/QD-BCA in 2022 that stipulates the procedure for applying for a new Certificate of Eligibility for Security and Order at the provincial level as follows:

Step 1: Organizations and individuals wishing to obtain a new Certificate of Eligibility for Security and Order submit applications directly or through postal services at the General Department of Administrative Management of Social Order - Ministry of Public Security during office hours on weekdays or submit applications online via the National Public Service Portal or the Public Service Portal of the Ministry of Public Security.

Step 2: The receiving officer checks the information, components, and validity of the application.

- If the application is valid and complete, the officer will accept the application for processing and issue a receipt directly or through postal services or via an account on the public service portal or via email (if available) to the business establishment or the person delegated to submit the application.

- If the application is invalid or incomplete, it will not be accepted, and a guideline form will be issued for completing the application either directly or through postal services or via email (if available) to the business establishment or the person delegated to submit the application.

- If the application does not meet the conditions, it will not be accepted, and a clear reason for rejection will be provided in a notice sent directly or through postal services or via an account on the public service portal or via email (if available).

Step 3: Based on the appointment date on the receipt, organizations or individuals will come to the application submission place to receive the result of the Certificate of Eligibility for Security and Order or receive the result via postal services after completing the appraisal fee payment.
