How long does it take to obtain a certificate of residence information in Vietnam?

Pursuant to the newly promulgated, amended, supplemented and annulled administrative procedures in the field of residence registration and immigration under the handling competence of the Ministry of Public Security enclosed with Decision 5548/QD-BCA-C06 in 2021 stipulating as follows:

4. Procedure: Verification of residence information
4.1. The order of execution:
- Step 1: Individuals and organizations prepare documents according to the provisions of law.
- Step 2: Individuals and organizations submit dossiers at the commune-level police station.
- Step 3: When receiving the application for verification of residence information, the residence registration agency checks the legality and content of the application:
+ In case the application is complete and valid, the application will be received and issued a receipt for the application and an appointment to return the results (form CT04 issued together with Circular No. 56/2021/TT-BCA) to the registrant;
+ In case the application is eligible but insufficient, guide on supplement and completion the application and issue the instruction slip for supplementing and completing the application (form CT05 issued together with Circular No. 56/2021/TT-BCA) to the registrant;
+ In case the application is not eligible, it will be rejected and issued a slip of refusal to receive and handle the application (form CT06 issued together with Circular No. 56/2021/TT-BCA) to the registrant.
- Step 4: Based on the appointment date on the Application Receipt Form and the appointment to return the results to receive a notification of the result of settlement of residence registration procedures (if any).
4.2. Methods:
- Submit the application directly to the commune-level police station.
- Submit your application online through online public service portals such as: Online at the Public Service Portal through the National Public Service Portal, or through the Public Service Portal of the Ministry of Public Security, the Public Service Portal for resident management reside.
Time to receive dossiers: Office hours on working days from Monday to Friday and Saturday morning (except public holidays as prescribed by law).
4.3. Composition, number of applications:
a) Application composition:
Declaration of change of residence information (Form CT01 issued together with Circular No. 56/2021/TT-BCA).

4.4. Time limit for settlement: From the date of receipt of valid dossiers, the residence registration agency is responsible for granting verification of information on residence to citizens in the case of information contained in the National Database of Population and within 3 working days for cases requiring verification; in case of refusal to process the verification of residence information, it must reply in writing and clearly state the reasons therefor.
4.5. Subjects carrying out administrative procedures: Agencies, organizations and individuals related to residence registration.
4.6. Agency carrying out administrative procedures: Commune-level police.
4.7. Result of administrative procedures:
- In case the application is valid and eligible, the residence registration agency shall issue a verification of residence information (Form CT07 issued together with Circular No. 56/2021/TT-BCA).
- In case of refusal to settle the household separation, there must be a written reply clearly stating the reason (form CT06 issued together with Circular No. 56/2021/TT-BCA).

- Law on Residence No. 68/2020/QH14 dated November 13, 2020;
- Decree No. 62/2021/ND-CP dated June 29, 2021 of the Government detailing a number of articles of the Law on Residence.
- Circular No. 55/2021/TT-BCA dated May 15, 2021 of the Ministry of Public Security detailing a number of articles and measures to implement the Law on Residence.
- Circular No. 56/2021/TT-BCA dated May 15, 2021 of the Ministry of Public Security providing for forms in registration and residence management;
- Circular No. 57/2021/TT-BCA dated May 15, 2021 of the Ministry of Public Security regulating the process of residence registration.

Thus, the time to issue a certificate of residence information is 01 working day in case the information is contained in the National Database on population and within 03 working days in the case where verification is required. When refusing to issue a certificate of residence information, the police agency must reply in writing and clearly state the reasons therefor.

Pursuant to Clause 2, Article 17 of Circular 55/2021/TT-BCA stipulating as follows:

2. Residence information that may be verified includes residence registration time, location and type. Residence information verification shall be valid for 06 months starting from the date on which the verification is made for the cases mentioned in Clause 1 Article 19 of the Residence Law if residence declaration is verified and valid for 30 days starting from the date on which the verification is made if residence information is verified. In case residence information of a citizen has changed and the change is updated to the residence database, residence information verification shall become invalid from the time of such change.

Thus, according to the above provisions, the certificate of residence information shall be valid for 06 months starting from the date on which the verification is made for the cases mentioned in Clause 1 Article 19 of the Residence Law if residence declaration is verified and valid for 30 days starting from the date on which the verification is made if residence information is verified.

How to receive applications for residence registration in Vietnam?

Pursuant to the provisions of Article 3 of Circular 55/2021/TT-BCA stipulating the receipt of applications for residence registration and announcement of results thereof as follows:

1. Applications for residence registration shall be directly received at offices of residence registration authorities (hereinafter referred to as “registration authorities”) or via the national public service portal, public service portal of the Ministry of Public Security or public service portal for residence management.
2. Applicants submitting their applications directly may submit certified copies or copies issued from the master registers (hereinafter referred to as “copies”) or photocopies together with their authentic copies for comparison. In case an applicant submits a photocopy together with its authentic copy, the application recipient shall inspect and compare the photocopy with its authentic copy and countersign and shall not request the applicant to submit a copy of such document.
3. Applicants submitting their applications via the national public service portal, public service portal of the Ministry of Public Security or public service portal for residence management shall declare information and attach scans or photocopies of necessary documents according to regulations. Citizens shall present the authentic copies of provided documents at the request of residence registration personnel.
4. Announcement of results of permanent residence registration, temporary residence registration, temporary residence extension, residence information declaration, residence information revision, household division and temporary absence declaration shall be carried out in writing or via emails, text messages, websites of registration authorities, electronic applications, national public service portal, public service portal of the Minister of Public Security or public service portal for residence management.
5. Registration authorities have the right to reject applications for residence registration and residence information verification and not refund paid charges if it is found that the documents provided by the applicants have been edited or forged.

Thus, applications for residence registration shall be directly received at offices of residence registration authorities or via the national public service portal, public service portal of the Ministry of Public Security or public service portal for residence management.
