When will teachers be entitled to hazard allowance in Vietnam?

According to the provisions of Article 10 of Decree 113/2015/ND-CP, the specific conditions for enjoyment are as follows:

Eligibility for allowance
1. Teachers must perform practical or integrative teaching duties (hereinafter referred to as practical teachers) in practice classrooms or facilities of public vocational education institutions or enterprises, manufacturing, trading and service business establishments associated with academic disciplines which involve one of physical hardship, hazard or danger as follows:
a) Direct contact with poisonous substances, gases or dusts; practical teaching work performed in the work environment that may easily inflict infection and infectious diseases in accordance with regulations;
b) Practical teaching work performed in the high-pressure or low-oxygen, very hot or cold work environment which exceeds the required standard;
c) Practical teaching work performed for academic disciplines that emit loud noise or at places that create constant high-frequency vibration exceeding rigorous standards of occupational safety and hygiene;
d) Practical teaching work performed in the work environment which produces radioactivity, radiation or electromagnetic field exceeding the required standard.
2. The list of academic disciplines which have arduous, hazardous and dangerous attributes shall be issued by the Ministry of Labor, War Invalids and Social Affairs.

Thus, according to the above regulations, teachers are entitled to hazard allowances when performing practical or integrative teaching duties in practice classrooms or facilities of public vocational education institutions or enterprises, manufacturing, trading and service business establishments associated with academic disciplines which involve one of physical hardship, hazard or danger:

- Direct contact with poisonous substances, gases or dusts; practical teaching work performed in the work environment that may easily inflict infection and infectious diseases in accordance with regulations;

- Practical teaching work performed in the high-pressure or low-oxygen, very hot or cold work environment which exceeds the required standard;

According to the provisions of Article 11 of Decree 113/2015/ND-CP, regulations on specific allowance levels are as follows:

Level of allowance
The physical hardship, hazard and danger allowance shall be calculated based on the statutory pay rate, which is categorized into the following level:
1. The level of 0.1 applicable to teachers teaching academic disciplines which involve one of physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 hereof.
2. The level of 0.2 applicable to teachers teaching academic disciplines which involve two physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 hereof.
3. The level of 0.3 applicable to teachers teaching academic disciplines which involve three physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 hereof.
4. The level of 0.4 applicable to teachers teaching academic disciplines which involve four physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 hereof.

Thus, based on the above regulations, physical hardship, hazard and danger allowances for teachers are categorized into 04 levels and are calculated according to the following levels:

- The level of 0.1 applicable to teachers teaching academic disciplines which involve one of physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 of Decree 113/2015/ND-CP.

- The level of 0.2 applicable to teachers teaching academic disciplines which involve two physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 of Decree 113/2015/ND-CP.

- The level of 0.3 applicable to teachers teaching academic disciplines which involve three physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 of Decree 113/2015/ND-CP.

- The level of 0.4 applicable to teachers teaching academic disciplines which involve four physical hardship, hazard or danger elements stipulated in paragraph 1 Article 10 of Decree 113/2015/ND-CP.

What is the formula to calculate the hazard allowance for teachers in Vietnam?

Pursuant to Article 6 of Circular 22/2017/TT-BLDTBXH regulating the calculation of monthly toxic allowances for teachers using the following formula:

Heavy, hazardous, dangerous allowance = (Level of heavy, hazardous, dangerous allowance x Statutory pay rate) / (Number of teaching hours for teachers in a year/12 months) x Number Hours of practical teaching and integration of arduous, hazardous, and dangerous fields and occupations during the month.

Note: The current statutory pay rate is 1,800,000 VND according to Article 3 of Decree 24/2023/ND-CP

Example 1: Teacher A is a teacher teaching practical welding skills at a workshop of an intermediate school (in direct contact with toxic gases), the allowance level for heavy, toxic and dangerous work is 0.1. .

- Statutory pay rate 1,800,000 VND.

- The teacher's teaching hour limit per year is 480 hours.

- The number of actual practice hours per month is 30 hours.

The heavy, hazardous, and dangerous allowance that teacher A receives monthly is calculated as follows:

Teacher's allowance for heavy, harmful and dangerous work = (0.1 x 1,800,000 VND)/ (480 hours/12 months) x 30 hours = 135,000 VND.

Example 2: Teacher B is a teacher who teaches welding practice in the ship's hold or barge's hold (direct contact with toxic gases and an oxygen-deficient environment), then the heavy, toxic, and dangerous allowance is benefit is 0.2.

- Statutory pay rate 1,800,000 VND.

- The teacher's teaching hour limit per year is 480 hours.

- The number of actual practice hours per month is 30 hours.

The heavy, hazardous, and dangerous allowance that teacher B receives monthly is calculated as follows:

Teacher's allowance for heavy, harmful and dangerous work = (0.2 x 1,800,000 VND)/ (480 hours/12 months) x 30 hours = 270,000 VND.
