From September 15, 2023: What are the requirements for Vietnamese traffic police officers in carrying out patrol, control, and handling of violations?

According to the regulations in Article 3 of Circular 32/2023/TT-BCA regarding the requirements for traffic police officers in carrying out patrol, control, and handling of violations, the following requirements are stated:

Requirements for traffic police officers in carrying out patrol, control, and handling of violations:
1. Comply with the regulations of road traffic laws, administrative violation handling laws, this Circular, and other relevant legal provisions.
2. Carry out assigned tasks correctly, completely, and responsibly according to the regulations and plans for patrol and control that have been issued by competent authorities; exercise democracy in ensuring traffic order and safety and in accordance with the People's Police Regulations.
3. When interacting with the public and individuals who have violated the law, maintain proper etiquette, demeanor, attitude, and appropriate cultural behavior.
4. Detect, prevent, and promptly handle violations of road traffic laws and other legal violations in accordance with the prescribed procedures and authorities.
5. Ensure compliance with other requirements and regulations of the Ministry of Public Security.

Therefore, starting from September 15, 2023, traffic police officers are required to meet the following requirements when carrying out patrol, control, and handling of violations:

- Comply with the regulations of road traffic laws, administrative violation handling laws, Circular 32/2023/TT-BCA, and other relevant legal provisions.

- Carry out assigned tasks correctly, completely, and responsibly according to the regulations and plans for patrol and control that have been issued by competent authorities; exercise democracy in ensuring traffic order and safety and in accordance with the People's Police Regulations.

- When interacting with the public and individuals who have violated the law, maintain proper etiquette, demeanor, attitude, and appropriate cultural behavior.

What are the duties of the Vietnamese traffic police officers in patrol and control?

Pursuant to the regulations in Article 7 of Circular 32/2023/TT-BCA regarding the duties of the Traffic Police in patrol and control, the following are the duties of the Traffic Police starting from September 15, 2023:

- Comply with the provisions of laws and orders, plans for patrol, control, and handling of violations that have been issued by competent authorities.

- Patrol, control, and handle violations to ensure order and safety on the road within the assigned routes and areas.

- Detect, prevent, and promptly handle violations of road traffic regulations and other legal violations as prescribed; coordinate with road management agencies to detect and prevent violations of regulations protecting road construction works and road safety corridors.

- Investigate and resolve traffic accidents as prescribed by laws and the Ministry of Public Security.

- Directly and in coordination with units within and outside the People's Police Force, combat crime and other legal violations on road traffic routes. Participate in counter-terrorism, anti-disruption of public order, prevention and control of epidemics, natural disasters, fires, and rescue operations on road traffic routes as prescribed.

- Through patrol, control, and handling of violations, fulfill the following tasks:

+ Identify weaknesses, deficiencies, and shortcomings in the state management of security, order, and road traffic to report and propose recommendations to competent authorities for timely remedies.

+ Guide, propagate, and mobilize the public to ensure order and road traffic safety and comply with road traffic laws.

- Carry out other tasks of the People's Police Force as prescribed by laws.

What are the regulations for traffic police officers when conducting control at a point on the traffic route in Vietnam?

Pursuant to the provisions of Clause 10, Article 2 of Circular 32/2023/TT-BCA, the regulations for public patrol and control are as follows:

2. Control at a point on the traffic route, at the Traffic Police Station
a) The Traffic Police organize forces at a point on the traffic route, at the Traffic Police Station according to the authorized plan to carry out control, detect and handle administrative violations of road traffic and other legal violations as prescribed.
b) At a point on the traffic route, choose a location with a wide and open road, without obstructing visibility and in compliance with the regulations of road traffic laws.
c) When conducting patrol and control, the Traffic Police use technical equipment (cameras) equipped to record the control process. For control during the evening or at night, there must be sufficient lighting.

Therefore, starting from September 15, 2023, the following regulations are applicable to traffic police officers when conducting control at a point on the traffic route:
