From May 18, 2024, what are the qualifications required for civil judgment enforcers in Vietnam?

On April 3, 2024, the Minister of Justice issued Circular 02/2024/TT-BTP stipulating codes, professional standards, and salary classification for civil judgment enforcement officials.

According to the provisions of Circular 02/2024/TT-BTP, training and retraining qualifications required for civil judgment enforcers in Vietnam are specified as follows:

[1] Senior Enforcer (Clause 4 Article 5 of Circular 02/2024/TT-BTP)

- Have a bachelor's degree in law or higher;

- Have a certificate of retraining the state management knowledge and skills for the senior official rank and equivalent or advanced degrees in political and administrative theory;

- Possess an advanced diploma in political theory or an advanced diploma in political-administrative theory or a diploma or certificate certifying the political theory level equivalent to the advanced level of the political theory of the competent authority;

- Have certificates of retraining knowledge and skills as required for job positions for senior enforcers according to the program contents of the Ministry of Justice.

[2] Intermediate Enforcer (Clause 4 Article 6 of Circular 02/2024/TT-BTP)

- Have a bachelor's degree in law or higher;

-Have a certificate of retraining the state management knowledge and skills for the principal official rank and equivalent or advanced degrees in political and administrative theory;

- Have certificates of retraining knowledge and skills as required for job positions for intermediate enforcers according to the program contents of the Ministry of Justice.

[3] Primary Enforcer (Clause 4 Article 7 of Circular 02/2024/TT-BTP)

- Have a bachelor's degree in law or higher;

- Have certificates of retraining state management knowledge and skills for official rank and equivalent;

- Have a certificate of professional training in civil judgment enforcement.

What are the requirements for professional competencies of civil judgment enforcers in Vietnam?

Under Circular 02/2024/TT-BTP, civil judgment enforcers in Vietnam must meet the following requirements for professional competencies of civil judgment enforcers:

[1] Senior Enforcer (Clause 3 Article 5 of Circular 02/2024/TT-BTP)

- Master and deeply understand the Party's policies, the State's laws, directives and resolutions of superiors to apply to the enforcement of civil judgments and administrative judgments; strategic objectives of economic, cultural and social development;

- Master and understand the knowledge of state administrative management, deeply understand the contents of the law on the enforcement of civil judgments and administrative judgments; be proficient in applying principles, regimes, and procedures on civil judgment enforcement;

- Master the situation and development trends in civil judgment enforcement in Vietnam and the world; organize research for management and processing of managed information;

- Be able to propose, advise on policy-making, take charge of formulating projects, draft legal documents, schemes, and programs associated with professional operations in civil judgment enforcement for submission to competent authorities for consideration and decision; be able to coordinate well with relevant agencies, units and individuals in the performance of assigned tasks;

- Be able to educate and persuade litigants to execute the court’s judgments and decisions; decisions of the Competition Case Handling Council and judgments and decisions of Commercial Arbitration;

- Be proficient in drafting, presentation, protection, and implementation organization skills to formulate and implement projects, schemes, programs, work plans, and teaching materials related to the enforcement of civil judgments and administrative judgments;

- Be able to conduct scientific research, summarize large-scale topics in assigned fields, and propose strategic matters on enforcement of civil judgments and administrative judgments; have the ability to analyze, generalize and synthesize in many fields related to judgment enforcement;

- Have basic information technology skills.

[2] Intermediate Enforcer (Clause 3 Article 6 of Circular 02/2024/TT-BTP).

- Master the Party's policies, the State's laws, directives and resolutions of superiors to apply to the enforcement of civil judgments and administrative judgments;

- Deeply understand the contents of the law on civil judgment enforcement and law on administrative judgment enforcement; be proficient in applying principles, regimes, and procedures on civil judgment enforcement;

- Master the situation and development trends in civil judgment enforcement in Vietnam and the world; organize research for management and processing of managed information;

- Be able to coordinate well with relevant agencies, units and individuals in the performance of assigned tasks;

- Be able to educate and persuade litigants to execute the court’s judgments and decisions; decisions of the Competition Case Handling Council and judgments and decisions of Commercial Arbitration.

- Be able to analyze, synthesize, and master skills in formulating documents related to assigned functions and tasks and making presentations on assigned matters.

- Have basic information technology skills.

[3] Primary Enforcer (Clause 3 Article 7 of Circular 02/2024/TT-BTP)

- Master the Party's policies, the State's laws, directives and resolutions of superiors to apply to the enforcement of civil judgments and administrative judgments;

- Master the contents of the law on civil judgment enforcement and law on administrative judgment enforcement; be proficient in applying principles, regimes, and procedures on civil judgment enforcement in organizing the execution of assigned cases.

- Understand the local economic and social situation; be proficient in the subordinate area

- Be able to coordinate well with relevant agencies, units, and individuals in performing assigned tasks

- Be able to educate and persuade litigants to execute the court’s judgments and decisions; decisions of the Competition Case Handling Council and judgments and decisions of Commercial Arbitration.

- Be able to draft documents related to assigned tasks.

- Have basic information technology skills.
