From May 15, 2024, which facilities are included in the list of facilities with fire and explosion hazards in Vietnam under Decree 50/2024/ND-CP?

Based on Appendix II attached to Decree 50/2024/ND-CP dated May 10, 2024, by the Government of Vietnam, the list of facilities with fire and explosion hazards in Vietnam is as follows:

(1) Governmental offices at all levels with buildings 10 floors or higher or having a total volume of 25,000 m3 or more.

(2) Apartment buildings, dormitories, or hostels 7 floors or higher or having a total volume of 10,000 m3 or more; mixed-use buildings 5 floors or higher or having a total volume of 5,000 m3 or more.

(3) Kindergartens, preschools, or nurseries with 350 or more children or having a total volume of 5,000 m3 or more in their teaching and service buildings; primary schools, junior high schools, high schools, and multi-level schools with a total volume of 5,000 m3 or more in their teaching and service buildings; colleges, universities, academies, professional secondary schools, vocational schools, continuing education institutions 7 floors or higher or with a total volume of 10,000 m3 or more; other educational institutions established under the Education Law with a total volume of 5,000 m3 or more.

(4) Hospitals with 250 or more beds; general clinics, specialist clinics, convalescent homes, rehabilitation centers, orthopedic facilities, nursing homes, disease control facilities, medical centers, other medical institutions established under the Medical Examination and Treatment Law 5 floors or higher or with a total volume of 5,000 m3 or more.

(5) Theaters, cinemas, circuses with 600 or more seats; conference, event centers, cultural houses 5 floors or higher or with a total volume of 10,000 m3 or more in their buildings; karaoke, dance halls, bars, clubs 5 floors or higher or with a total volume of 5,000 m3 or more in their buildings; amusement parks, zoos, aquariums with a total volume of 5,000 m3 or more.

(6) Grade 1 markets, grade 2 markets; commercial centers, electronics stores, supermarkets, service business, dining establishments, businesses selling flammable or explosive goods with a total business area of 500 m2 or more or with a total volume of 5,000 m3 or more in their buildings.

(7) Hotels, guest houses, inns, other lodging establishments established under the Tourism Law, hostels 7 floors or higher or with a total volume of 10,000 m3 or more in their buildings.

(8) Buildings used as headquarters, offices for enterprises, political organizations, social organizations 7 floors or higher or with a volume of 10,000 m3 or more.

(9) Museums, libraries, exhibition halls, display houses, archives, bookstores, fair houses with a volume of 10,000 m3 or more.

(10) Post offices, mail processing facilities, telecommunications facilities 5 floors or higher or with a total volume of 10,000 m3 or more in their buildings; data management centers, broadcasting stations, printing and publishing facilities with a total volume of 5,000 m3 or more in their buildings.

(11) Stadiums with a capacity of 40,000 or more seats; indoor sports halls with a capacity of 500 or more seats; sports centers, race tracks, shooting ranges with a total sports arena volume of 10,000 m3 or more or a total seating capacity of 5,000 or more; other sports facilities established under the Physical Training and Sports Law with a volume of 5,000 m3 or more.

(12) Airports; air traffic control towers; seaports; inland ports grade I, grade II; grade I and II bus stations; grade I rest stops; grade I, II railway stations; cable car stations for transporting people with a volume of 5,000 m3 or more; subway constructions; vehicle registration centers; businesses, repair, and maintenance facilities for vehicles with a total business area of 500 m2 or more or a total volume of 5,000 m3 or more in their buildings.

(13) Parking garages with a capacity of 50 or more cars.

(14) Nuclear facilities; facilities producing, trading, storing, using industrial explosives and explosive precursors; warehouses for industrial explosives, explosive precursors; ports for importing and exporting industrial explosives, explosive precursors; armory and auxiliary tool warehouses.

(15) Facilities extracting, processing, manufacturing, transporting, trading, and storing petroleum and petroleum products, gas onshore; petroleum and petroleum product warehouses, gas warehouses; ports for importing and exporting petroleum and petroleum products, gas; gasoline stations; shops selling flammable liquids, gas stores with a total gas storage of 200 kg or more.

(16) Industrial facilities with fire and explosion hazard classifications A, B with a total production chain building volume of 5,000 m3 or more; fire and explosion hazard classification C with a total production chain building volume of 10,000 m3 or more; fire and explosion hazard classification D, E with a total production chain building volume of 15,000 m3 or more.

(17) Power plants; substations with voltage from 110 kV or more.

(18) Tunnels used for production, storage, or use of flammable or explosive substances; national reserve warehouses; warehouses storing flammable goods and materials with a total volume of 5,000 m3 or more.

What acts are prohibited in fire prevention and fighting in Vietnam?

Based on Article 13 of the Fire Prevention and Fighting Law 2001 supplemented by Clause 8, Article 1 of the Amended Fire Prevention and Fighting Law 2013, the following acts are prohibited:

- Deliberately causing fire or explosion, harming human life and health; damaging the property of the state, agencies, organizations, and individuals; adversely affecting the environment, security, and social safety and order.

- Obstructing fire prevention and fighting activities; resisting fire prevention and fighting officers.

- Exploiting fire prevention and fighting to harm human life and health; infringing upon the property of the state, agencies, organizations, and individuals.

- Reporting false fire alarms.

- Failing to report a fire when able to do so; delaying fire reporting.

- Illegally producing, storing, transporting, using, or selling hazardous flammable or explosive substances.

- Illegally bringing flammable or explosive goods and materials into crowded places.

- Constructing buildings with fire and explosion hazards or high-rises and commercial centers without approved fire prevention and fighting designs; accepting and putting into use buildings with fire and explosion hazards, high-rises, commercial centers without meeting fire prevention and fighting safety requirements.

- Appropriating, destroying, damaging, arbitrarily altering, relocating, obscuring fire prevention and fighting equipment, signs, and evacuation routes.

- Other acts violating the legal provisions on fire prevention and fighting

What are the cases of temporary suspension of operations if they do not meet fire safety requirements in Vietnam?

According to Article 17 of Decree 136/2020/ND-CP as amended by Clause 9, Article 1 of Decree 50/2024/ND-CP, the following cases are subject to temporary suspension of activities:

Temporary suspension, suspension of activities of facilities, motor vehicles, households, and individuals not ensuring fire prevention and fighting safety

1. Cases subject to temporary suspension:

a) In hazardous fire and explosion environments where ignition sources or heat sources appear, or when ignition sources or heat sources exist and hazardous fire and explosion environments appear (hereinafter referred to as direct risk of fire and explosion);

b) Serious violations of fire prevention and fighting regulations that have been required by the competent authority to be remedied in writing but are not implemented, including: illegal production, storage, transportation, use of hazardous flammable and explosive substances; not ensuring fire compartment separation solutions between fire compartments of industrial facilities with fire and explosion hazard classifications A, B, C; not having the required number of emergency exits;

c) Particularly serious violations of fire prevention and fighting regulations:

Putting works, project sections, and motor vehicles requiring special fire prevention and fighting safety into operation and use as stipulated in Appendix V attached to this Decree without a fire prevention and fighting design approval or acceptance document, or an acceptance approval document from the competent police authority requiring remedy in writing but not implemented.

There are 03 cases subject to temporary suspension as follows:

- In hazardous fire and explosion environments where ignition sources or heat sources appear, or when ignition sources or heat sources exist and hazardous fire and explosion environments appear.

- Serious violations of fire prevention and fighting regulations that have been required by the competent authority to be remedied in writing but are not implemented.

- Particularly serious violations of fire prevention and fighting regulations.
