How is the procedure to support small and medium enterprises in Vietnam implemented?
Pursuant to Article 32 of Decree 80/2021/ND-CP stipulates as follows:
“Article 32. Support processes and procedures
1. Small and medium enterprises are supported through agencies and organizations supporting small and medium enterprises. Small and medium-sized enterprises shall send dossiers of proposal for support needs specified in Clause 4 of this Article either in person or online to agencies or organizations supporting small and medium-sized enterprises for consideration and decision.
2. For the content of information support, human resource development for small and medium-sized enterprises and support for small and medium-sized enterprises converting from business households: Agencies and organizations supporting small and medium-sized enterprises implement according to the plans and estimates of the assigned state budget.
3. For the content of consulting support, technology, support for small and medium-sized enterprises in creative start-ups, small and medium-sized enterprises participating in industry clusters and value chains, the process and procedures must be followed. as follows:
a) Within 14 working days from the date of receipt of the dossier of proposal for support needs of the small and medium-sized enterprise, the agency or organization supporting the small and medium-sized enterprise shall consider the dossier, make a decision and make a decision. notice (in writing or online) to the business. In case an enterprise is not eligible for support, the agency or organization supporting small and medium-sized enterprises shall notify such to the enterprise. In case an enterprise is eligible for support but does not have a complete dossier, the agency or organization supporting small and medium enterprises shall guide the enterprise to complete the dossier. In case the enterprise is eligible for support and completes the application, the agency or organization that supports the small and medium-sized enterprise shall issue a notice on support for the enterprise, clearly stating the contents and budget in the notice. State support books and other funds (if any).
b) Where the agency or organization supporting small and medium-sized enterprises is capable of directly providing supporting products and services to small and medium-sized enterprises:
After the announcement of support for small and medium-sized enterprises is announced, the agency or organization supporting small and medium-sized enterprises together with the small and medium-sized enterprise shall sign a contract; the contract must clearly show the state budget support, expenses to be paid by small and medium-sized enterprises, other expenses (if any) and payment terms. On the basis of the results of contract implementation, the two parties take over, liquidate and settle contract costs according to regulations.
c) In case the agency or organization supporting small and medium-sized enterprises cooperates with other agencies, organizations and individuals capable of providing supporting products and services for small and medium-sized enterprises (collectively referred to as the "small and medium enterprises"). provider):
After the announcement of support for small and medium-sized enterprises is announced, the agency or organization supporting small and medium-sized enterprises together with the supplier and the small and medium-sized enterprise shall sign a contract; the contract must clearly show the state budget support, expenses to be paid by small and medium-sized enterprises, other expenses (if any) and payment terms. On the basis of the results of contract implementation, the three parties check, accept, liquidate and settle contract costs according to regulations.
d) The use, payment and settlement of state budget support funds of agencies or organizations supporting small and medium-sized enterprises according to the cases specified at Points b and c of this Clause must comply with regulations of this Law. legislation on state budget and related guiding documents.
4. A dossier of proposal for support needs includes:
a) A declaration of identification of a micro-enterprise, a small-sized enterprise, a medium-sized enterprise and a request for support, made according to the form specified in the Appendix issued together with this Decree;
b) Documents and records related to the proposed support content (if any).
5. A dossier of payment of state budget funding to support small and medium-sized enterprises includes:
a) Notice of support for small and medium enterprises;
b) Contract, contract liquidation and acceptance (if any) between small and medium enterprises and agencies, organizations and individuals providing support services;
c) Relevant invoices and financial documents.”
Thus, the implementation of support for small and medium enterprises in Vietnam is carried out in accordance with the above provisions.

Guidance on implementing the process of supporting small and medium-sized enterprises in Vietnam in the near future?
Pursuant to Article 5 of Circular 06/2022/TT-BKHDT has the following guidelines:
“Article 5. Guidelines for the implementation of support for SMEs
Agencies and organizations supporting SMEs shall support SMEs according to the provisions of Article 32 of Decree No. 80/2021/ND-CP, specifically as follows:
1. Components of a proposal include:
a) A declaration according to the form specified in Appendix 1 issued with Decree No. 80/2021/ND-CP, clearly stating the content and budget level requested for support, the supplier's quotation ( if).
b) Documents and dossiers related to the proposed support content: Documents identifying innovative start-up SMEs specified in Clauses 1 and 2, Article 15 of this Circular; identify SMEs participating in industry clusters and value chains in the field of production and processing specified in Articles 17 and 18 of this Circular; other directly related documents (if any).
2. Regarding the content of supporting human resource development for SMEs as prescribed in Clauses 1, 2, 3, Article 14 of Decree No. 80/2021/ND-CP: agencies and organizations supporting SMEs shall comply with regulations. specified in Section 2, Chapter II of this Circular.
3. Regarding the content of technology support, consulting and support for SMEs to start and innovate, support SMEs to join industry clusters and value chains specified in Clauses 1, 2, 3, 4, Article 11, Clause 2, Article 13, Article 22, Article 25 of Decree No. 80/2021/ND-CP: agencies and organizations supporting SMEs shall comply with the provisions of Clause 3, Article 32 of Decree No. 80/2021/ND-CP ( contract form in Appendix 1 of this Circular).
4. SME support agencies and organizations review dossiers, summarize SME's proposed support needs and approve annual or quarterly SME support plans. The selection of suppliers to implement the SME support plan shall comply with the provisions of the law on bidding.”
Accordingly, the application documents and supporting process for small and medium-sized enterprises in Vietnam are carried out according to the content of the instructions mentioned above.
Support consulting remuneration for small and medium enterprises in Vietnam?
Pursuant to Article 4 of Circular 06/2022/TT-BKHDT stipulates as follows:
“Article 4. Activities supported by the state budget
Agencies and organizations supporting SMEs determine the activities supported by the state budget as prescribed in Clause 3, Article 32 of Decree No. 80/2021/ND-CP as follows:
1. For consulting support content: consulting remuneration for SMEs; field visits, meetings and working trips of individual consultants; interpreting for foreign consultants; management activities of the consulting organization (in case the consultant is an organization).
2. For supporting contents specified in Clause 5, Article 22; Points c, d, dd, Clause 6, Article 22; Clause 1, Article 25; Points d, dd, Clause 3, Article 25 of Decree No. 80/2021/ND-CP: follow the instructions in Articles 16 and 19 of this Circular.
3. For supporting contents specified in Clause 2, Article 11; Clause 1 Article 22; Points b and c Clause 3 Article 22; Points b and c Clause 4 Article 25; Clause 5, Article 25 of Decree No. 80/2021/ND-CP: comply with regulations in specialized legal documents guiding economic-technical standards and norms. In the absence of regulations, based on the work items stated in the quotation of the supplier in the market, it must be reasonable, valid, effective, and meet the needs of SMEs.
Thus, the activities mentioned in the above regulations will be supported from the state budget.
Circular 06/2022/TT-BKHDT will take effect from June 25, 2022.
