From July 1, 2024, which payroll will apply to People's Public Security officers in Vietnam?

On November 10, the National Assembly passed the Resolution on the 2024 State budget estimate.

The Resolution clearly states that from July 1, 2024, a comprehensive reform of salary policy will be implemented according to Resolution 27-NQ/TW of 2018 of the Seventh Conference of the 12th Central Committee.

Thus, from July 1, 2024, People's Public Security officers will have a separate payroll built according to positions, titles, and ranks or grades.

When implementing salary reform from July 1, 2024, the salary for People's Public Security officers will be designed according to the following formula:

Police professional officer salary = Basic salary + allowances (if any) + bonuses (if any). 

In addition, the salary level for People's Public Security officers during the salary reform will increase as follows:

- Increase by 7% per year from 2025 until the minimum salary is equal to or higher than the minimum salary of region I in the enterprise sector.

- Income from bonuses (if any), with the bonus fund being about 10% of the total annual salary fund, excluding allowances.

What are the positions of People's Public Security officers in Vietnam?

According to Article 24 of the Law on People's Public Security 2018, it is stipulated as follows:

Positions and titles of People's Public Security officers

1. The basic positions for People's Public Security officers include:

a) Minister of Public Security;

b) Director General, Commander;

c) Director of Provincial Police, City Police under central authority;

d) Head of Department; Head of District-level Police, town, city under province, city under central authority; Regiment Commander;

dd) Team Leader; Head of Commune, Ward, Town Police; Battalion Commander;

e) Company Commander;

g) Platoon Leader;

h) Squad Leader.

2. Positions equivalent to those specified at points b, c, d, đ, e, g, and h, clause 1 of this article and the remaining positions and titles in the People's Public Security are regulated by the Minister of Public Security.

3. The professional titles and standards for the professional titles of People's Public Security officers are prescribed by the Minister of Public Security in accordance with the law.

- Minister of Public Security;

- Director General, Commander;

- Director of Provincial Police, City Police under central authority;

- Head of Department; Head of District-level Police, town, city under province, city under central authority; Regiment Commander;

 - Company Commander;

- Platoon Leader;

- Squad Leader.

What are the duties and powers of the People's Public Security?

According to Article 16 of the Law on People's Public Security 2018, it is stipulated as follows:

Duties and powers of the People's Public Security

1. Collect information, analyze, evaluate, forecast the situation, and propose to the Communist Party and the State to promulgate, direct the implementation of guidelines, policies, laws, strategies to protect national security, ensure social order and safety, combat, prevent crimes and violations of laws on national security, social order and safety; participate in appraising and evaluating the impact on national security, social order and safety for socio-economic development plans and projects in accordance with the law; closely combine the tasks of protecting national security, ensuring social order and safety, combating, preventing crimes and violations of laws on national security, social order and safety with socio-economic development tasks; effectively coordinate security activities with defense and foreign affairs activities.

2. Proactively prevent, detect, stop, fight and defeat plots and activities that infringe on national security, eliminate the dangers that threaten national security; protect independence, sovereignty, unity and territorial integrity of the Fatherland; protect the Communist Party, the State, the People and the socialist system; protect political security, security in the fields of ideology – culture, economy, defense, foreign affairs, information, society, environment, science and technology; protect other national interests; protect the great solidarity of the entire nation; protect life, health, honor, dignity, property, freedom, democracy of citizens, and the legitimate rights and interests of organizations and individuals.

3. Conduct intelligence activities according to the provisions of the law.

4. Protect senior leaders of the Communist Party, the State, international guests visiting and working in Vietnam; protect events, important goals in politics, economy, diplomacy, science – technology, culture, society; protect important works related to national security, foreign representative agencies, representatives of international organizations in Vietnam; protect individuals who hold or closely relate to state secrets; protect transportation of special items according to the provisions of the law.

5. Manage the protection of national security and state secrets; take lead in managing immigration, emigration, transit, and residence of foreigners in Vietnam; manage the emigration, immigration of Vietnamese citizens in accordance with the law; control immigration, emigration, and transit at border gates as stipulated by the law; cooperate with the People's Army, relevant sectors, and local authorities in managing and protecting national borders, border gates, islands, seas, skies, and perform tasks to protect national security, ensure social order and safety in border areas according to the law, international treaties to which the Socialist Republic of Vietnam is a member, and related international agreements.

6. Manage cybersecurity, protect cybersecurity and prevent network crime according to the provisions of the law.

7. Manage investigation and prevention of crimes. Take lead in combating terrorism, riots, and resolving complex security situations as stipulated by law. Proactively prevent, detect, stop, fight crimes and violations of laws on social order and safety, protect the environment, resources, and food safety related to the environment; receive, resolve crime reports, initiation requests; prosecute, investigate crimes according to the law; conduct criminal statistics; identify the causes and conditions of crimes and violations of laws on social order and safety, on environmental protection and propose corrective measures; educate law violators in the community according to the law.

8. Manage criminal enforcement, temporary detention; manage prisons, temporary detention facilities, and compulsory education facilities; implement criminal judgments, judicial measures; supervise and educate minors who are exempt from criminal liability; manage early released prisoners with conditions; perform escort, transfer, manage evidence warehouses, protect trials and perform other judicial support tasks according to the law.

9. Manage administrative sanctioning, handling administrative violations in the field of national security, social order and safety; impose administrative sanctions and apply administrative measures according to the law; ensure security and order during the implementation of enforcement decisions at the request of competent authorities.

10. Manage residence, national population database, citizen identity database, seals, traffic order and safety, public order, weapons, explosives, explosive precursors, supporting tools, fire prevention, fighting, rescue, and salvage according to the law; issue and manage citizen identity cards and other personal papers; register, issue and manage vehicle licenses; perform fire prevention, fighting, rescue, and salvage tasks; manage security and order for investment and business sectors with conditions according to the law.

11. Take lead, coordinate and manage propaganda, education about protecting national security, ensuring social order and safety, combating, preventing crimes and violations of laws on national security, social order and safety; guide, inspect, supervise, resolve complaints, denunciations, handle violations in activities to protect national security, ensure social order and safety, combat, prevent crimes and violations of laws on national security, social order and safety.

12. Play a key role in building people's security and the people's security posture, building the movement of the entire people to protect national security. Guide agencies and organizations to protect internal political security, economic security, ideological – cultural security, cybersecurity, information security, communication security, social security, environmental security.

13. Guide, train, and provide legal knowledge for public security organizations participating in protecting security, order at the grassroots level, neighborhood patrols, neighborhood watch, protect agencies and enterprises according to the law.

14. Apply measures of public mobilization, law, diplomacy, economics, science – technology, profession, armed forces to protect national security, ensure social order and safety, combat, prevent crimes and violations of laws on national security, social order and safety.

15. Use weapons, explosives, supporting tools, force, professional technical means, and other means to attack, arrest criminals, stop offenders, or other law-violating acts and for legitimate self-defense according to the law.

16. Decide or propose the temporary suspension, suspension of activities of agencies, organizations, individuals having acts harmful or threatening to national security, social order, and safety; request agencies, organizations, individuals to provide information, documents, objects when there are grounds to determine their relation to activities infringing on national security, social order, and safety according to the law. Mobilize, requisition information and communication means, transport means, other means, and people using or operating those means in urgent cases to protect national security, ensure social order and safety, or to prevent or mitigate the consequences of social harm occurring or posing a risk of occurring according to the law.

17. Take measures to protect national security, ensure social order and safety according to the law when there are states of war, emergency situations, or when there is a threat to national security, social order, and safety but not to the extent of declaring a state of emergency.

18. Manage, develop security industry; research, apply, mobilize scientific and technological achievements in protecting national security, ensuring social order and safety, combating crimes, violations of laws on national security, social order and safety and build the People's Public Security.

19. Build a revolutionary, professional, elite, gradually modern People's Public Security force, prioritizing the modernization of certain forces; play a key role in performing tasks to protect national security, ensure social order and safety, combat crimes, violations of laws on national security, social order and safety.

20. Perform international obligations; cooperate internationally in combating crimes, protecting national security, ensuring social order and safety, and building the People's Public Security force; provide mutual legal assistance in criminal matters according to the law. The Ministry of Public Security is the central authority of the Socialist Republic of Vietnam in extradition and transfer of sentenced persons.

21. Perform other tasks and powers according to the law.

Thus, the People's Public Security has duties and powers as stipulated above.
