From July 1, 2024, will the resolution time for digital certificate issuance requests of the State Bank be reduced?

Based on Clause 3, Article 5 of Circular 28/2015/TT-NHNN as amended by Clause 6, Article 1 of Circular 10/2020/TT-NHNN, the resolution time for digital certificate issuance is regulated as follows:

3. Resolution time and result implementation

Within 05 working days from the date of receiving the request for the issuance of a digital certificate, the Information Technology Department shall proceed to check the dossier, issue the digital certificate or supplement the digital certificate operations for the subscriber, send the digital certificate issuance notification and activation code to the email address and SMS to the mobile phone number of the subscriber. For digital certificates for organizations, the Information Technology Department shall send the digital certificate issuance notification and activation code to the email address and SMS to the mobile phone number of the focal person in charge of digital certificates of the subscriber’s managing organization as prescribed in Clause 1, Article 14 of this Circular.

In case the dossier is invalid, the Information Technology Department shall refuse to process the dossier and state the reasons. Feedback and dossier processing results shall be carried out as prescribed in Clause 3, Article 4a of this Circular.

According to the new regulations in Clause 7, Article 1 of Circular 16/2023/TT-NHNN, the time to process the digital certificate issuance application is amended as follows:

4. Resolution time and result implementation

Within 03 working days from the date of receiving a valid request for the issuance of a digital certificate, the Information Technology Department shall proceed to issue the digital certificate or supplement the digital certificate operations for the subscriber, send the digital certificate issuance notification and activation code to the email address and SMS to the mobile phone number of the subscriber. For digital certificates for organizations, the Information Technology Department shall send the digital certificate issuance notification and activation code to the email address and SMS to the mobile phone number of the focal person in charge of digital certificates of the subscriber’s managing organization.

In case the dossier is invalid, the Information Technology Department shall refuse to process the dossier and state the reasons within 02 working days from the date of receiving the dossier. Feedback and dossier processing results shall be carried out as prescribed in Clause 3, Article 4a of this Circular.

Thus, according to the new regulation, from July 1, 2024, the time to process the application for issuing a digital certificate will be reduced from 05 working days to 03 working days from the date of receiving a valid application.

How will the content of the digital certificate of the State Bank change from July 1, 2024?

Based on the current regulations in Article 4 of Circular 28/2015/TT-NHNN, the content of the digital certificate is as follows:

1. Name of the digital signature service provider.

2. Name of the subscriber.

3. Name of the subscriber's managing organization.

4. Serial Number of the digital certificate.

5. Validity period of the digital certificate.

6. Public key of the subscriber.

7. Digital signature of the digital signature service provider.

8. Restrictions on the purposes and scope of use of the digital certificate.

9. Legal liability limitations of the digital signature service provider.

10. Other necessary contents as prescribed by the Ministry of Information and Communications.

Based on the new regulations in Clause 4, Article 1 of Circular 16/2023/TT-NHNN, the content of the digital certificate is as follows:

10. Other necessary contents as prescribed by the Ministry of Information and Communications.

Accordingly, under the new regulation in Circular 16/2023/TT-NHNN, the content of the digital certificate of the State Bank will no longer include information about the subscriber’s managing organization and will instead include cryptographic algorithm information.

What will be the validity period of the digital certificate after renewal?

Based on Clause 8, Article 1 of Circular 16/2023/TT-NHNN amending and supplementing Article 6 of Circular 28/2015/TT-NHNN, it is stipulated as follows:

Renewal, Change of Digital Certificate Information

1. The request for renewal or change of digital certificate information must ensure that the certificate remains valid.

2. The validity period of the digital certificate:

a) The renewed digital certificate's validity period shall be calculated from the successful renewal date but shall not exceed 05 years;

b) Changing the digital certificate information does not alter the validity period of the digital certificate.

3. Cases for renewal or change of digital certificate information:

a) The subscriber’s managing organization must request the renewal of the digital certificate at least 10 days before the certificate expires;

b) The subscriber’s managing organization must request the change of digital certificate information within 05 working days from any of the following changes:

- Changes in the subscriber’s title, position, or department without changing the organization/branch. If the subscriber changes their working unit/branch, the subscriber’s managing organization shall revoke the digital certificate at the old unit/branch and issue a new digital certificate at the new unit/branch if the subscriber needs to continue using it;

- Changes in the subscriber's identification number/Citizen ID/Passport;

- Changes in the subscriber's address, email, phone number.

Thus, based on the above regulations, the renewed digital certificate will be valid from the successful renewal date but will not exceed 05 years.

Circular 16/2023/TT-NHNN takes effect from July 1, 2024, and repeals Circular 10/2020/TT-NHNN.
