What are the bases for determining the price of maritime pilot services?

Based on Article 10 of Circular 39/2023/TT-BGTVT, the bases for determining the price of maritime pilot services are as follows:

- The price of maritime pilot services is calculated per pilot trip, by multiplying the corresponding service price specified in Article 8, Article 9 of Circular 39/2023/TT-BGTVT by the piloting distance and the total gross tonnage (GT) of the vessel; specifically for point 6 of Article 8 and point 6 of clause 1 Article 9 of Circular 39/2023/TT-BGTVT, the price is calculated by multiplying the corresponding service price by the total gross tonnage of the vessel.

- In case the pilot service price calculated according to clause 1 of Article 10 of Circular 39/2023/TT-BGTVT is lower than the minimum price for one pilot trip, the minimum price for one pilot trip specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT shall be applied.

- Total gross tonnage (GT) is a base unit for calculating the pilot service price, which is defined as follows:

+ For liquid cargo vessels: the gross tonnage is calculated as 85% of the maximum GT recorded on the certificate issued by the relevant authorities, regardless of whether the vessel has ballast tanks.

+ For passenger vessels: the gross tonnage is calculated as 50% of the maximum GT recorded on the certificate issued by the relevant authorities.

What specific cases are used to calculate the price of maritime pilot services?

Based on Article 11 of Circular 39/2023/TT-BGTVT, specific cases used to calculate the price of maritime pilot services include:

- When requesting pilot services, the requester must notify the pilot organization at least 06 hours before the pilot's dispatch; for offshore oil ports, at least 24 hours' notice is required.

In case of changes or cancellation of pilot service requests, the requester must notify the pilot organization at least 03 hours before the scheduled time; for offshore oil ports, at least 08 hours' notice is required.

- If the request time or cancellation notice is under 03 hours for pilot services or under 08 hours for offshore oil ports, the requester must pay a waiting charge of 30,000 VND/person/hour for domestic activities and 10 USD/person/hour for international activities.

If the request includes a vehicle, the charge is 200,000 VND/person and vehicle/hour for domestic activities and 20 USD/person and vehicle/hour for international activities.

If the pilot has not yet departed, the waiting time is calculated as 01 hour; if the pilot has departed, waiting time is calculated from the departure time until the pilot returns to the original position, with a minimum of 01 hour; the pilot can wait at the designated meeting point for a maximum of 04 hours beyond the requested service time, after which the request is considered canceled and the requester must pay 80% of the pilot service fee for the requested distance and the rates as specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT.

- If the pilot has completed piloting but the captain retains the pilot, additional waiting time charges will apply and will be calculated based on the actual time retained.

- If the pilot has boarded the vessel and the pilot request is canceled, the requester must pay 80% of the pilot service fee for the requested distance and the rates specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT.

- Vessels conducting machinery and equipment tests or compass adjustments are subject to 110% of the price framework specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT.

- Vessels unable to operate due to technical issues requiring the use of a tugboat are subject to 150% of the price framework specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT.

- Vessels requiring emergency pilot services (besides those stated in clauses 1 to 6 of Article 11 of Circular 39/2023/TT-BGTVT) are subject to 110% of the price framework specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT.

- If the pilot has boarded the vessel but it cannot operate due to force majeure confirmed by the regional maritime authority, the pilot service fee is equal to the minimum price for one pilot trip as specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT.

- If the vessel does not proceed directly to the destination port but requires anchoring en route (except for routes not authorized for night navigation), the requester must pay additional vehicle costs for the pilot pick-up and drop-off. The vehicle pick-up/drop-off fee is no more than 300,000 VND/vessel/trip for domestic vessels and 30 USD/vessel/trip for international vessels.

- If the vessel arrives at the pilot pick-up location at the scheduled time approved by the regional maritime authority and the pilot is late, leading to waiting, the pilot organization must compensate the shipowner at a rate of 250,000 VND/hour for domestic activities and 100 USD/hour for international activities based on actual waiting time.

- Vessels (except passenger vessels) entering and leaving a maritime area a minimum of 04 trips/month/area, from the fourth trip onwards in the month, the pilot service fee is 80% of the framework specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT but not lower than 2,000,000 VND for domestic vessels and 300 USD for international vessels.

- Passenger vessels entering and leaving a maritime area a minimum of 4 trips/month/area, from the fourth trip onwards in the month, the pilot service fee is 50% of the framework specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT but not lower than 2,000,000 VND for domestic vessels and 300 USD for international vessels.

- International passenger vessels with a gross tonnage of 50,000 GT or more, entering and leaving a maritime area, are subject to 40% of the framework specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT but not lower than 300 USD.

- Vessels required to move between berths within the port area as per instructions from the port enterprise's director are subject to the pilot service framework for intra-port movement as specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT.

- Vessels entering or leaving a maritime area for fuel, food, fresh water, crew changes, repairs, dismantling, or trial runs after repair or new construction without loading/unloading cargo or embarking/disembarking passengers are subject to 70% of the framework specified in Articles 8 and 9 of Circular 39/2023/TT-BGTVT.

Circular 39/2023/TT-BGTVT takes effect from February 15, 2024.
