From December 1, 2023: Shall the fee for reissuance and renewal of driver licenses be reduced in Vietnam?

On October 16, 2023, the Ministry of Finance issued Circular 63/2023/TT-BTC amending and supplementing certain Circulars on fees and charges to encourage the use of online public services.

In Article 8 of Circular 63/2023/TT-BTC, which amends and supplements Article 3 of Circular 37/2023/TT-BTC dated June 7, 2023, of the Minister of Finance on the collection rate, collection policies, payment, management and use of driver examination fees; fees for issuance of licenses and certificates for operating different types of vehicles, and registration fees for specialized motorcycles.

Fee Rates

1. The fee rates for driver examination; fees for issuance of licenses and certificates for operating different types of vehicles and registration fees for specialized motorcycles are stipulated in the fee rate schedule issued together with this Circular.

2. In case organizations or individuals submit applications for new issuance, reissuance, or renewal of driver licenses (national and international) online:

a) From December 1, 2023, to December 31, 2025, the applicable fee rate is 115,000 VND per issuance.

b) From January 1, 2026, onwards, the applicable fee rate will be as stipulated in the fee rate schedule issued together with this Circular.

Circular 37/2023/TT-BTC stipulates the fee for reissuance and renewal of driver licenses (national and international) is 135,000 VND per issuance effective from August 1, 2023.

However, in Article 8 of Circular 63/2023/TT-BTC, the online reissuance and renewal fee for driver licenses is only 115,000 VND per issuance effective from December 1, 2023, to December 31, 2025.

From January 1, 2026, onwards, the applicable fee rate will be as stipulated in the fee rate schedule issued together with Circular 37/2023/TT-BTC, which is 135,000 VND per issuance.

Thus, the reduction in the fee for reissuance and renewal of driver licenses when submitting online applications will be applied from December 1, 2023, to December 31, 2025.

According to Point c Clause 8 Article 37 of Circular 12/2017/TT-BGTVT amended by Point b Clause 6 Article 2 of Circular 01/2021/TT-BGTVT as follows:

8. Procedure for exchanging driver licenses:

a) The General Department of Vietnam Roads or the Department of Transport will check the application upon receipt; if the application is not in compliance with regulations, they must directly notify or notify in writing or through the online public service system the necessary amendments or supplements to the individual within 2 working days from the date of receipt of the application;

...

c) Within 5 working days from the date of receipt of a compliant application, the General Department of Vietnam Roads or the Department of Transport will process the exchange of the driver license; if the driver license is not exchanged, they must provide a response and clearly state the reason;

Thus, the duration for exchanging a driver license as stipulated is 5 working days from the date of receipt of a compliant application, during which the General Department of Vietnam Roads or the Department of Transport will process the exchange of the driver license; if the driver license is not exchanged, they must provide a response and clearly state the reason.

Which cases are not eligible for driver license exchange in Vietnam?

According to Clause 6 Article 37 of Circular 12/2017/TT-BGTVT supplemented by Point a Clause 20 Article 1 of Circular 38/2019/TT-BGTVT and repealed Point c by Clause 2 Article 3 of Circular 01/2021/TT-BGTVT as follows:

Exchanging driver licenses

...

6. driver licenses will not be exchanged in the following cases:

a) Temporary foreign driver licenses; international driver licenses; foreign, military, police driver licenses that are expired according to regulations, tampered with, torn, or not sufficient or different in identification factors to exchange; foreign driver licenses not issued by competent authorities;

b) driver licenses issued by the Transport sector but not in the driver license information system, the list of issued driver licenses (management book);

d) Individuals not meeting health standards as prescribed;

dd) Vietnamese individuals with foreign driver licenses having an overseas residence period of less than 3 months and a residence period not matching with the driver's training period of the country issuing the driver license;

The following categories are not eligible for driver license exchange:

- Temporary foreign driver licenses; international driver licenses; foreign, military, police driver licenses that are expired according to regulations, tampered with, torn, or not sufficient or different in identification factors to exchange; foreign driver licenses not issued by competent authorities;
