From August 1, 2024, what is the format of the application for renting of official housing in Vietnam? What are methods for evaluating rent of official housing in Vietnam?
According to Appendix III attached to Decree 95/2024/ND-CP dated July 24, 2024, of the Government of Vietnam, the format of the application form for renting of official housing in Vietnam is stipulated.

What are methods for evaluating rent of official housing in Vietnam?
According to Article 31 Decree 95/2024/ND-CP on methods for evaluating rent of official housing in Vietnam
(1) Rent for official residences includes management operation costs, maintenance costs, and housing management costs.
(2) For projects investing in the construction of official residences or purchasing entire commercial housing projects for official residences, the rent is determined as follows:
- Management operation costs include:
+ Wages and other expenses of the unit managing the official residence;
+ Costs for services in the official residence area according to regulations;
+ Electricity and water costs for the office operations of the management unit;
+ Public lighting electricity costs and other electricity consumption loads in the housing area, along with other associated costs;
+ The service fee for managing official residences follows the price framework issued by the provincial People's Committee applied in the locality of the official residence;
- Maintenance costs for official residences include: all costs for regular upkeep, periodic maintenance, emergency repairs, and replacement of accompanying equipment and furnishings;
These costs are determined by the investor or the official residence management agency According to the legal maintenance procedures for construction works in accordance with construction and housing laws;
- Housing management costs include: indirect management costs of the official residence management agency and direct management costs of the operational management unit, determined as a percentage (%) of total management and maintenance costs decided by the housing ownership representative agency.
(3) For purchasing some commercial apartments in a commercial housing project for official residences, the rent is determined as follows:
- Management operation costs follow the regulations on managing apartment operations;
- Maintenance costs for housing and management costs are determined according to points b and c, clause 2, Article 31 Decree 95/2024/ND-CP.
(4) The formula for determining the rent for official residences applies to cases of investment in constructing official residence projects, purchasing entire commercial housing projects, or buying some commercial apartments in commercial housing projects for official residences:

+ Gt is the rent for one square meter of apartment usage per month (VND/m2/month).
+ Q is the annual total management and renting costs of the official residence area (VND/year).
+ Bt is the average annual maintenance cost inside the apartment and accompanying internal equipment (VND/year).
+ Tdv are the revenues from business services within the official residence area according to regulations (VND/year).
+ S is the total usable area of the official residence apartments (m2).
+ T is the value-added tax rate as regulated by value-added tax laws.
Note:
- The revenue from renting official residences is used for maintaining the property and its furnishings and covering management and renting operation costs;
In cases where the rental revenue is insufficient for the full maintenance and operation costs, the state budget will cover the shortfall, with the central budget paying for residences managed by central agencies and the local budget paying for those managed by local agencies.
- According to the rent determination method specified in Article 31 Decree 95/2024/ND-CP, provincial People's Committees are responsible for issuing rent frameworks for official residences managed by the locality.
What are principles for evaluating rent of official housing in Vietnam?
According to Article 46 Housing Law 2023, principles for evaluating rent of official housing in Vietnam include:
- Accurately and fully calculate the necessary costs for management, maintenance, and renting operations during the usage of official residences.
- Exclude land levy costs for constructing official residences and not include depreciation costs of investment capital in construction or the purchase cost of commercial housing for official residences.
- The rent for official residences is determined by the competent authorities specified in Article 14 Housing Law 2023 and adjusted periodically.
- When leasing commercial housing for official residences, the rent paid by the official residence occupant is lower than the commercial housing rent.
