Based on Appendix III attached to Decree 95/2024/ND-CP dated July 24, 2024, of the Government of Vietnam, the form of the Decision to arrange lease of official housing in Vietnam is as follows:

What are rules for design, construction, warranty, maintenance, and management and operation of official housing in Vietnam?

Based on clause 1, Article 3 of Decision 11/2024/QD-TTg, the investment and construction of official housing must be in sync with infrastructure works, ensuring criteria for construction density, land use coefficient, and other criteria as per construction planning, standards, and regulations, including:

- Villas not exceeding 04 stories with a land area for construction from 300 m² to 500 m² (except for cases stipulated in clause 1, Article 4 of Decision 11/2024/QD-TTg), having a courtyard, garden, fence, separate entrance, security system according to regulations;

- Terraced houses not exceeding 04 stories with a land area for construction from 60 m² to 250 m², designed in the style of garden terraced houses or townhouses, built adjacent with shared infrastructure systems;

- Apartments with a usable area from 45 m² to 160 m², designed with enclosed living spaces, having one or more functional spaces such as: living room, bedrooms, dining room, kitchen, bathroom, balcony, or loggia;

- Single-story adjacent houses with a usable area from 24 m² to 60 m², built in a series of houses with each having independent utility works. Minimum usable area is 24 m² per house.

What Conditions Must Be Met to Rent official housing in Vietnam?

Based on Article 30 of Decree 95/2024/ND-CP, the conditions to be eligible for renting official housing in Vietnam include:

(1) For subjects specified at point a, clause 1, Article 45 of Housing Law 2023, they must be currently in office.

(2) For subjects specified at point b, clause 1, Article 45 of Housing Law 2023, they must meet the following conditions:

- Have a decision on transfer, rotation, attachment, and documents proving they are under the subjects of renting official housing;

- Not having their own house and not renting, buying, or purchasing a social house at the new workplace or having their own house at the new workplace but with an average dwelling area per household member under 20 m² floor/person.

(3) For subjects specified at point d, clause 1, Article 45 of Housing Law 2023, they must meet the following conditions:

- Have a decision on transfer, rotation, attachment, and documents proving they are officers, professional soldiers, non-commissioned officers, public security workers, officials, employees in national defense; cypher workers and other workers in cryptographic organizations receiving salaries from the state budget under the people's armed forces;

- Meet the housing conditions as stipulated at point b, clause 2, Article 30 of Decree 95/2024/ND-CP;- Not required to stay in the barracks of the armed forces as regulated by the Ministry of National Defense, Ministry of Public Security.

(4) For subjects specified at points c and dd, clause 1, Article 45 of Housing Law 2023, they must meet the following conditions:

- Have a decision on transfer, rotation, attachment, or assignment to work in areas specified at points c or dd, clause 1, Article 45 of Housing Law 2023;- Meet the housing difficulty conditions as stipulated at point b, clause 2, Article 30 of Decree 95/2024/ND-CP; if assigned to work in rural plain or midland areas, they must be outside the district and at least 30 km from their home to the workplace.

If assigned to work in remote, isolated areas with especially difficult socioeconomic conditions, border, and island areas, the provincial People's Committee shall specify the distance appropriately but must be at least 10 km from their home to the workplace.

(5) For subjects specified at point e, clause 1, Article 45 of Housing Law 2023, the following conditions must be met:

- Have a decision assigning them to lead national important scientific and technological tasks as regulated by science and technology laws;- Have a decision recognizing them as talents with significant contributions to the nation as per regulations;- Meet the housing difficulty conditions as stipulated at point, clause 2, Article 30 of Decree 95/2024/ND-CP.
