On February 21, 2023, the Government issued Decree 06/2023/ND-CP regulating the pre-employment tests for candidates for government officials.

Pursuant to the provisions of Article 4 of Decree 06/2023/ND-CP on organization of pre-employment tests for candidates for government officials as follows:

1. The Ministry of Home Affairs is the agency competent to organize pre-employment tests for candidates for government officials.
2. The pre-employment tests for candidates for government officials is held periodically twice in July and November every year.
3. Before January 31 of each year, the Ministry of Home Affairs shall announce the plan to organize the pre-employment tests for candidates for government officials on the website of the Ministry of Home Affairs and the information page on the pre-employment tests for candidates for government officials.
4. In case government official recruitment agencies wish to inspect the quality of government official input, they shall develop a plan and notify them according to the provisions of Article 7 of this Decree and receive the registration form for pre-employment tests for candidates for government officials on websites of agencies, organizations and units under their management; make a list of candidates and send them to the Ministry of Home Affairs for testing. No later than 30 days after receiving the list, the Ministry of Home Affairs shall organize the pre-employment tests.

Thus, the Ministry of Home Affairs is identified as the agency competent to organize the pre-employment tests for candidates for government officials.

Pursuant to Clause 1, Article 2 of Decree 06/2023/ND-CP stipulating as follows:

Principles of implementing pre-employment tests for candidates for government officials
1. The pre-employment tests for candidates for government officials is an activity of assessing and recognizing the necessary background knowledge for candidates before participating in the recruitment of government officials at a competent agency.

Thus, the use of the results of the pre-employment tests for candidates for government officials is specified in Article 10 of Decree 06/2023/ND-CP as follows:

Using test results
1. The results of the pre-employment tests for candidates for government officials are valid for use within 24 months from the date of issuance of the approval decision of the Ministry of Home Affairs. During the validity period of the verification results, the people who achieve the pre-employment tests results may register for the government official recruitment exam at the agencies and organizations specified in Clause 1, Article 1 of this Decree nationwide.
2. Heads of agencies or organizations competent to recruit government officials shall, based on the results of government official accreditation, stipulate the conditions for registration for government official recruitment and organize the 2nd round exam for those who pass the accreditation. under the provisions of Clause 2, Article 8 and Points a and c, Clause 3, Article 14 of the Government's Decree No. 138/2020/ND-CP dated November 27, 2020 on recruitment, employment and management of government officials (hereinafter referred to as Decree No. 138/2020/ND-CP).
3. The results of the assessment of the quality of the entrance exam for the candidates for the job positions that require a university degree or higher are allowed to be used instead of the results of the pre-employment tests for candidates for government officials for a job position with lower qualification requirements when applying for government official recruitment in accordance with recruitment requirements.
4. Cancel the test results.
a) Incorrect information in the registration form for pre-employment tests.
b) In case an agency, organization or unit competent to recruit public employees detects that the recruited person is using diplomas, certificates or certifications in contravention of regulations, it shall request a written request to the Ministry of Home Affairs to cancel the test results.
c) The list of cases in which the pre-employment tests results have been canceled shall be publicly announced on the website of the Ministry of Home Affairs, the information page on the pre-employment tests for candidates for government officials. Persons whose test results have been canceled are not allowed to register for the next pre-employment tests period.

Thus, according to the above regulations, candidates for government official recruitment must pass the results of the entrance examination before registering for the entrance exam at agencies and organizations nationwide.

What is the order of organization of pre-employment tests for candidates for government officials in Vietnam?

Pursuant to Article 9 of Decree 06/2023/ND-CP, the organization of pre-employment tests for candidates for government officials shall be carried out in the following order:

- The Accreditation Council announces the list and summons qualified candidates to participate in the pre-employment tests for candidates for government officials on the website of the Ministry of Home Affairs and the information page on the pre-employment tests for candidates for government officials.

Within 15 days from the date of notification of summoning candidates, the Accreditation Council shall conduct pre-employment tests.

- The organization of testing is done on the computer. The test results are notified to candidates immediately after the end of the testing period and no re-examination of the test results is performed.

- Within 05 working days from the end of the pre-employment tests period, the Accreditation Council shall report to the head of the agency competent to accredit the pre-employment tests for candidates for government officials to approve the pre-employment tests results;

The pre-employment tests results are publicly posted on the website of the Ministry of Home Affairs and the information page on the pre-employment tests for candidates for government officials.

Decree 06/2023/ND-CP takes effect from April 10, 2023.
