4. A fine ranging from VND 5,000,000 to VND 7,000,000 shall be imposed for finding out the location, effect, structure, and recording data related to national defense works or military zones not in accordance with their respective responsibilities. , duty or not authorized by the competent authority.

5. Additional sanction: Confiscation of material evidences and means of administrative violations, for the acts specified in Clauses 1, 2, 3 and 4 of this Article."

"21. To amend and supplement Clauses 3 and 4, Article 26 as follows:

3. A fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed for filming, taking photos, measuring or drawing prohibited areas of defense works or military zones without permission of competent authorities.

4. A fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed for collecting information about location, effect, structure, recording data related to national defense works or military zones. according to their respective responsibilities and duties or without permission of competent authorities”.

Thus, from July 22, 2022, the act of taking pictures and filming in the defense works of the military zone will be subject to a fine of up to 15 million VND, nearly 4 times higher than the previous regulations.

According to Article 25 of Decree No. 120/2013/ND-CP stipulating illegal travel, residence, production and business in prohibited areas, protected areas, safety belts of defense works, zones military as follows:

"Article 25. Violations against regulations on illegal travel, residence, production and business in prohibited areas, protected areas, safety belts of defense works or military zones

1. A warning will be imposed for inadvertently entering, leaving, or traveling in restricted areas, protected areas, or safety belts of defense works or military zones.

2. A fine of between VND 300,000 and 500,000 shall be imposed for intentionally leaving, entering, or traveling within protected areas, safety belts of defense works or military zones.

3. A fine ranging from VND 500,000 to VND 1,000,000 shall be imposed for intentionally leaving, entering, or traveling in restricted areas of defense works or military zones.

4. A fine ranging from VND 2,000,000 to VND 3,000,000 shall be imposed for illegally residing in prohibited areas, protected areas or safety belts of defense works.

5. A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for illegal production and business in prohibited areas, protected areas, safety belts of defense works or military zones.

6. Remedial measures: Forced dismantling of illegally built works or houses, restoring to their original condition and forcible relocation out of prohibited areas, protected areas, and safety belts of defense works and military zones, for the acts specified in Clauses 4 and 5 of this Article."

“Article 25. Violations against regulations on illegal travel, residence, production and business in prohibited areas, protected areas, safety belts of defense works, military zones

1. A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for intentionally entering or traveling within protected areas or safety belts of defense works or military zones without permission of competent authorities. authorization.

2. A fine ranging from VND 5,000,000 to VND 8,000,000 shall be imposed for intentionally entering or leaving restricted areas of defense works or military zones without permission of competent authorities.

3. A fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed for illegally residing in prohibited areas, protected areas or safety belts of defense works.

4. A fine ranging from VND 20,000,000 to VND 30,000,000 shall be imposed for illegal production and business in prohibited areas, protected areas or safety belts of defense works.

According to the provisions of Clause 22, Article 1 of Decree 37/2022/ND-CP amending Article 27 of Decree 120/2013 / ND-CP stipulating the scope of regulations on national defense, protection and military zones as follows:

"22. To amend and supplement Point c, Clause 1, Article 27 as follows:

“C) Damaging landmarks, fences, fences, signboards of the work area, the incident area;”.

In Article 27 of Decree 123/2013 / ND-CP stipulates:

"Article 27. Scope of definition of defense protection and military zones

1. Payment of money from 2,000,000 VND to 5,000,000 VND for one of the following activities:

a) Let the penetrating substance corrode and destroy the structure and equipment of the country of the work;

b) Set the image method to the structure, effect, safety, secrecy of company defense, military zone;

c) Damaging landmarks and signs in defense zones or military zones;

d) Cutting down trees of defense companies and military zones. "

Thus, from July 22, 2022, additional acts of damaging the fence of the construction area or military zone will be fined according to Clause 1, level 27, from 2,000,000 VND to 5,000,000 VND.

Decree 37/2022/ND-CP takes effect from July 22, 2022.
