What are locations prohibited to stop or park vehicles from January 1, 2025, according to the latest regulations in Vietnam?

Based on Clause 4, Article 18 of the Law on Traffic Order and Road Safety 2024, operators of road vehicles are prohibited from stopping or parking at the following locations:

- On the left side of one-way roads;

- On curved sections of roads or near the tops of hills where visibility is obscured;

- On bridges, except where traffic management allows;

- Under overpasses, except where stopping or parking is permitted;

- Parallel in the same direction with another vehicle already stopped or parked on the road;

- Less than 20 meters away from an opposite-direction parked vehicle on narrow streets, and less than 40 meters on roads with one motor vehicle lane per direction;

- At pedestrian crosswalks;

- At intersections and within 5 meters from the edge of the intersecting road;

- At passenger pick-up and drop-off points;

- In front of and within 5 meters on both sides of the gates of offices or organizations with designated entrances and exits for vehicles;

- Where the road width only allows for one lane of motor vehicles;

- Within railway safety zones;

- Obscuring road signs or traffic signals;

- On bus-only lanes, on drainage openings, telephone line or high-voltage cable openings, designated fire hydrant areas, or in contravention of the law on streets and sidewalks.

Additionally, vehicle operators must obey the following regulations when stopping or parking on the road:

- Signal to inform other road users when entering or leaving a stopping or parking position;

- Avoid impacting pedestrians and other road vehicles.

How to understand the terms of stopping and parking vehicles?

Based on Clauses 1 and 2, Article 18 of the Law on Traffic Order and Road Safety 2024, the concepts of stopping and parking vehicles are defined as follows:

- Stopping is the temporary state of a vehicle being stationary for the necessary time to allow passengers to board or disembark, load or unload goods, check the vehicle's technical condition, or perform other activities.When stopping, the engine should not be turned off and the driver should not leave the driving position, except to close or open the doors, load or unload goods, or perform vehicle checks while using the parking brake or other safety measures.

- Parking is the state of a vehicle being stationary without any time limit. When parking, the vehicle operator can leave the vehicle after using the parking brake or other safety measures.Vehicles parked on slopes must have their wheels turned towards the roadside and be chocked.

What must vehicle operators comply with when participating in road traffic in Vietnam?

Based on Article 56 of the Law on Traffic Order and Road Safety 2024, the conditions for vehicle operators participating in road traffic in Vietnam are regulated as follows:

(1) Vehicle drivers participating in road traffic must:

+ Meet the age and health requirements stipulated by law;+ Possess a valid driving license, in accordance with the type of vehicle being operated, issued by the competent authority, except for motorbike riders specified in (4).

When participating in road traffic, drivers must carry the following documents:

(i) Vehicle registration certificate or a certified copy accompanied by the original confirmation document from a credit institution, foreign bank branch still in effect if the vehicle is mortgaged at a credit institution, foreign bank branch;(ii) Driving license appropriate for the vehicle being operated;(iii) Certificate of technical safety and environmental protection for motor vehicles as stipulated by law;(iv) Compulsory civil liability insurance certificate for motor vehicles.

(2) Operators of specialized motor vehicles participating in road traffic must:

+ Meet the age and health requirements stipulated by law;+ Possess a certificate or operator license appropriate for the specialized motor vehicle being operated;+ Hold a valid driving license or a certificate training in road traffic law.

When participating in road traffic, specialized motor vehicle operators must carry the following documents:

(i) Vehicle registration certificate or a certified copy accompanied by the original confirmation document from a credit institution, foreign bank branch still in effect if the vehicle is mortgaged at a credit institution, foreign bank branch;(ii) Certificate or operator license for specialized motor vehicles;(iii) Driving license or certificate of training in road traffic law;(iv) Certificate of technical safety and environmental protection for specialized motor vehicles as stipulated by law;(v) Compulsory civil liability insurance certificate as stipulated by law.

(3) If the documents specified in (1) and (2) are integrated into an electronic identity account, the presentation and inspection may be carried out through the electronic identity account.

(4) Motorbike riders participating in road traffic must understand road traffic rules, possess skills in vehicle operation, and meet the age and health requirements specified in (1i) and Clause 2 of Article 59 of the Law on Traffic Order and Road Safety 2024.

(5) Learners driving cars, and those taking car driving tests must practice on designated driving training or testing routes, accompanied by a driving instructor or examiner.

Driving instructors and examiners must carry the documents specified in (1).

The Law on Traffic Order and Road Safety 2024 will take effect in Vietnam from January 1, 2025, while Clause 3, Article 10 of the Law on Traffic Order and Road Safety 2024 will be effective from January 1, 2026.
