How to change positions for civil servants working in the field of organization and personnel in Vietnam?
In Article 25 Law on Anti-Corruption 2018 regulations on position and time limit for change of working position are as follows:
"Article 25. Working position and time limit for periodic change
1. Persons with positions and powers working in a number of related positions related to the organization and personnel work, management of public finance, public assets, public investment, directly contact and handle the affairs of other agencies, organizations, units and individuals that must be changed positions. Working position
2. The period of periodical change of working position is from full 02 years to 05 years depending on the characteristics of each branch or field
3. For agencies, organizations and units, there is only one position. If a position has to periodically change jobs, but this position has special professional requirements compared to other positions of that agency, organization or unit, the change of working position shall be done by the head of the agency. Agencies, organizations and units employing persons with positions and powers shall request the competent agency to decide on the conversion
4. The Government shall detail the work positions subject to conversion and the periodical time limit for the transfer. change positions in ministries, ministerial-level agencies, government-attached agencies, and local governments.
The Chief Justice of the Supreme People's Court, the Chief Procurator of the Supreme People's Procuracy, the State Auditor General, the Chairman of the President's Office, the Chairman of the Office of the National Assembly, the central authority of a political organization, Socio-political organizations shall detail the working positions subject to change and the periodical time limit for changing working positions for persons with positions and powers under their management."
In Article 26 The Law on Anti-corruption 2018 stipulates on the plan to change the working position of civil servants:
"Article 26. Plan for changing working positions
1. Annually, the heads of agencies and organizationsto change working positions for people with positions and powers according to their management competence.

Pursuant to Article 37 Decree 59/2019/ND-CP guiding the Law on Anti-corruption stipulates the method of changing working positions as follows:
"Article 37. Methods of changing working positions
1 Transfer of working positions with the same expertise or profession from one department to another in the agency, organization or unit; between fields and areas assigned to monitor, be in charge of, or manage, or between agencies, organizations and units within the management scope of ministries, ministerial-level agencies, government-attached agencies and local governments
2. Change of working position shall be effected by written regulation. to act, arrange and assign tasks to persons with positions and powers as prescribed by law."

According to Article 2 Circular 3/2022/TT-BNV stipulating the list of periodically changing working positions for civil servants and public employees who directly contact and handle work in The field of organization and personnel in Vietnam as follows: :
"Article 2. List of working positions in the field of organization and personnel subject to periodic transformation
1. Personnel appraisal to submit to competent authorities for appointment, transfer, rotation, training and retraining maintenance of cadres, civil servants and public employees
2. Organize recruitment of civil servants and public employees; examination for promotion of civil servants and public employees; examination for promotion of public employee professional titles
3. Evaluation of dossiers for submission for granting approval. has the authority to approve the organizational apparatus and staffing
4. Appraisal of projects on new establishment and rearrangement of agencies, organizations, units and state-owned enterprises, non-governmental organizations, associations 5.

How long is the official position in Vietnam?
According to Article 3 Circular 3/2022/TT-BNV stipulating the time limit for periodically changing working positions for civil servants and public employees who directly contact and handle work in The field of organization and personnel in Vietnam as follows :
"Article 3. Periodic
time limit for changing working positions from full 03 years to 05 years."
Thus, civil servants and public employees who directly contact and deal with work in the field of cadre organization in the locality will periodically change their working positions for a term of three to five years.
Circular 3/2022/TT-BNV takes effect from June 1, 2022.
