Dossier and procedures for supplementing the status of relatives in the martyr's file
1. Individuals requesting to supplement relatives in the martyr's file must make a declaration according to Form No. 06 Appendix I of this Decree, sent to the People's Committee of the commune where they reside, accompanied by a certified copy of one of the documents proving the relationship with the martyr as follows:
a) For the request to supplement as biological parents, spouse of the martyr:
Citizen ID card, employee biography, party member biography, military personnel biography, marriage certificate.
Other documents and materials issued or confirmed by competent authorities.
Consent document from the martyr's relatives or from those stipulated in point b clause 1 Article 651 of the Civil Code. In case these people are no longer available, the consent must be obtained from those stipulated in point c clause 1 Article 651 of the Civil Code.
b) For the request to supplement as the child of the martyr: Birth certificate, notarized birth extract, decision recognizing child adoption according to the law; employee biography, party member biography, military personnel biography; other documents and materials issued or confirmed by competent authorities before July 1, 2021.
Simultaneously, based on the regulations in Subsection 25 Section 2 Administrative Procedures promulgated with Decision 108/QD-LDTBXH in 2022, the components of the dossier for supplementing the status of relatives in the martyr's file include:
- Application form according to Form No. 06 Appendix I attached to Decree 131/2021/ND-CP.
- A certified copy of one of the documents proving the relationship with the martyr as follows:

Step 1: The individual requesting to supplement relatives in the martyr's file makes a declaration according to Form No. 06 Appendix I attached to Decree 131/2021/ND-CP, sent to the People's Committee of the commune where they reside, accompanied by a certified copy of one of the documents proving the relationship with the martyr:
- For the request to supplement as biological parents, spouse of the martyr:

Step 2: The People's Committee of the commune, within 05 working days from the date of receiving all documents, is responsible for checking, verifying the declaration, and making a list accompanied by the documents specified in clause 1 Article 29 Decree 131/2021/ND-CP sent to the Department of Labor, Invalids and Social Affairs.
Step 3: The Department of Labor, Invalids and Social Affairs, within 07 working days from the date of receiving all documents, is responsible for checking, making a list accompanied by the documents specified in clause 2 Article 29 Decree 131/2021/ND-CP, sent to the Department of Labor, Invalids and Social Affairs.
Step 4: The Department of Labor, Invalids and Social Affairs, within 12 days, is responsible for checking, issuing the decision to supplement the status of the martyr's relatives and preferential benefits according to Form No. 56 Appendix I attached to Decree 131/2021/ND-CP and supplementing information in the martyr's file.

Pursuant to the provisions in Subsection 25 Section 2 Administrative Procedures promulgated with Decision 108/QD-LDTBXH in 2022, the resolution period for supplementing the status of relatives in the martyr's file is 24 days from the date of receiving all required documents as prescribed.
