Who is eligible for the seniority allowance for teachers?
Based on Article 2 of Decree 77/2021/ND-CP, the seniority allowance for teachers is applicable to teachers who are teaching and educating at public educational institutions and academies, schools, and centers tasked with training and fostering under state agencies, political organizations, and socio-political organizations that have been categorized and ranked according to Decree 204/2004/ND-CP. Specifically, this includes:
- Teachers include public employees in the education and training sector (with initial character codes V.07) and public employees in the vocational education sector (with initial character codes V.09) who are on the payroll list approved by the competent authority, currently teaching and educating at public educational institutions funded by the state (including revenues from the state budget and career revenues as prescribed by law).
- Teachers on the payroll list approved by the competent authority, currently teaching, guiding practice, and conducting experiments on training ships, school workshops, stations, farms, practice centers, laboratories, and subject rooms of public general education institutions, continuous education institutions, vocational education institutions, and public higher education institutions.
- Subjects not belonging to the above two groups but holding codes with initial characters V.07 and V.09 are not eligible for the seniority allowance for teachers.
Thus, when meeting the conditions regarding these subjects, teachers can be eligible for the seniority allowance for teachers.

How much will the seniority allowance for teachers increase in 2023?
Based on Article 4 of Decree 77/2021/ND-CP as follows:
Seniority allowance level
1. Teachers participating in teaching and education who have paid compulsory social insurance for at least 5 years (60 months) are eligible for a seniority allowance of 5% of their current salary level plus the leadership position allowance and overtime seniority allowance (if any). From the sixth year onward, each year (12 months) is calculated with an additional 1%.
2. The seniority allowance is calculated and paid along with the monthly salary and is used to calculate contributions and enjoy social insurance, health insurance, and unemployment insurance.
3. The method of calculating the monthly seniority allowance amount:
The amount of seniority allowance = The current salary coefficient according to the professional title of public employee plus the percentage coefficient of the leadership position allowance, overtime seniority allowance (if any) x The statutory pay rate regulated by the Government of Vietnam from time to time x The percentage seniority allowance rate.
Teachers participating in teaching and having paid compulsory social insurance for at least 5 years will be eligible for a seniority allowance of 5% of their current salary plus the position allowance, and overtime seniority allowance.
And from the sixth year onward, each year (12 months) is calculated with an additional 1%.
The method for calculating the seniority allowance amount is based on the current salary coefficient according to the professional title of public employee plus the percentage coefficient of the leadership position allowance and overtime seniority allowance (if any); the statutory pay rate and the seniority allowance percentage.
The seniority allowance amount for teachers is calculated based on the statutory pay rate. According to Clause 1, Article 3 of Resolution 69/2022/QH15, the National Assembly has stipulated that the statutory pay rate will increase to 1.8 million VND/month from July 1, 2023 (an increase of 20.8% compared to the current statutory pay rate).
Therefore, from July 1, 2023, the seniority allowance amount for teachers will also increase by 20.8%.
When does the period for calculating the seniority allowance for teachers start?
Based on Article 3 of Decree 77/2021/ND-CP as follows:
The period for calculating and not calculating the seniority allowance
1. The period for calculating the seniority allowance
The period for calculating the seniority allowance is determined by the total of the following periods:
a) The period of teaching and educating with compulsory social insurance contributions in public educational institutions.
b) The period of teaching and educating with compulsory social insurance contributions in non-public educational institutions (for teachers currently teaching and educating in public educational institutions who previously taught and educated in non-public educational institutions).
c) The period of working that is calculated for the seniority allowance, including: the period of working ranked according to one of the customs, court, inspection, audit, law enforcement titles; the period of working calculated for seniority allowance in the military, public security, cipher, and the period of working calculated for seniority in other professions (if any).
d) The period of mandatory military service under the law before joining the mandatory military service, calculated for professional seniority allowance.
2. The period not calculated for the seniority allowance
a) The period of probation.
b) The period of unpaid leave continuously from 01 month or more.
c) The period of sickness, maternity leave exceeding the prescribed time under social insurance laws.
d) The period of working as an expert, studying, practicing, working, surveying domestically and abroad exceeding the duration decided by the competent authority.
DD) The period of suspension from work or detention for investigation, prosecution, and trial purposes.
e) The period not working other than the provisions in points a, b, c, d, and DD of Clause 2 of this Article.
Thus, the period for calculating the seniority allowance for teachers is not specifically defined. It is calculated based on the total of the following periods:
