Which entities are recognized and awarded titles and prizes for entrepreneurs, enterprises, and economic organizations?

Pursuant to Article 60 of Decree 98/2023/ND-CP, the entities eligible for recognition and awarding of titles and prizes are specified as follows:

Entities Eligible for Recognition and Awarding of Titles and Prizes

1. The competent authorities to organize the recognition and awarding of titles and prizes for entrepreneurs, enterprises, and other economic organizations include:

a) Ministries, ministerial-level agencies, agencies under the Government of Vietnam; central agencies of political-social organizations, the Vietnam Chamber of Commerce and Industry (hereinafter referred to as ministries and central authorities, central associations);

b) The people's committees of provinces and centrally-run cities (hereinafter referred to as provincial people's committees).

2. Entities eligible for recognition and awarding of titles and prizes:

a) Entrepreneurs who are Vietnamese nationals or foreigners engaged in production or business activities within the territory of Vietnam in accordance with the law;

b) Enterprises of various economic sectors and other economic organizations.

Thus, there are 02 entities eligible for recognition and awarding of titles and prizes for entrepreneurs, enterprises, and other economic organizations including:

- Entrepreneurs who are Vietnamese nationals or foreigners engaged in production or business activities within the territory of Vietnam in accordance with the law;

- Enterprises of various economic sectors and other economic organizations.

What are the conditions for enterprises and other economic organizations to participate in the recognition and awarding of titles and prizes?

Pursuant to the provisions of Article 67 of Decree 98/2023/ND-CP, the conditions for enterprises and other economic organizations to participate in the recognition and awarding of titles and prizes include:

- Complying with the conditions according to the registered industry or profession or the granted investment license, regulations of the law on enterprises, investment, labor, land, construction, environmental protection, intellectual property, product quality, and other legal regulations related to production and business activities.

- Business activities bringing about profitability, stable tax contribution to the state budget, and growth.

- Having initiatives, technical improvements, new scientific technologies applied to production and business effectively; having many innovations and creativity in production and business activities, creating values positively contributing to the overall development of society and the country.

- Fully complying with financial, tax obligations, and other contributions to the state budget as prescribed by law.

- Ensuring stable employment and increasing income for employees; fully and promptly implementing social insurance benefits, health insurance, unemployment insurance, and policies and laws related to employees.

- Effectively performing social security work, actively and effectively participating in emulation movements launched by ministries, central authorities, and local authorities; actively developing Communist Party organizations, trade unions, and mass organizations (if any) within the enterprise and other economic organizations.

- Not being involved in complaints, denunciations, lawsuits, strikes, or collective work stoppages.

What conditions must entrepreneurs meet to participate in the recognition and awarding of titles and prizes?

Pursuant to the provisions of Article 66 of Decree 98/2023/ND-CP, entrepreneurs participating in the recognition and awarding of titles and prizes for entrepreneurs must meet the following conditions:

- Possessing good ethical qualities, strictly adhering to the Party's policies, the State's laws, and the internal regulations of their agencies, organizations, and places of residence.

- Holding a stable and continuously developing managerial position in an enterprise or other economic organization for 07 years or more when participating in the titles and prizes of ministries and central authorities, central associations, and socio-professional organizations, and from 05 years or more when participating in the recognition and awarding of titles and prizes of provinces and centrally-run cities (calculated up to the time of submitting the nomination dossier).

In cases where entrepreneurs operate multiple enterprises or change jobs, the time managing different enterprises and economic organizations can be accumulated to meet the conditions for the titles and prizes.

- Actively engaging in self-improvement to enhance managerial capabilities and enterprise management skills.

- Having initiatives, management improvements, or the application of new technologies that contribute to increasing productivity, product quality, and competitive capacity of enterprises and other economic organizations.

- Focusing on training and improving the skills of workers, enhancing the human resource quality of enterprises and other economic organizations. Effectively, fully implementing policies for employees as prescribed by law.

- Actively participating in emulation movements, contributing, supporting, and effectively implementing the social responsibilities of enterprises, entrepreneurs, and other economic organizations in the locality; fostering the development of Communist Party organizations, trade unions, and mass organizations (if any) within enterprises and other economic organizations.

- Enterprises and other economic organizations managed by entrepreneurs must comply with legal regulations; ensure revenue, profit, contribution to the state budget, stable and growing employee income; and must not be involved in complaints, denunciations, lawsuits, strikes, or collective work stoppages.
