How many days off are there for the Lunar New Year 2024?

Based on Notice 5015/TB-LDTBXH in 2023, officials, public employees, and workers of administrative agencies, public service units, political organizations, and socio-political organizations (hereinafter referred to as officials and public employees) will have time off for the Lunar New Year 2024 from:

Thursday, February 8, 2024 (Gregorian calendar) (i.e., the 29th day of the 12th month of the Year of the Cat) to the end of Wednesday, February 14, 2024 (Gregorian calendar) (i.e., the 5th day of the 1st month of the Year of the Dragon).

Workers will have time off for the Lunar New Year 2024 based on 3 options determined by their employers as follows:

(1) Choose 1 day at the end of the Year of the Cat and 4 days at the beginning of the Year of the Dragon.(2) Choose 2 days at the end of the Year of the Cat and 3 days at the beginning of the Year of the Dragon.(3) Choose 3 days at the end of the Year of the Cat and 2 days at the beginning of the Year of the Dragon.

For students, time off for the Lunar New Year 2024 will follow the regulations of each locality and school.

Refer to some Lunar New Year 2024 holiday schedules for students in some localities at the Official Portal of the Government of Vietnam as follows:

Students in Ho Chi Minh City will have time off for the Lunar New Year 2024 from February 5, 2024 (the 26th day of the 12th month of the Lunar calendar) to February 18, 2024 (the 9th day of the 1st month of the Lunar calendar).

Students in Hanoi will have time off for the Lunar New Year 2024 from Thursday, February 8, 2024, to Wednesday, February 14, 2024 (i.e., from the 29th day of the 12th month of the Year of the Cat to the end of the 5th day of the 1st month of the Year of the Dragon).

In Ha Tinh, for students, time off for the Lunar New Year 2024 starts from February 6, 2024 (the 27th day of the 12th month of the Year of the Cat) to February 18, 2024 (the 9th day of the 1st month of the Year of the Dragon).

In Dong Thap, preschools, general education institutions, and continuing education schools will have time off for the Lunar New Year from February 8, 2024 (the 29th day of the 12th month of the Year of the Cat) to February 14, 2024 (the 5th day of the 1st month of the Year of the Dragon).

In Lao Cai: Time off for the Lunar New Year spans from February 3, 2024, to February 18, 2024.

Thus, depending on each subject group, the Lunar New Year 2024 holiday period will vary:

Officials and public employees will have 7 days off from Thursday, February 8, 2024 (Gregorian calendar) (i.e., the 29th day of the 12th month of the Year of the Cat) to the end of Wednesday, February 14, 2024 (Gregorian calendar) (i.e., the 5th day of the 1st month of the Year of the Dragon).

Workers will have 5 days off as prescribed by the Labor Code with 3 options for employers to choose from as per Notice 5015/TB-LDTBXH in 2023.

Students will have time off for the Lunar New Year 2024 based on decisions made by local governments and schools.

How are workers paid if they work during the Tet holiday?

Based on the provisions of Article 98 of the Labor Code 2019, regulations on overtime pay and night work pay are as follows:

Overtime pay, night work pay

1. Workers who work overtime are paid wages calculated based on their wage unit price or the actual wages paid for the work being done as follows:

a) On regular days, at least 150%;

b) On weekly rest days, at least 200%;

c) On holidays, Tet holidays, paid leaves, at least 300%, not including the day's wages for holidays, Tet holidays, or paid leaves for workers paid on a daily basis.

2. Workers who work at night are paid an additional amount of at least 30% of the wage unit price or the daily wage of a regular working day.

3. Workers who work overtime at night are paid, in addition to the wages specified in Clauses 1 and 2 of this Article, an additional 20% of the wage unit price or the daily wage of a regular working day or a weekly rest day or a holiday or Tet holiday.

4. the Government of Vietnam provides detailed regulations for this Article.

In case workers work on Tet holidays, they are entitled to at least 300% of their usual wages, excluding the daily wages for Tet holidays for workers paid on a daily basis.

Additionally, if workers work at night, they will receive at least 30% of the wages for a regular working day and 20% of the wages for a Tet holiday.

Thus, working on the Lunar New Year 2024 will be calculated as follows:

- Working during the daytime: Receive at least 400% of wages.- Working during the nighttime: Receive at least 490% of wages.
