Do freelancers have to participate in social insurance in Vietnam?
Article 2 of the 2014 Social Insurance Law stipulates the subjects of social insurance contributions as follows:
Applicable Subjects
1. Employees who are Vietnamese citizens and subject to compulsory social insurance participation, including:
a) Employees working under indefinite-term labor contracts, fixed-term labor contracts, seasonal labor contracts, or specific work contracts with a term of between 3 months and less than 12 months, including labor contracts signed between the employer and the legal representative of a person under 15 years old as prescribed by the labor law;
b) Employees working under labor contracts with a term of between 1 month and less than 3 months;
c) Officials and public employees;
d) Defense workers, police workers, and other personnel engaged in cryptographic activities;
dd) Officers, professional soldiers of the people's army; officers, non-commissioned officers specialized in technical services, officers, non-commissioned officers specialized in technical services of the people's police; persons engaged in cryptographic activities who are salaried as soldiers;
e) Non-commissioned officers, soldiers of the people's army; non-commissioned officers, soldiers of the people's police serving with a fixed term; military, police, and cryptographic cadets who are entitled to living expenses;
g) Persons working abroad under contracts as stipulated in the Law on Vietnamese Labor Going to Work Abroad under Contracts;
h) Managers of enterprises, managers of cooperatives who are salaried;
i) Persons engaged in part-time activities at commune, ward, commune-level town.
2. Employees who are foreign citizens working in Vietnam with a work permit or practicing certificate or practicing permit issued by the competent authority of Vietnam are eligible to participate in compulsory social insurance as prescribed by the Government of Vietnam.
3. Employers participating in compulsory social insurance include state agencies, public service providers, people's armed units; political organizations, socio-political organizations, socio-professional political organizations, professional social organizations, other social organizations; foreign agencies, foreign organizations, international organizations operating on the territory of Vietnam; enterprises, cooperatives, household businesses, collaborative groups, other organizations, and individuals employing labor under labor contracts.
4. Voluntary social insurance participants are Vietnamese citizens aged 15 and older and not subject to the provisions of Clause 1 of this Article.
5. Agencies, organizations, individuals related to social insurance.
The subjects specified in Clauses 1, 2, and 4 of this Article are collectively referred to as employees.
According to the above regulations, there are currently two types of social insurance contributions:
- Compulsory social insurance: for the subjects under Clause 1, Article 2 of the 2014 Social Insurance Law.
- Voluntary social insurance: for the subjects under Clause 4, Article 2 of the 2014 Social Insurance Law.
Freelancers are those who work independently without being bound by a contract, so they are not subject to compulsory social insurance. However, freelancers can register for voluntary social insurance.

How do freelancers contribute to voluntary social insurance in Vietnam?
Clause 2, Article 87 of the 2014 Social Insurance Law stipulates as follows:
Contribution Rate and Method of Voluntary Social Insurance Participants
1. Employees specified in Clause 4, Article 2 of this Law shall contribute monthly at a rate of 22% of their chosen monthly income to the retirement and survivorship fund. The monthly income used as the basis for contributions must not be lower than the rural poverty threshold and not exceed 20 times the statutory pay rate.

2. Employees can choose one of the following contribution methods:
a) Monthly;
b) Once every 3 months;
c) Once every 6 months;
d) Once every 12 months;
dd) Once for many subsequent years with a lower monthly rate or once for the remaining period with a higher monthly rate than specified in this Article.
3. The Government of Vietnam shall detail the implementation of this Article.
According to the above regulation, freelancers can contribute to voluntary social insurance using one of the following methods:
- Monthly.
- Once every 3 months.
- Once every 6 months.
- Once every 12 months.
- Once for many subsequent years with a lower monthly rate or once for the remaining period with a higher monthly rate than specified in Article 87 of the 2014 Social Insurance Law.
