Conditions and procedures for organizing beauty contests and model contests specified under Clause 2 Article 14
1. Conditions for organizing contests:
a) Be public service providers specialized in delivering art performances; associations specialized in performance arts; organizations and individuals applying for delivering art performances as per the law;
b) Satisfy requirements regarding security, social order and safety, environment, medical and fire prevention as per the law;
c) Obtain written permission for organizing beauty contests and model contests of competent authorities.

What are the procedures for issuing written permission to organize beauty contests in Vietnam?

Pursuant to Article 16 of Decree No. 144/2020/ND-CP stipulating the procedures for issuing written permission to organize beauty contests as follows:

(1) Organizations and individuals eligible to organize a beauty contest send 01 set of documents, including:

- Written application for organizing contests;

- Schemes for organizing contests.

shall submit application in person, via postal service or online to competent authorities at least 30 working days before the date on which contests are expected to take place;

(2) If applications are inadequate, competent authorities shall request the applicants in writing to revise the applications within 3 working days after receiving the applications;

(3) In case applications are adequate as per the law, competent authorities shall appraise, issue written permission and upload on website within 15 working days.

In case of rejection, provide written response and explanation;

(4) In case of any change to contents of contests which have been approved, applicants for organizing contests shall issue written explanation and submit in person, via postal service or online to application receivers.

Within 5 working days from the date on which adequate applications are received, application receivers must consider, decide and inform the applicants in writing;

(5) In case of change to time and/or location of approved contests, applicants for organizing contests shall inform approving agencies and local governments where the contests take place in person, via postal service or online at least 5 working days before the date on which the contests are expected to take place.

What is the penalty for holding beauty contests in contravention of written permission?

Pursuant to the provisions of Article 12 of Decree No. 38/2021/ND-CP stipulating as follows:

Violations against regulations on beauty contests or model contests
1. Imposing the fine ranging from 5,000,000 dong to 10,000,000 dong for one of the following violations:
a) Making untruthful declarations in the application for the written consent to hosting beauty contests or model contests;
b) Making untruthful declarations in the application for the written confirmation of participation in overseas beauty contests or model contests;
c) Failing to comply with notices sent to competent state authorities according to regulations on beauty and model contests under the internal management of agencies or organizations.
2. Imposing the fine ranging from 10,000,000 dong to 15,000,000 dong for one of the following violations:
a) Holding beauty or model contests in contravention of written permission;
b) Failing to notify competent state authorities according to regulations on beauty and model contests under the internal management of agencies or organizations.
3. Imposing the fine ranging from 15,000,000 dong to 20,000,000 dong for one of the following violations:
a) Failing to withdraw or revoke titles that individuals win in beauty or model contests when such revocation or withdrawal is required in writing by competent state authorities;
b) Failing to publicly announce the withdrawal or revocation of titles, prizes of beauty or model contests through mass media according to regulations;
c) Using titles, awards of beauty or model contests after they are revoked or decisions to cancel the results of contests or festivals are issued;
d) Using titles that individuals win in overseas beauty or model contests without receiving any consent from competent state authorities.
4. Imposing the fine ranging from 20,000,000 dong to 25,000,000 dong for the act of participating in overseas beauty or model contests without any consent from competent regulatory authorities.

According to the above regulations, holding beauty contests in contravention of written permission may be subject to an administrative fine of from VND 10,000,000 to VND 15,000,000.

Note: The above administrative fine is imposed upon individuals, the fine imposed upon organizations shall be doubled (based on the provisions of Article 5 of Decree No. 38/2021/ND-CP as amended by Clause 2, Article 1 of Decree No. 128/2022/ND-CP).
