Pursuant to Article 4 of Decree 131/2021/ND-CP as follows:
Conditions and criteria for recognition of revolutionary activists before January 1, 1945
A revolutionary activist before January 1, 1945 specified in Clause 1, Article 8 of the Ordinance is a person recognized by competent agencies and organizations when one of the following conditions and standards is met:
1. Having joined a revolutionary organization or having actually engaged in revolutionary activity under the leadership of the Party before January 1, 1945.
2. To be admitted or readmitted to the Communist Party of Indochina before August 19, 1945.
The recognition of revolutionary activists before January 1, 1945 shall comply with the provisions of Directive No. 27-CT/TW dated December 24, 1977 of the Party Central Committee Secretariat (iv course) "On policies and regimes for cadres and long-term party members", Circular No. 07-TT/TC dated March 21, 1979 of the Central Organizing Committee "Guidance on the application of standards and confirmation of beneficiaries of policies and regimes for cadres of revolutionary activities before August 19, 1945".
Thus, a revolutionary activist shall be recognized by a competent authority as a revolutionary activist before January 1, 1945 when one of the following conditions and criteria is met:
- Joined a revolutionary organization before January 1, 1945;
- Admitted or readmitted to the Communist Party of Indochina before 19 August 1945.

According to the provisions of Article 5 of Decree 131/2021/ND-CP on this content as follows:
Grounds for making documents
1. A person who is still alive or who has died after June 30, 1999 shall base on a certified copy from one of the following documents recording the time of participation in revolutionary activities:
a) Resumes of party cadres and members declared from 1962 onwards shall be managed by competent agencies and organizations.
b) Background statements in the Campaign to Protect the Party according to Directive No. 90-CT/TW dated March 1, 1965 of the Secretariat of the Central Committee of the Party (session III).
c) Party membership records declared in 1975 and 1976 according to Circular No. 297/TT-TW dated April 20, 1974 of the Party Central Secretariat (course III) for revolutionary activists admitted to the Party after 1969 or persons active continuously in battlefield B, C, K from 1954 to April 30, 1975.
2. A person who has died on June 30, 1999 or earlier shall base one of the following documents on the time of participation in revolutionary activities:
a) A certified copy from the background as prescribed in Clause 1 of this Article, from the commendation dossier of the Gold Star Medal, the Ho Chi Minh Medal, the Independence Medal or from the records and documents kept at the archives of the Party, the State, historical museums from the district level or higher.
b) An extract of the martyr's dossier.
c) Party histories from commune level and above shall be appraised, approved and licensed for publication by competent agencies.
So:
(1) A living or deceased person who dies after June 30, 1999 shall, based on a certified copy of one of the following documents documenting the time of participation in revolutionary activities:
- Resumes of party cadres and members declared from 1962 onwards shall be managed by competent agencies and organizations.
- Background in the Campaign to Protect the Party under Directive No. 90-CT/TW dated March 1, 1965 of the Party Central Committee Secretariat (iii session).
- Party membership records declared in 1975 and 1976 according to Circular No. 297/TT-TW dated April 20, 1974 of the Party Central Committee Secretariat (session III) for revolutionary activists admitted to the Party after 1969 or persons active continuously in battlefields B, C, K from 1954 to April 30, 1975.
(2) A person who has died on June 30, 1999 or earlier, based on one of the following documents documenting the time of participation in revolutionary activities:
- Certified copies from the background as prescribed in Clause 1 of this Article, from the commendation records of the Gold Star Medal, the Ho Chi Minh Medal, the Order of Independence or from records and documents kept at the archives of the Party, the State, historical museums from district level or higher.
- An extract of the martyr's record.
- Party histories from commune level and above are appraised, approved and licensed for publication by competent agencies.
How are the records and procedures for recognition and settlement of preferential treatment of revolutionary activists before January 1, 1945 in Vietnam?
Pursuant to Article 7 of Decree 131/2021/ND-CP stipulating dossiers, procedures for recognition and settlement of preferential regimes as follows:
- Individuals shall write an affidavit according to Form No. 01, Appendix I of this Decree to the People's Committee of the commune where they reside together with one of the documents specified in Article 5 of this Decree.
- Commune-level People's Committees shall, within 05 working days from the date of receipt of sufficient documents as prescribed in Clause 1 of this Article, certify the affidavit and send all documents to competent agencies specified in Article 6 of this Decree.
- Competent agencies shall, within 20 days from the date of receipt of sufficient documents, consider and issue a recognition decision according to Form No. 49 of Appendix I of this Decree and transfer the dossier to the Department of Labor, War Invalids and Social Affairs where the beneficiary resides permanently to settle the preferential regime.
- The Department of Labor, War Invalids and Social Affairs shall, within 12 days from the date of receipt of sufficient dossiers as prescribed, issue a decision on the issuance of certificates of revolutionary activists before January 1, 1945 and preferential allowances and allowances according to Form No. 50 of Appendix I of this Decree;
At the same time, the issuance of certificates according to Form No. 102 of Appendix I of this Decree.
- The Ministry of National Defense of Vietnam and the Ministry of Public Security of Vietnam shall guide the process of recognizing revolutionary activists before January 1, 1945 belonging to the army and police.
