What are the operating conditions for establishments of publication release in Vietnam?
Pursuant to Clause 3, Article 36 of the 2012 Publishing Law in Vietnam and Clause 4, Article 36 of the 2012 Publishing Law in Vietnam stipulating the operating conditions for establishments of publication release as follows:
Operating conditions for releasing establishments which are enterprises, public service providers:
- The head of releasing establishment must reside in Vietnam, having diploma or certificate of professional knowledge on the publication release issued by the establishment of training and fostering of specialized publication release;
- Having one of the following certificates: business registration certificate, business registration certificate or decision on establishment of public non-business unit in accordance with the law;
- Having business location of publication;
Operating conditions for releasing establishment as business household:
- Householder must permanently reside in Vietnam;
- Having business registration certificate;
- Having business location of publications.

Where can I register for publication releasing operation in Vietnam?
Pursuant to Clause 1, Article 37 of the 2012 Publishing Law in Vietnam stipulating:
Registration of publication releasing operation
1. Before operation, the releasing establishment as enterprise, public non-business unit must register the publication releasing operation with the State management agencies on the publishing activities in accordance with the following provisions:
a) The releasing establishment has its headquarters and branches in two centrally-affiliated provinces and cities or more and register operation with the Ministry of Information and Communications;
b) The releasing establishment has its headquarters and branches in the same one centrally-affiliated province and city and register operation with the provincial-level People’s Committee.
2. The Minister of Information and Communications shall regulate procedures and dossier for registration of publication releasing operation.
Thus, before operation, the releasing establishment as enterprise, public non-business unit must register the publication releasing operation with the State management agencies on the publishing activities in accordance with the following provisions:
- The releasing establishment has its headquarters and branches in two centrally-affiliated provinces and cities or more and register operation with the Ministry of Information and Communications;
- The releasing establishment has its headquarters and branches in the same one centrally-affiliated province and city and register operation with the provincial-level People’s Committee.
What are the procedures for registration of publication releasing operation in Vietnam?
Pursuant to Article 17 of Circular No. 01/2020/TT-BTTTT stipulating the procedures for registration of publication releasing operation as follows:
- 15 days before operating, a publication-issuing establishment being an enterprise or public service provider (hereinafter referred to as publishing establishment) must register the publication of publication on a case-by-case basis specified at point a, clause 1, Article 37 of the 2012 Publishing Law in Vietnam and point b, Clause 1, Article 37 of the 2012 Publishing Law in Vietnam.
- Dossiers for registration of publication distribution shall be submitted directly or by post to the Department of Publication, Printing and Distribution or the Department.
In case of submitting the application via the Internet, the issuer must have a digital certificate issued by the digital signature certification service provider and follow the instructions on the portal of the Department of Publication, Printing and Releasing, Department of online public service provision.
- The application is made into one (01) set, including:
+ An application for registration of publication distribution activities;
+ A copy (presented together with the original for comparison) or a certified true copy of the head office ownership papers or the contract to rent or borrow the head office for use as a business location;
+ A copy (presented together with the original for comparison) or a certified copy of the household registration certificate or a document proving that the head of the establishment is permitted to permanently reside in Vietnam, issued by a competent Vietnamese authority. Male level;
+ A copy (presented together with the original for comparison) or a certified true copy of the diploma or certificate of training in knowledge and skills on publication distribution of the head of the publishing establishment, trained by the publishing establishment, specialized training in publishing publications.
- Within 07 working days from the date of receipt of complete dossiers, the Department of Publication, Printing and Distribution or the Department must certify in writing the registration of publication distribution activities; in case the registration is not confirmed, a written reply clearly stating the reason.
The certificate of registration of publication distribution is no longer valid in case the publishing establishment is merged, divided, dissolved or bankrupt.
