Conditions for Granting Operational Licenses to Internal Medicine Clinics as Regulated
Is a specialized internal medicine clinic a form of medical examination and treatment facility?
Based on point a, clause 4, Article 22 of Decree 109/2016/ND-CP, as amended by clause 3, Article 11 of Decree 155/2018/ND-CP, the following is stipulated:

Medical examination and treatment facilities are established according to legal provisions and must follow one of the following organizational forms:

4. Specialized clinics, including:
a) General internal medicine clinics
An internal medicine clinic is a form of medical examination and treatment facility. Therefore, the conditions for obtaining an operational license for an internal medicine clinic will be generally stipulated for all medical examination and treatment facilities.

What are the general conditions for obtaining an operational license for medical examination and treatment facilities?
Based on Article 23a of Decree 109/2016/ND-CP (as supplemented by clause 4, Article 11 of Decree 155/2018/ND-CP), the following general conditions for obtaining an operational license for medical examination and treatment facilities are stipulated:
Infrastructure:
- There must be a fixed location (except for mobile medical examination and treatment organizations);- Ensure safety conditions for radiation, fire prevention, and fighting as per legal regulations;- Space for sterilizing medical instruments must be arranged, except in cases where there are no instruments to be sterilized again or there is a contract with another medical facility for sterilizing instruments.
Medical equipment:
- Sufficient medical equipment suitable for the scope of professional activities of the facility;- For occupational disease treatment facilities, at least a biochemical laboratory is required;- Health consultation rooms or health consultation rooms through information technology and telecommunications are not required to have medical equipment as stipulated above but must have sufficient information technology and telecommunications equipment suitable for the registered scope of operation.
Health examination facilities must meet the following conditions:
- Be a medical examination and treatment facility that has been granted an operational license as per legal regulations;- Must have sufficient clinical and paraclinical examination departments, personnel, and necessary medical equipment to examine and detect health conditions according to health standards and health examination form issued along with health examination guidance documents as per legal regulations.
What are the conditions for obtaining an operational license for a specialized internal medicine clinic?
Based on Article 26 of Decree 109/2016/ND-CP (as amended by clause 8, Article 11 of Decree 155/2018/ND-CP), the following is stipulated:
Conditions for obtaining an operational license for specialized clinics
Besides meeting the conditions stipulated in Article 23a of this Decree, with the exception of the conditions for the technical professional person in charge, specialized clinics must meet additional conditions as follows:
1. Infrastructure:
a) In cases of performing procedures, including dental implant techniques, acupuncture, massage, and acupressure, a separate room or area dedicated to these procedures must be available. The room or area must have sufficient space to perform specialized techniques;
b) In cases where the specialized clinic performs both upper gastrointestinal endoscopy and lower gastrointestinal endoscopy techniques, there must be two separate rooms;
c) In cases of occupational disease treatment, a biochemical laboratory is required.
2. Medical equipment: A shock prevention kit and sufficient specialized emergency medicines must be available.
3. Personnel:
a) The person in charge of the technical professional aspects of the specialized clinic must meet the following conditions:
- Be a doctor with a professional practice certificate suitable for the specialized field registered by the clinic.
- Have at least 54 months of experience in the specialized field of medical examination and treatment.
Additionally, for the following specialized clinics, the person in charge of the technical professional aspects must meet these conditions:
+ Rehabilitation Specialized Clinic: Be a doctor with a certificate in physiotherapy or rehabilitation;
+ Drug Addiction Treatment Clinic: Be a psychiatrist, a general practitioner with a psychiatry training certificate, or a traditional medicine specialist with a training certificate in drug addiction treatment using traditional medicine methods;
+ HIV/AIDS Treatment Clinic: Be an infectious disease specialist or a general practitioner with a certification in HIV/AIDS treatment training;
+ Nutrition Consultation Clinic: Be a nutrition specialist or a general practitioner with a training certificate in nutrition;
+ Aesthetic Specialized Clinic: Be a specialist in plastic surgery or plastic surgery aesthetics;
+ Andrology Specialized Clinic: Be a specialist in andrology or a general practitioner with a training certificate in andrology.
b) Besides the person in charge of the technical professional aspects of the specialized clinic, other personnel working in the specialized clinic who are also involved in medical examination and treatment must have a professional practice certificate and be assigned tasks appropriate to the scope of professional activities recorded in their practice certificate.
In addition to meeting the conditions for obtaining an operational license for medical examination and treatment facilities, specialized internal medicine clinics must also meet the following conditions for specialized clinic licenses:
Infrastructure:
- In cases of performing procedures, including dental implant techniques, acupuncture, massage, and acupressure, a separate room or area dedicated to these procedures must be available. - The person in charge of the technical professional aspects of the specialized internal medicine clinic must meet the following conditions:+ Be a doctor with a professional practice certificate in internal medicine for the clinic being registered.+ Have at least 54 months of experience in the specialized field of internal medicine.- Besides the person in charge of the technical professional aspects, other personnel working in the specialized internal medicine clinic who are also involved in medical examination and treatment must have a professional practice certificate in internal medicine and be assigned tasks appropriate to the scope of professional activities recorded in their practice certificate.
