What are the regulations on awarding titles of People's Teacher, Teacher of Merit in Vietnam under the Decree 35/2024/ND-CP?
On April 2, 2024, the Government issued Decree 35/2024/ND-CP to establish regulations on the awarding the titles "People's Teacher" and "Teacher of Merit".
Decree 35/2024/ND-CP provides guidelines on the subjects, principles, criteria, evaluation boards, application documents, procedures, and sequence for the awarding the titles "People's Teacher" and "Teacher of Merit".
The subjects covered by Decree 35/2024/ND-CP include:
- Teachers, education managers, and education researchers, including:
+ Teachers and managers at educational institutions who are responsible for the care, nurturing, and teaching (referred to as teaching) according to the regulations of the Education Law.
+ Managers responsible for educational management in educational management agencies according to legal provisions (referred to as managers in educational management agencies).
+ Education researchers engaged in scientific research on education and training, vocational education.
+ Retired teachers, education managers, and education researchers who are eligible for social insurance benefits between two consecutive evaluation periods.
+ Retired teachers, education managers, and education researchers who continue to work as teachers, lecturers, or managers in private and semi-private educational institutions.
- Organizations and individuals involved in the process of awarding the titles "People's Teacher" and "Teacher of Merit".
Decree 35/2024/ND-CP: What are the regulations on awarding titles of People's Teacher, Teacher of Merit in Vietnam?
What are the principles and criteria for awarding the titles of "People's Teacher" and "Teacher of Merit" in Vietnam?
Pursuant to Article 4 of Decree 35/2024/ND-CP, principles and criteria for awarding the titles of "People's Teacher" and "Teacher of Merit" are as follows:
- The achievements for awarding the titles of "People's Teacher" and "Teacher of Merit" must be obtained during the working time in the education sector. Achievements that have already been considered and awarded with honorary titles by the State, including National Physician, Specialist Physician, People's Artist, Excellent Artist, People's Artisan, and Excellent Artisan, cannot be used to apply for the titles of "People's Teacher" and "Teacher of Merit".
- The time spent in centralized training after being recruited into the education sector by competent authorities is considered as working time in the education sector and is not counted as direct teaching time.
- In the process of awarding the titles of "People's Teacher" and "Teacher of Merit", if an individual changes their position, the evaluation will be based on the position at the time of submitting the application to the local evaluation council.
- Individuals who receive salary and annual commendation and reward at a certain unit should apply for the titles of "People's Teacher" and "Teacher of Merit" at that unit.
- For teachers, education managers at educational institutions, and education researchers who have held management positions for 36 months or more, or for 3 academic years or more until the time of submitting the application for the titles of "People's Teacher" and "Teacher of Merit", the collective achievement criteria specified in Clause 5 of Article 7 and Clause 5 of Article 8 of Decree 35/2024/ND-CP shall be applied.
- The awarding of the titles of "People's Teacher" and "Teacher of Merit" should focus on teachers directly nurturing and teaching; teachers and education managers directly organizing educational activities, teaching disabled people and students with special circumstances; teachers and education managers working in border areas, on the sea, in island areas, and in areas with particularly difficult socio-economic conditions as stipulated by the Government (referred to as areas with particularly difficult socio-economic conditions).
- The working time of teachers and education managers in areas with particularly difficult socio-economic conditions shall be implemented according to the regulations in Clause 4 of Article 64 of the Law on Emulation and Commendation 2022.
Education managers at educational institutions who have participated in nurturing and teaching according to the minimum quota specified in the working regime of teachers shall have their direct teaching time counted and converted as follows:
+ Education managers at educational institutions directly nurturing and teaching up to 30% of the teaching hours/class periods according to the working regime of teachers shall have a conversion coefficient of 0.3 compared to teachers directly nurturing and teaching.
+ Education managers at educational institutions directly nurturing and teaching from 31% to less than 60% of the teaching hours/class periods according to the working regime of teachers shall have a conversion coefficient of 0.6 compared to teachers directly nurturing and teaching.
+Education managers at educational institutions directly nurturing and teaching from 60% to 80% of the teaching hours/class periods according to the working regime of teachers shall have a conversion coefficient of 0.8 compared to teachers directly nurturing and teaching.
+ Education managers at educational institutions directly nurturing and teaching from 81% of the teaching hours/class periods according to the working regime of teachers and above shall have a conversion coefficient of 1 and no conversion is required.
- The evaluation councils for awarding the titles of "People's Teacher" and "Teacher of Merit" at all levels can only submit applications to competent authorities for cases that meet the conditions, criteria, sequence, procedures, and documents as prescribed in Decree 35/2024/ND-CP.
Vietnam: When does Decree 35/2024/ND-CP come into force?
Pursuant to the provisions of Article 18 of Decree 35/2024/ND-CP, the regulations are as follows:
Effect
1. This Decree shall come into effect on May 25, 2024.
2. Decree No. 27/2015/ND-CP dated March 10, 2015 of the Government on awarding "People's Teacher" and "Teacher of Merit" shall cease to be effective from the effective date of this Decree.
Therefore, based on the above provisions, Decree 35/2024/ND-CP comes into force from May 25, 2024.
